I just got the attached letter from DEMLR related to the discussion below. The attached letter specifies a minimum
release requirement of inflow or 1.9 cfs. I was unaware of this requirement during the initial project review in 2017.

Chris and I worked with the applicant in 2015 to get a minimum flow during the project locked in. I don't
know if we ever involved you (if not, our bad) — but we settled on a minimum of 2 cfs. You can see the
discussions and how we got there in the attachments. See what you think.

Hey Fred,
Andrew Moore and I have a permit application for lake dredging (and other lake improvements) in Avery County. We're
just starting our review. Comments are due to the USACE on 10/23 per their public notice.
Here's the LF file.
This project came up a couple years ago (but they didn't finalize it) and Andrea Leslie recommended a minimum release
flow which they have incorporated into their current application.
Please let me know by 10/11 if you have any comments or concerns. That will give us time to discuss further prior to
developing comments to go to the USACE/applicant.

Dear Mr. Clyfton:
Pursuant to the Dam Safety Law of 1967 (General Statute §143-215.23 at
sec.) and the rules promulgated thereunder (the North Carolina Administrative Code,
Title 15A, Subchapter 2K), the referenced dam is subject to the minimum
streamflow release requirements as outlined in G. S. § 143-2.15.31 and 15A NCAC
2K .0500. Minimum streamflow releases which are required from dams are
necessary to ensure that stream classifications, water quality standards and aquatic
habitat- requirements are met and maintained.
The Division of Water Resources (DWR) has investigated concerns regarding
the possible need for establishing a minimum streamflow release from the
Grandfather Mountain Dam to the downstream reach of the Linville River: The
following offers some background regarding the dam and its impoundment:
Loch Dornie is a recreational impoundment on the Linville River which is
impounded by the Grandfather Mountain Dam. The dam is located on a reach of the
Linville River which has beendesignated as Class C Trout Waters by the Division of
Water Quality (DWQ). Two National Pollutant Discharge Elimination System
(NPDES) permits - NCO023124 and NCO039446 - exist for this reach of the Linville
River from Loch Donnie to the confluence with the West Fork Linville River, The
summer 7Q70 (i. e., the sustained seven-day low flow with a probability of
occurring once every 10 years) for the upstream NPDES permit (NC0023124) is 1.9
cubic feet per second (cfs).

Based on recommendations from the DWR, this letter serves to require that Grandfather
Golf and Country Club shall meet the fallowing requirements ass condition for operation of this
dam:
1. A continuous, instantaneousminimum streamflow release equal to the rate of inflow to the
lake or equal to the 7Q70 flow rate of 1.9 cfs, whichever is greater, shall be released from -
the Grandfather Mountain Dam to the downstream waters of the Linville River.
2. A staff gage shall be installed in the Linville River downstream from the dam. The staff
gage shall be calibrated to the 7010 flow release equal to 1.9 cfs
(It is suggested that apermanent surveying benchmark be established in the vicinity of the
staff gage in order to survey the water surface elevation corresponding to a flow rate of 1.9
cfs. Such a benchmark will also allow installation of a new staff gage in the event that an
established staff gage is damaged. It is not necessary to survey and establish the
permanent surveying benchmark using mean sea level, National Geodetic Vertical Datum
1929, or North American Vertical Datum 1988 elevations.)
3. If the impoundment is used for irrigation purposes, including, but not limited to, golf course,
residential lawn, or crop irrigation, then a calibrated staff gage shall be installed in the
Linville River upstream of the impoundment to measure the inflow to the lake.
4. - If the lake is lowered such that the water surface elevation of the lake is below the top of
the spillway as a result of irrigation withdrawals, then the minimum streamflow release as
set forth in Condition No. 1 above shall be maintained downstream through the dam's
bottom drain releasemechanism or another means approved by the DivisionofLand

5. If the lake is lowered for maintenance purposes such that the water surface elevation of the
lake is below the top of the spillway, a minimum. streamflow release equal to the 7010 of
1.9 cfs or the inflow, whichever is less, shall be maintained downstream through the dam's
bottom drain release mechanism or another means approved by the DLR until the
impoundment is refilled and minimum streamflow release requirements are met by
discharges over the spillway.
6. The staff gage or gages shall be installed, calibrated and maintained following procedures
described in the United States Geological Survey Water Supply Paper 2175 entitled
"Measurement and Computation of Streamflow." - -
7. The plans for the staff gageorgages and the mechanism to provide minimum streamflow
releases shall be submitted to the DLR and the DWR fol review and approval prior to
..installation.

8. Calibration of the staff gage or gages shall be verified at least every two years. All initial
calibration and re -calibration measurements, including field data, shall be provided to the
DLR and the DWR within 30 days of completion.
The Conditions of Operation for the Grandfather Mountain Dam as described herein are
effective immediately. It is requested that a schedule for implementation be submitted to this
office within 30 days of receipt of this letter.
