Neil Styers Post Office Box 12247 Gastonia, NC 28052 Subject Property: Lot# 64, Woodland Bay, Belmont, NC Dear Mr. Styers: You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact approximately 0.01 acres of waters and 0.003 acres of protected riparian buffers on Lake Wylie for the purpose of installing rip rap to stabilize shoreline, as described within your application dated April 19, 2004. After reviewing-your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3373 (GC3373). The Certification(s) allows you to use Regional General Permit No. 198200030 when is'sued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0243. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Duke Power regulations and permits. Also, this approval will expire when the accompanying 404 pemiit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Riparian Buffer Rule: The main-stem of the Catawba River below Lake James and along the main-stem lakes from and including Lake James to the North Carolina and South Carolina Border is subject to riparian (streamside or lakeside) buffer rules. The purpose of these rules, are to protect and preserve riparian buffers. That is, these rules help to maintain the pollutant removal functions of the streamsidellakeside areas necessary to protect surface waters. Specifically, this Rule applies to the 50-foot wide riparian buffers as described in 15A NCAC 02B .0243 (4)). Further, the protected riparian buffer has two zones as follows: (a) Zone 1, the 30 foot zone closest to waters edge, shall consist of a vegetated area that is undisturbed except for uses provided for in Subparagraph (6) of 15A NCAC 2B .0243, and (b) Zone 2 [the outer 20 feet, land-ward from the outer 30 foot edge of N. Page 2 Mr. Styers April 29, 2004 zone 1] shall consist of stable vegetated area that is undisturbed except for activities and uses provided for in Subparagraphs (4) and (6) of 15A NCAC 2B .0243. Accordingly, this 401 Water Quality Certification and Catawba Buffer authorization allows you to install the shoreline stabilization measures as stipulated in your application and this Certification. The construction area, the area located immediately adjacent to the shoreline, may only extend landward to a distance necessary to install the proposed shoreline structures. This construction area must be stabilized immediately upon the completion of the work. Also, this approval does not authorize grading or land disturbance of Zone I, beyond the area necessary to install the shoreline measures or the removal of vegetation, beyond what is authorized in the Catawba Buffer Rules. (Note: Zone 1 is measured from the top or of bank landward for 30 feet). 2. Erosion and Sediment Control Practices: Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation, and operations and maintenance of such Best Management Practices: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Erosion and Sediment Control Manual. b. The design, installation, operation, and maintenanc,e of the erosion and sedimentation control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Erosion and Sediment Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. If land disturbance amounts are below the thresholds, where a Division of Land Resource (DLR) or a DLR delegate program approved Erosion and Sedimentation Control Plan is not required, then measures and control practices must be installed such that sedimentation to waters is prevented. 3. Sufficient, materials required for stabilization and/or repair of erosion control measures shall be on site at all times. The streamside area/pond side areas must be stabilized within 30 days of receipt of the Certification. 4. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0243(5). 5. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. f Page 3 Mr. Styers April 29, 2004 If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C.27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. . Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Catawba riparian buffer protection rule as described within 15A NCAC 2B .0243.
