Approval from DWQ is required to disturb these areas. Please provide 7 copies of the following information and
refer to the DWQ # listed above in your reply. Please show these on maps of suitable scale (for instance 1" = 100
feet) so we can begin to determine your projects' compliance with 15A NCAC 2H .0500.
1. Please provide a better justification for crossing. Why is this crossing needed when you already have
an existing access road and/or planned road to SR 23Q6?
2. Stormwater management will be needed since the site is in a buffered basin.
3. Please provide a plan showing, which development exiSts and what is proposed?

procedural materials. This project will remain on hold as incomplete in accordance with 15A NCAC 2H .0505(c).
The processing time for this application will begin when this information is received. If we do not hear from you

Approval of 401 Water Quality Certification and Authorization Certificate per the Neuse
River Buffer Protection Rules (15A NCAC 2B .0233) with Additional Conditions
To Whom It May Concern:
You have our approval, in accordance with the attached c6nditions and those listed below, to
place fill within or otherwise impact 0.025 acres of wetland~, 110 feet of streams and 11,000
square feet (ft2) of protected riparian buffers for the purpose of installing a road at the subject
property, as described within your application dated April 23, 2004 and received by the N.C.
Division of Water Quality (DWQ) on April 27, 2004 including additional information received
on June 2, 2004 and June 8, 2004. After reviewing your application, we have decided that the
impacts are covered by General Water Quality Certification Number(s) 3404 (GC3404). The
Certification(s) allows you to use Nationwide Permit(s) 14 when issued by the US Army Corps
of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for
impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you should
obtain or otherwise comply with any other required federal, state or local permits before you go
ahead with your project including (but not limited to) Erosion and Sediment Control and Non-
discharge regulations. Also, this approval to proceed with your proposed impacts or to
conduct impacts to waters as depicted in your application shall expire upon expiration of
the 404 Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

1. Impacts Approved - The following impacts are hereby approved as long as all of the other
specific and general conditions of this Certification (or Isolated Wetland Permit) are met. No
other impacts are approved including incidental impacts:

2. Erosion & Sediment Control Practices - Erosion and sediment control practices must be in
full compliance with all specifications governing the proper design, installation and operation
and maintenance of such Best Management Practices in order to protect surface waters
standards:
a. The erosion and sediment control measures for the project must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion
control measures must be such that they equal, ''Or exceed, the requirements specified
\
in the most recent version of the North Carolina, Sediment and Erosion Control
\
Manual. The devices shall be maintained on all tonstruction sites, borrow sites, and
waste pile (spoil) projects, including contractor-owned or leased borrow pits
associated with the project.
3. No Waste, Spoil, Solids, or Fill of Any Kind - No waste, spoil, solids, or fill of any kind
shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts
depicted in the Pre-Construction Notification. All construction activities, including the
design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality
standards, statutes, or rules occur.
4. No Sediment & Erosion Control Measures win Wetlands or Waters - Sediment and
erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters
is unavoidable, they shall be removed and the natural grade restored within six months of
the date that the Division of Land Resources has released the project.
5. Certificate of Completion - Upon completion of all work approved within the 401 Water
Quality Certification or applicable Buffer Rules, and any subsequent modifications, the
applicant is required to return the attached certificate of completion to the 401/Wetlands
Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC,
27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed

impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification, shall expire upon expiration of the 404 Permit.
If you do not accept any of the conditions of this Certification (associated with the approved ._
wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the
approved buffer impacts) shall be referred in writing to the Director for a decision. The
Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
Water Act and the Neuse riparian buffer protection rule as described within 15A NCAC 2B

Dear Mr. Dorney:
This is in response to your letter dated May 26, 2004 requesting additional information to
Hephzibah Baptist Church's request for constructing a Parking Lot Street Connector in
Wake County.
Question 1
The crossing is needed to access SR 2473. The connection to SR 2473 is needed to
provide ingress and egress from the property for members who live east of the church.
Currently these members enter and leave the property on US 64 Business where it
intersects NC 97. As shown on the site plan, this intersection is a maze of islands, ramps,
signal lights, and acceleration lanes. This intersection has been the site of numerous
accidents with serious injuries and most recently loss of life. As a testament to the
dangers of this intersection, although the intersection is not in the city limits of Wendell,
the Wendell Commissioners have targeted this intersection as the most dangerous in
Wendell and have asked that NCDOT redesign this intersection.
The construction of this connector will allow approximately 30% of our membership to
exit towards Wendell without entering the intersection of US 64 Business and NC 97.
The approach to the US 64 Business and NC 97 intersection from the west is a 4 lane
divided uphill grade. This requires drivers leaving the church to determine if an
approaching car is in the right lane to go to Wendell or if it is in the left lane to go to
Zebulon while looking at the car from the headlights up. The tires of the car and
pavement markings cannot be seen until the car crosses SR 2366. Also, the speed limit
changes from 55 mph to 45 mph at the western edge of the church property. The cars
that pass by the existing driveways are traveling between 60 mph to 50 mph and are
beginning to slow down. The intersection of US 64 Business and SR 2473 is
approximately 800 feet past the speed limit sign and cars are traveling much slower. The
approach to this intersection is on a slight down hill slope and allows drivers leaving the
church to see the entire car and know that that the car is in the through lane.
The driveway onto SR 2366 does not help the safety of members who live in Wendell at
all. Members who live in Eagle Rock, Knightdale, or south and west of the church use
the driveway onto SR 2366. The construction of this driveway has allowed for these

members to enter and leave the church without having to enter onto US 64 Business and
has greatly alleviated traffic congestion at the main entrance to the church, but it in no
way helps the members who live east of the church.
The construction of the new driveway establishes a traffic pattern that circles the
buildings instead of driving between the buildings. As shown on the plan, the existing
main entrance goes between the Worship Center and Family Life Center buildings. The
connector to SR 2473 provides a traffic pattern that allows all of the members to enter
and exit the property without having to use the main entrance between the buildings.
This is especially important during evening activities because members including
children walk between the buildings for various activities. Accidents have occurred
when children have run in front of cars while going between buildings.
Question 2
Stormwater management is not required for this ,site. WQC #3404 states, "Additional ~~\
site-specific stormwater management requirements may be added to this Certification at , 1->\}
DWQ's discretion on a case by case basis for projects that have or are anticipated to have ~ if...
impelVious cover of greater than 30 percent." The existing impervious surface for the ~Q}>'~
church property is 25.8 percent. Upon completion ofthe construction of the connector, (\'^
the impervious surface will be 26.4 percent. The property does not have nor is it \(y ~'~r--~ '" *'~
anticipated to have greater than 30 percent impervious surface; therefore, stormwater '0
management is not required.
Question 3
I have attached 7 additional copies of the same plan sent to you on April 27. Everything
shown on the plan with a dashed line exists i.e. everything except the new connector.
The proposed construction is the solid lines showing the proposed connector. This is
standard engineering notation for plan preparation.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Unable to avoid impact because the stream that we are crossing runs the entire length of the
property and parallels the road we need to connect with. Minimized the impact bv selecting the
crossing site that the existing parking lot was in the riparian buffer area and close to the stream
thus minimizing riparian buffer area being disturbed bv new construction.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.

If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr .state.nc. us/ncwetlands/ strmgide.html.
