your reply. Please show these on maps of suitable scale (for instance I" = 100 feet) so we can begin to determine your
projects' compliance with 15A NCAC 2H .0500.
o Based on information provided with a fax received by the DWQ'pn May 11,2004, it appears that lots 18 and 20 of
"The Villas at Falls Lake were subdivided and platted and recd~ded on September 14, 2001. The Neuse River
Buffer Ru1e became effective on Ju1y 22, 1998, prior to the subdivision of this property. The DWQ has determined
that this property cou1d have been subdivided such that a variance from the Neuse River Buffer Ru1e wou1d not be
required. Also, the DWQ believes that homes could be constructed on Lots 18 and 20 without impacting the
protected buffers. As such, the DWQ believes that your request does not meet the requirements for granting a
variance (15A NCAC 02B .0233(a)(a)) and thereforeDWQ cannot approve your request for a Minor Variance from
the Neuse River Buffer Ru1e. You are welcome to provide additional justification and information as to how your
request meets the variance requirements or to redesign this project to meet the requirements of the rule.

I have received your letter concerning the buffer variance request. I have
enclosed with this fax sketches of the two lots and the date ofreCoIdation for
the subdivision. Your letter suggests that you will probably deny tlle variance
requeSt, but I would like to add that it would be a tremendous help if you were
to grant a variance for only one lot. We had originally submitted a request for
three lots and it was then reduced to two because of a buyer selection for one

Dear Mr. Zarzecki:
On behalf of The Villas at Falls Lake, LLC (property owner), we hereby
request a minor variance be issued from the North Carolina Division of
Water Quality for two proposed lots in the Dalton's Ridge Subdivision. A
completed Variance Request Form is attached as well as an agent
authorization form.
The subject property is located immediately west of Falls of Neuse Road
approximately 1.4 miles north of the intersection of Falls ofNeuse Road and
Raven Ridge Road in northern Raleigh (Wake County). The attached
portion of the Wake Forest, NC USGS map depicts the location of the site
No stream impacts are proposed for this area so there is no associated
401/404 requested. The proposed impacts will result from the construction
of houses on 2 residential lots (lots 18 and 20) as shown on the attached
map. Resulting construction impacts will total 1124 ft2 of Zone 2 impact
(see attached site plans). Lot 18 requires 580 ft2 and Lot 20 requires 544 ft2

1. Description of proposed activity [Also, please attach a map of sufficient detail (such as a plat
map or site plan) to accurately delineate the boundaries of the land to be utilized in carrying
out the activity, the location and dimension of any disturbance in the riparian buffers
associated with the activity, and the extent of riparian buffers on the land. Include the area
of buffer impact in fe.]:
The proposed impacts will result from the construction of houses on 2 residential lots (lots
18 and 20) as shown on the attached map. Resulting construction impacts will totall124

2. State reasons why this plan for the proposed activity cannot be practically accomplished,
reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers:
The stream that flows along the northwestern property line flows almost through the
center of lot 20 and along the back lot line of lot 18. Given the proximity of the existing
subdivision road and the 50' riparian buffers, little space is left to construct houses of a
similar nature that exist within the rest of the subdivision.
3. Description of any best management practices to be used to control impacts associated with
the proposed activity (Le., control of runoff from impervious surfaces to provide diffuse flow,
re-planting vegetation or enhancement of existing vegetation, etc.):
During the construction of these homes silt fencing will be used to control runoff and to
prevent sediment from entering the stream. The remaining portion of zone 2 will be
revegetated primarily with herbaceous cover. Zone 1 of the buffers within the lots is well
vegetated with trees etc. and would most likely not benefit any by planting additional
vegetation.
4. Please provide an explanation of the following:
(1) The practical difficulties or hardships that would result from the strict application of this
Rule.
If the proposed lots 18 and 20 are not granted minor variances, most likely the lots will be
lost or at the very least houses will be built that are not in keeping with the existing
houses. The existing roads, building offsets from the lot lines (10' from each line) and the
road (20' from easement), and the riparian buffers reduce the house footprint area
considerably making the resulting house footprint much smaller than the surrounding
houses.
(2) How these difficulties or hardships result from conditions that are unique to the property
involved.
Given the angle that the stream channel enters the property and then flows at an acute
angle with the property line, long lots were required in order to make the lots buildable. In
particular lots 18 and 20 are difficult to build on because a significant portion of the lots is
within the riparian buffer. Lot 20 especially has the stream and its buffer in roughly half
of its lot area. A small portion of lot 20 that would otherwise be usable upland area is
"isolated" on the opposite side of the stream channel from the existing road.
(3) If economic hardship is the major consideration, then include a specific explanation of the
economic hardships and the proportion of the hardship to the entire value of the project.
The loss of either of the lots would be a significant economic hardship for the developer.
