9. PROJECT DESCRIPTION:
John Pierce with John Pierce and Associates, P.A., on behalf of Homeco Builders, Inc., AP Construction and Pierce-Rizzo
Development, LLC, has requested that the attached application be processed under the Express Permit Review Pilot
Program.
The applicant's project is located along N.C. State Highway 210, approximately 1.5 miles north of the intersection of N.C.
Hwy 50 and N.C. Hwy 210, adjacent to Stump Sound, in Surf City, Pender County. To fmd the property, take Highway 17
North from Wilmington and turn right on N. C. State Highway 50 (approximately 30 miles from Wilmington). Head east on
Hwy 50 and turn left onto Hwy 210 at the intersection of Hwy 210 and Hwy 50. The property is located on the western side
of Hwy 210, approximately 1.5 miles from the intersection of Hwy 210 and Hwy 50.
The applicant has submitted an Express CAMA Permit Application to develop approximately 0.84 acres, of a 2.07 acre
tract located between Highway 210 and the AIWW, adjacent to Stump Sound. The high ground portion of the tract is
mostly cleared of vegetation and is relatively flat with an elevation of 4.0' to 5.0' above Mean High Water (MHW).
Several small stands of Southern Wax Myrtle (Merica cerifera), Yaup on (flex vomitoria), and Red Cedar (Juniperus
virginiana) exist on water ward side of the site, bordering Stump Sound. The property has approximately 335 linear feet of
shoreline along Stump Sound. The high ground vegetation is bordered by transitional species including Sea Oxeye
(Borrlchiafrutescens) and Grounsel-bush (Baccharus halimifolia). High coastal marsh vegetation including Black Needle
Rush (Juncus roemarianus), Spike Grass (Distichlis spicata) and Sea Lavender (Limonium, spp., exist in the inter-tidal
zone. Salt Meadow Grass (Spartina patens) complete the transition to the waters edge where Smooth Cordgrass Marsh
(Spartina altemiflora) is the predominant species. The shoreline in this area is not bulk-headed. The proposed development
averages approximately 98 feet landward of mean high water (MHW), along the western edge of the property. There are
four (4) existing duplex units located on eight (8) of the twelve (12) lots within the entire subdivision. The individual duplex
units were approved by the issuance of CAMA Minor Permits by the Town of Surf City. The Town of Surf City, however,
informed the applicant to cease project development because it was determined that the total land disturbance was in excess
of one (1) acre, As such, the owners were required to submit a CAMA Major development permit application. The
proposed work included as part of this application package involves the construction of two (2) additional duplex units,
utilities and access drives.
The waters of Stump Sound adjacent to the project are classified as SA by the North Carolina Division of Water Quality.
They are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are open to the
harvest of shellfish. The subject property is located within the High Hazard Flood Area, as indicatedby Zone VB (elevation
12) on the Flood Insurance Rate Map. The High Hazard Flood Area (VE Zone) associated with the subject property is
contiguous to the Atlantic Ocean.
PROPOSED PROJECT
The applicant proposes to construct two (2) additional buildings (or four (4) duplex units), on four (4) lots within the 2.07
acre tract. Additionally, the applicant proposes to clear, grade and pave an additional 0.84 acres of the tract for utilities and
access driveways. The total disturbed area for the entire project would be 1.4 acres. Individual lots sizes would average
7,504 square feet - a density of 6 units/acre. Access to the lots will be provided by the construction of a single road
(Waters Drive). The road would provide the subdivision with one entrance and exit from Highway 210. The asphalt road
would parallel NC Hwy 210 and would extend from one end of the subdivision to the other. Waters Drive would consist of
a 25 foot right-of-way and a 18 foot paved asphalt surface with an ABC stone sub-base. The road would be constructed with
curb and gutter, utilizing curb breaks and vegetated swales to control stormwater. An Express Stormwater Permit
(SW8031222) was issued by the Division of Water Quality on 4/13/2004. A Sedimentation and Erosion Control Plan '
(permit #-Pende-2004-121) has been issued for land disturbance activities. Municipal water and sewer would be provided by
the Town of Surf City.

As proposed, no portion of the subdivision, including but not limited to the dwellings, eaves, access roads, driveways,
streets and/or sidewalks will impact any portion of coastal wetlands or "404" type wetlands.
10. ANTICIPATED IMPACTS:
The initial grading of the property (for the two proposed duplex units) would result in the disturbance of an additional 0.84
acres of high ground, with a total of 1.40 acres being disturbed by all proposed development. The proposed dwellings, and
drives would result in the creation of approximately 0.46 acres (20,038 square feet) of impervious surface. Total
impervious surface coverage within the 75' Estuarine Shoreline AEC would be 8 %. The applicant has received an Express
State Stormwater Permit from the Division of Water Quality (Stormwater Project #8031222), as well as a Sedimentation and
Erosion Control Plan from Division of Land Quality (Permit #Pende-2004-121).

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
, setbacks and dune alteration are designed to minimize, but
not eliminate, property loss from hazards. By granting

liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean

This structure shall be relocated or dismantled within two
years of becoming imminently threatened.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued for developmentin this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is im por-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
. placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line 'established. It is unlawful to continue work
after permit expiration without this approval.
