E. 2nd Street Snow Hill, NC 28580 FAX (252-747-5111) Subject Property: NC Hwy 33 & Tucker Rd, Parcel Number 056138, Greenville, NC UT to Phillippi Branch [03-03-05, 28-98.6, C NSW (nutrient sensitive)] On-Site Determination for Applicability to the Tar-Pamlico River Riparian Area Protection Rules (15A NCAC 28 .0259) Dear Mr. Barrow: On April 1 , 2004, at your request I conducted an on-site determination to review a surface water located on the subject property for applicability to the Tar-Pamlico Buffer Rules (15A NCAC 2B .0259). The surface water is labeled as "04- 0636" on the map below. Division of Water Quality (DWQ) Staff from the Washington Regional Office (WaRO) had previously conducted an on-site determination of the surface water. In your letters dated December 2, 2003 and March 4, 2004, you requested an appeal of their determination as provided within 15A NCAC 02B .0259(3)(a). Other DWQ staff present during my determination included Mr. John Dorney and Mr. Danny Smith of the DWQ Wetlands/401 Unit. During my review I evaluated the surface water using the DWQ Stream Classification Form. I evaluated the section of the surface water from the field road crossing to the large Sycamore tree and calculated the score to be 16.25 points. I evaluated the section of the surface water from the large Sycamore tree to NC Hwy 33 and calculated the score to be 30.5 points. The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent". Also, I evaluated the pond and surface water section above (west) of the field road crossing and determined it to be an agricultural irrigation pond and ditch. The OWQ has determined that the surface water labeled as "04-0636" on the map above is at least an "intermittent" modified natural stream and is subject to the Tar-Pamlico Buffer Rule starting at the large sycamore tree (approximated on the map above). The OWO determined that the surface water above (west) of the large sycamore tree is an agricultural irrigation pond and ditch and is exempt from the Tar-Pamlico Buffer Rule. This determination shall replace the determination originally performed by the Regional Office. This stream and it's associated buffers should be identified on any future plans for this property. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This on- site determination shall expire five (5) years from the date of this letter. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State.
