The attached technical requirements document discusses NCDOT’s agreement with the I-77MP related to implementation of applicable NCS000250 requirements along with other non-NPDES related requirements. There are a number of other contract agreements with I-77MP including the I- 77 Express Lanes Executed Comprehensive Agreement which is too large to email. These other contract agreements have very little language related to NCS000250 but are available for you to review at the following website: https://www.ncdot.gov/projects/i-77-express- lanes/Pages/contract-documents.aspx An executed agreement between NCDOT and the City of Jacksonville, NC which includes among other matters a commitment by the City to operate and maintain a bioretention basin located adjacent to Bridge 24 over the New River on US 17. NCDOT has numerous agreements with other entities related to the operation and maintenance of existing stormwater control measures. The stormwater control operation and maintenance language in most other agreements is substantially similar to the attached agreement. If DEMLR is interested in reviewing other similar agreements the Department respectfully requests a time extension to gather additional agreements as these are held locally, typically in hardcopy format, at the Division level. We anticipate needing additional time to compile the agreements with an intended goal of providing them to DEMLR on September 23, 2019. Your letter also requested a copy of the Current Stormwater Management Plan (SWMP). NCDOT does not have a SWMP as it is not a requirement of our current permit, nor has it been a requirement in our past Term I, II, or III permits. From past conversations with the former DEMLR Stormwater Program managers we were informed that NCDOT did not need a SWMP. That said, it is our understanding from conversations with you earlier this year that DEMLR is considering adding a SWMP requirement to NCS000250 upon renewal in 2020. NCDOT does not have any objection in concept to new SWMP-related requirements being added to the permit and we look forward to working with you on the renewal. Also per your request we have reserved a large meeting room with a computer, internet access, and a projector at the NCDOT Century Center A building located at 1000 Birch Ridge Drive in Raleigh. There should be ample free parking for DEQ staff. I’ll provide you with additional details prior to the audit date.
