Division of Water Quality (DWQ) Staff from the Raleigh Regional Office (RRO) had previously conducted an on-site determination of the stream (NBRRO-03-151). In your letter to the Director, you requested an appeal of their determination as provided within15A NCAC 02B .0233(3)(a). Map: At your request, I conducted an appeal of their determination as stated above. During my review, I confirmed that two surface water features exist within the approximate location of the "intermittent stream" depicted on the USGS topographic map. (No surface waters are depicted on the Johnston County Soil Survey within the approximate location of the subject North Carolina Division of Water Quality, 401 Wetlands Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650 (Mailing Address) 2321 Crabtree Blvd., Raleigh, NC 27604-2260 (Location) 919-733-1786 (phone), 919-733-6893 (fax), http://h2o.enr.state.nc.us/ncwetlands/ Kevin Martin (DWQ # 04-0559) Page 2 of 2 April 13, 2004 property.) The two features included a large channel located partially outside of the natural drainage way and a smaller channellooated within the natural drainage way (previously labeled as a linear wetland and exempted by the RRO). I evaluated the smaller channel using the DWQ Stream Classification Form and calculated the score to be 12.5 points. The form states that if the score is "greater than or equal to 19 points the stream is at least intermittenf'. Therefore, I have determined that the smaller channel is an "ephemeral" modified stream and concur with the RRO that this feature is not subject to the buffer rule. I evaluated the large channel and determined it to be a "ditch" (not a modified natural stream). The DWQ has determined that the surface water labeled as "040559" on the attached map and located on the subject property contains a large "ditch" (not a modified natural stream) and an "ephemeral" modified stream and is, therefore, not subject to the Neuse Buffer Rule. As such, the DWQ has determined that n.Q surface waters subject to the Neuse Buffer Rule exist on the subject property or within 50 feet of the property boundaries of the subject property. This determination shall replace the determination originally performed by the Regional Office. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This on-site determination shall expire five (5) years from the date of this letter. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any aotivity within Waters of the United States or Waters of the State. Mr. Mitchell and I met on-site and he did not believe the feature should be buffered but he had forgotten that he previously examined the site and issued a letter indicating it was buffered. In his first evaluation he did not examine the full extent of the feature. A signed authorization from the current owner is attached. Problem with the site visit was the first took place in a wet period and the feature is piped out of an existing housing developement. It still looks like a stream at EOP. when I did the site visit w/S&EC, the feature was evaluated in the summer in the woods some distance from the pipe and it appeared exempt. The is an additonal feature shown on soils that further complicates the matter. He discussed with you and you said to do an appeal and you would look at it to avoid a conflict on Steve's part, the client never authorized me to do the appeal, well of course now he is calling wanting it done. Based on the fact that steve's original call was over 60 days and basd on our discussions with Coleen, can we appeal it? Or does it fall into the OAR situation since it was not appealed withing 60 days? The one hope is the person wishing to appeal is a buyer and was not the same as the person who asked for the original call , so he is an interested party and was not "notified" of the original determination. So what do we do"I really do not care they should have had this done when I first asked and you agreed.
