This letter is to inform you of our POA as required in section VI.3 GENERAL CONDITIONS of our
NPDES Permit, (NC0086614). We will outline in the following paragraphs the actions that we will take in the
event that we measure a freeboard level of less than 19 inches. If we are unable to obtain a level of less than 19
inches within 24 hours by pumping the waste to another lagoon within the system, we will implement the
following POA:
The first step that will be taken to reduce the freeboard level will be to land apply the waste onto fields which
have adequate PAN and established- crop cover. The waste will be applied in a manner not to cause runoff from
the field.
The second step will be to pump and haul the waste to another lagoon that is owned by DM Farms which has
adequate freeboard. We will obtain approval from DWQ prior to utilizing this option.
When a level of less than 19 inches is measured in any lagoon this POA will be implemented and the
appropriate agencies will be notified and the required paperwork forwarded.
