Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated May 4, 2004. The applicant, Pointe West, LLC, has applied for a Department of the Army (DA) permit to construct a community pier and dock. The proposed work is being considered under Regional General Permit 198000291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (CAMA), These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16U,S,C, 661-667d), Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection offish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C, 1531-1543), Proposed Activities The applicant proposes to construct a community pier and dock with boat lifts to provide water access for the lot owners of the Pointe West subdivision. The Field Investigation Report (FIR) of the North Carolina Division of Coastal Management (NCDCM) states that no dredging or wetland fill would be required. The community boating facility would have 10 boat slips (each with a boat lift), a 16-foot by 16-foot gazebo, a 16-foot by 16-foot open deck. The boating facility would be located in the Atlantic Intracoastal Waterway (AIWW). Twenty mooring pilings would be installed to create the boat slips, Access to the facility would be provided by a six-wide, 365-foot long pier, ~ ,. 2 Environmental Impacts The FIR states that the proposed work would impact 1,320 square feet (ft2) of vegetated coastal wetlands. Impacts, in the form of incorporation, on unvegetated open water are variously given in the FIR as 6,068 ft2 (Item 7) and 2,068 ft2 (Item 10). ' The FIR gives no indications that areas of submerged aquatic vegetation (SA V) would be impacted, The AIWW in the project vicinity is not designated as a primary nursery area, The vegetated wetlands to be impacted are described as intertidal. Therefore, we assume that the proposed work would not adversely affect SA V. Federally Protected Species The Service has reviewed available information on federally-threatened or endangered species known to occur in Brunswick County, We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S, Geological Survey (USGS), Data from USGS quads provide the most project-specific information on species which should be considered in permitting this project. The project area is located in the Holden Beach quad, The occurrence data of special status species within these quads can be obtained on the internet at < http://www.ncsparks.net/nhp/quad.html >. Our review indicates that the only federally listed species likely to occur in the proj ect area is the West Indian manatee (Trichechus manatus), a federally-endangered mammal. The species is known to occur in the coastal waters of Brunswick County as the animals move along the Atlantic Coast during summer months, primarily from June through October, The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site, Manatees may use waters one to two meters (3.3 -6,6 feet) deep, The FIR states that application data show water depths at the proposed docking location to range from -2,00 to -2.7 feet at mean sea level (MSL), Since mean low water is -1.8 feet MSL, the water at or near the docking facility could be accessible to manatees during high tide, Service Recommendations The Service is concerned that low piers could harm marsh vegetation by blocking sunlight. Supplemental sheet A in the FIR indicates that the "bottom of decking" would have a minimum clearance of three feet above the marsh substrate. While the actual clearance is unclear, the Service believes that three feet is not enough to ensure adequate sunlight penetration. Smooth cordgrass (Spartina alterniflora) can range from one to eight feet tall. We recommend that the lowest part of any structure build over vegetated wetlands should be least four feet above the bottom. A minimum elevation of four feet is a special condition of the Corps' Regional General Permit #197800056. -"', .. 3 The potential presence of manatees in the AIWW near the project site will not prevent construction, However, simple measures should be taken to avoid harm to this endangered species, The risk to manatees during construction can be reduced by implementing the "Guidelines for Avoiding Impacts to the West Indian Manatee - Precautionary Measures for Construction Activities in North Carolina Waters." These guidelines are available on our web site at < http://nc-es,fws.gov/mamma1/manatee guide1ines,pdf>, The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if a manatee approaches the work area, work should not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee, The risk to manatees would be further reduced by performing the work during the period of November through May, The FIR indicates that the proposed work would not result in a major loss or degradation of fish and wildlife habitat. With the inclusion of an objective standard for the minimum elevation (four feet) of structures over vegetated areas as a permit condition, we do not believe that the proposed activity will have significant adverse and/or irreversible effects on general fish and wildlife resources under our jurisdiction. Therefore, from the perspective of the FWCA and the 404(b)(1) guidelines, the Service has no objection to the issuance of such an amended DA permit. From the perspective of the ESA, the