APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. McKeon:
You have our approval, in accordance with the attached conditions, to usurp 0.04 acre of open water in order to
extend and existing docking facility and to construct a new boatlift, floating dock and work platform at your lot in Craven
, County, as described in your application received by the Division of Water Quality on April 5, 2004. After reviewing your
application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be
downloaded from our web site at htto://h20.enr.state.nc.us/ncwetlands. This Certification allows you to use your CAMA
Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge,
Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the
accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur;

4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project;
5. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [15A
NCAC 4B .0024]; see NCDOT publication, Best Management Practices for the Protection of Surface Waters
(March 1997).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

9. NARRATIVE DESCRIPTION:
Project Setting
Mr. Richard McKeon owns a quarter share of Lot #1 within The Moorings subdivision.
The remaining owners include George Garrance, Leonard Jones, and Joseph Berry. All of the
owners have agreed to the proposed modifications and are on record through signatures and e-
mail correspondences included in this major permit package. The Moorings subdivision can be
accessed by turning onto Temples Pt Rd, off Highway 101. Temples Pt Rd. will be on your
left heading south toward Beaufort or on your right heading north toward Havelock. Once on
Temples Pt Rd.(SR 1711) turn right onto Blades Rd. (SR 1715) and then left onto SR 1713.
Immediately after your left turn The Moorings subdivision entrance will be on your left side as
you turn onto Anchorage Drive. Once in the subdivision Lot#l is located at the end of
Spinnaker Lane, which is located on the south side of the subdivision. The subdivision borders
Clubfoot Creek and is located within the Blades community, Craven County. l,
Lot #1 is 1.23 acres in size with its highest point located near Spinnaker Lane around
5' above normal water and its lowest point less than 6" above normal water near shore. Lot #1
is vacant as it is a shared lot for water access. The lot transitions from coastal wetlands to pine
trees and mixed hardwoods as you move up the lot's slope. The existing pier was permitted
under general permit #017046-C in 1997. This current configuration includes four docking
spaces oriented parallel with the creek two on each side of the approximate 150' long pier
separated by a 55' by 6' "T" pier head.
Lot #1 is a typical lot within The Moorings and has a natural shoreline without any
shoreline stabilization. The adjacent waterbody, Clubfoot Creek, is classified as SA-HQW-
NSW by the Division of Water Quality is not considered a primary nursery area but does serve
as a secondary nursery a~ea. The water appears to be closed to any shellfish harvesting.
Project Description
Richard McKeon on behalf of all owners of Lot #1 has applied to extend the existing
dock by 40' to gain additional water depth for the large sailboats which use the facility. The
current configuration has two vessels oriented parallel with the creek on the inside of the
existing "T" pier head while the other vessels dock parallel to the creek on the outside of the
"T" pier head. The 40' by 5' extension would extend into Clubfoot Creek with new pilings
offset approximately 15' from the end of the proposed extension to facilitate creek
perpendicular dockage. This would keep the stern of the vessel into deeper water. The 40'
extension would put the stern of the boat in to an additional 1.25' of water depth by design
keeping the prop and keel off the bottom during wind tide events. The reconfiguration was
necessary to review through the major permit process because of its expansion outside the
existing footprint and the fact that the dock could provide spaces for more than two vessels.
Since being reviewed under the CAMA major permit process the applicant has decided
to add a couple of amenities to the current facility. A new uncovered boatlift (12' by 12') is
proposed approximately 90' from the normal water level along the north side of the existing
access. A new floating dingy dock (5' by 12') is proposed approximately 25' from normal
water on the north side of the access. Finally a new floating work platform (5' by 10') is

proposed approximately 50' from normal water along the north side of the access. This
floating work platform could be moved to service the sailboats using the docking facility.
The proposed 40' extension appears to be inline with the established pier head length
along The Moorings. The structure would not extend into the assumed channel and will not be
more than IA distance across Clubfoot Creek. The proposed piling off the north side of the
proposed extension does appear to be positioned within 15' of the north riparian corridor
however, Mr. Garrance the northern neighbor is one of the four owners and is in agreement to
the change. The proposed extension and inside additions would provide an additional 3
possible docking spaces if you include the floating work platform.
Anticipated Impacts
The project would usurp 1,774 ft2 of public trust area. This amount is 57.,4 fe more than
the existing configuration. The request would not extend beyond the established pier head
alignment and thus should not impact traditional navigation in the area. The revised
configuration would create an additional three docking spaces for a total of seven.

other instrument under which the applicant claims title

prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U,S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Lot #1 is quarter shared by four owners of property at the Moorings.
A.djacent, to the left, is George Garrance at Lot #2. Immediately behind
is Richard 1VkKeon at 126 Spinnaker Lane at the end of the Cul-de-Sac.

Due to the nature of the wind tides at the creek, the water level drops
sub~tantiany most of the boating season because of the south/south west
winds. This puts both sailboats on the ground.
\Ve propose to extend the walkway directly out from the existing "T"
another 40' ~ and move the pilings in to change the configuration of the
docking slips. This will allow the sailboats to "bow in" to the "T",
putting their keels out into tbe deeper water and aUowing tbem a better
c,banc,e of getting off tbe docks at 10'" water. The pilings fot' the new slip
configurations should not stick out further into the creek than existing
pinng.~ of other docks on the west side of the creek. By "bowing in", they
