A copy of the Compliance Inspection Report is enclosed for your review. The time and assistance provided by you and Mr. John Fearrington with Smith Gardner during the inspection is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES General Permit NCG020000 under Certificate of Coverage NCG020628. Permit coverage authorizes the discharge of stormwater, mine dewatering and process wastewater from the facility to receiving waters designated as Little Coharie Creek (Sinclair Lake), a Class C;Sw waterbody in the Cape Fear River Basin. As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG020000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. Reviewed the Stormwater Pollution Prevention Plan for the SCD Mine site, which needs to be updated to include current contact/responsible party information and listing of any significant spills or notation that none have occurred on an annual basis. Although the mine site has remained inactive for several years, monitoring is conducted/recorded quarterly under the wastewater discharges section of the NCG020000 permit, specifically as commingled stormwater and mine dewatering. Mine site has two distinct outfalls, each of.which is a concrete weir spillway located on the back side of the mine's affected boundary. Monitoring records reviewed indicate results meeting associated effluent limits or no discharge for respective periods. Due to the prolonged inactive status of the mine, a discussion was held about the possibility of granting dormant status upon request. After the records review, site observations were made at the mine. At the time of inspection, there was no flow/discharge at either of the outfalls.