Service manatee guidelines should be part of the DA permit. With the inclusion of these guidelines, Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. PROJECT DESCRIPTION '~...j , 'j The project is located off Tide Ridge Drive, in the Pointe West Subdivision on the western end of Holden Beach adjacent to the AIWW in Brunswick County. The project site is a .87 acre subdivision common area that begins as a pathway leading to the AIWW from the north side of Lot 21. To get to the property take US 17 to Shallotte, then follow NC 130 towards Holden Beach. Continue to follow NC 130 as it turns right and cross over the Holden Beach Bridge. At the base of the bridge, tuln right onto Ocean Boulevard West. Travel west about 5 miles - be prepared to turn shortly after the last set of canal streets, which have fish names. Turn right on Pointe West Drive. Tide Ridge Drive is perpendicular to Ponte West Drive, and the project site is located just west of where they intersect. A wooden walk and stairs lead to the path to the AIWW. The highground property has an average elevation of approximately 5 to 12 feet above mean sea level. The pathway follows a long, approximately 800 foot long, 20 foot wide highground peninsula that is a remnant of the eastern dike of an old dredged material disposal area. This path extends from the main part of the island through coastal marsh and past the adjacent spoil area, leading to the AIWW. The only other man-made features on the tract are a wooden walkway and steps leading down to the path. The vegetation on the highground area and along the pathway consists of mostly of Live Oak (Quercus virginiana), Cedar (Juniverus virginiana), Yaupon (flex vomitoria), and Wax Myrtle (Mvrica cerifera). To the west of the property near the waterway is the old disposal area. To either side of the peninsular pathway, highground vegetation quickly gives way to coastal wetland vegetation. High coastal marsh vegetation, including, Black Needle Rush '(.funcus roemarianus), and Salt Meadow Grass (Spartina patens) transitions to a broad expanse of Smooth Cordgrass (Svartina alterniflora). On the east side of the pathway there is an open water slough that connects to the AIWW via a narrow channel. Towards the end of the pathway at the AIWW, high ground gives way. to coastal wetland vegetation, rack, and abundant crab holes. Salt Meadow Grass (Svartina vatens), Glasswort (salicornia spp.), Sea Lavender (Limonium spp.) and Salt Grass (Distichlis Spicata) are scattered across the upper marsh. From mean high water Smooth Cordgrass (Spartina alterniflora) extends waterward approximately 60 feet to the open water of the AIWW. The waters of the AIWW are Classified SA by the NC Division of Water Quality. The AlWW in this area is not designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. This area of the AIWW is open to the harvesting of shellfish. The applicant is proposing to construct a community pier and dock with boat lifts to provide water access for the lot owners of the Pointe West subdivision. The pier would be accessed from the waterward end of the common area pathway. The applicant is not proposing to make any improvements to the path from the end of the stairs to the beginning of the pier at this time. Pointe West Community Pier and Dock Page 3 The property has a shoreline length of approximately 200 linear feet along the waterway. The pier would be elevated above the wetlands at its landward end. From the end of the upland of the path the 6 foot wide pier would be 365 feet in length. It would extend approximately 150 feet from the edge of the marsh and terminate with a 32 ft. X 16 ft. T-head platform. This platform would be half covered (16 ft. X 16 ft.) and half open deck (16 ft. X 16 ft.). Water ward of the T-head platform, the pier would ramp to a floating dock. The dock would be roughly parallel to the channel, and would extend out to a distance 50 feet from the 80 foot AIWW channel setback. The docking facility would have a 180 foot long 6 foot wide spine, and would have five (5) perpendicular finger piers each 25ft. X 6 ft. Twenty (20) mooring pilings would be installed to create ten (10) boat slips within and adjacent to the finger piers. Total square footage incorporated by the boat lifts would be 4000 square feet. Including the mooring pilings, the total width of the docking facility would be 215 feet. The application shows existing water depths at the proposed docking location are in the range of -2.00 to -2.70 at mean sea level (MSL). The measured width of the waterbody is 525 feet. 10. ANTICIPATED IMPACTS - , The proposed pier would result in the shading of 1320 square feet of vegetated intertidal wetland beach . and Smooth Cordgrass (Svartina alterniflora) marsh. The docks, boat lifts, and mooring pilings would incorporate 2068 square feet of Estuarine Waters and Public Trust Area. Short term increases in turbidity can be expected during piling installation. The facility will feature 10 boat slips with boat lifts~ a 16'x16' gazebo, a 16'x16' open deck and a 6' wide by 365' access pier. The facility will be for the use of prop~rty owners within the Pointe West subdivision. No excavation or fill of any wetlands or open water areas is proposed with the project.
