The City of Charlotte is requesting 401 Water Quality Certifications from the North
Carolina Division of Water Quality to provide maintenance at the referenced sites, The
NCWRC has reviewed information provided by the applicant, and field biologists on our
staff are familiar with habitat values of the project area, These comments are provided in
accordance with provisions of the Clean Water Act of 1977 (33 U.S.c. 466 et. seq.) and
the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
The following comments are provided for your consideration as you evaluate the
proposed City of Charlotte maintenance projects:
1. DWQ No. 040515 - The project proposed is to reshape/clean stream banks
and install 275 feet of permanent turf and 75 feet of gab ion wall. We
recommend that the entire stream reach be reshaped to provide increased
floodplain capacity and revegetated with native riparian tree species in order
to promote long-term stability and to restore habitat values. We do not
support the use of gabions as they tend to destabilize other areas.
2. DWQ No. 040516 - The project proposed is to replace an existing pipe with a
new pipe without impacting additional waters. We concur with burying the

pipe a foot. Generally, we recommend that culverts 48 inches diameter or
larger should be buried a foot into the streambed, Culverts less than 48 inches
diameter should be buried to a depth equal to or greater than 20% their size to
allow for aquatic life passage. These measurements must be based on natural
thalweg depths.
3. DWQ040517 - The project proposed is to replace an existing (3' drop)
hanging culvert with a larger (1.35' drop) hanging culvert with concrete head
and end walls. Leaving the culvert hanging is indicated as necessary due to an
existing eight (8) inch water line. A thirty (30) foot apron is proposed. We
recommend that the eight (8) inch water pipe be relocated to allow proper
burial of the stormwater pipe for improved aquatic life passage. We do not
support the use of concrete aprons as they preclude aquatic life movement by
reducing the depth of stream waters. If the water pipe cannot be relocated so
that the stormwater pipe can be properly installed as indicted in number two
above, large riprap should be used to provide a stair stepped channel or
waterfall that maintains stream depth and width to the extent possible. We
recommend that entire stream reach be reshaped and revegetated with native
riparian tree species in order to promote long-term stability and to restore
habitat values. If concrete will be used, work must be accomplished so that
wet concrete does not contact stream water,
Whenever stream maintenance can be provided through bioengineering techniques and
riparian plant restoration, these measures should be used. Maintained lawn areas should
have naturally vegetated woody buffers restored to the maximum extent practicable for
stability and water temperature moderation. In urban settings like these, a twenty-five
(25) foot buffer should be provided wherever possible. Buffers should be permanently
protected through deed restrictions or other similar enforceable methods on both private
and public property if public funds are used for the project.

Dear Mr, Karl:
You have our approval, in accordance with the attached conditions and those listed below, to
impact/stabilize approximately 175 linear feet (If) of a perennial unnamed tributary of McAlpine Creek at the
above noted location in Mecklenburg County, as described in your application received by the Division of
Water Quality (DWQ) on April 2, 2004, After reviewing your application, we have determined that this project is
covered by Water Quality General Certification Number 3399, which can be viewed on our web site at
http://h2o,enr,state,nc,us/ncwetlands, The General Certification allows you to use Nationwide Permit Number
13 once it is issued to you by the U,S, Army Corps of Engineers, Please note that you should get any other
federal, state or local permits before proceeding with your project, including those required by (but not limited
to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations.
The above noted Certification will expire when the associated 404 permits expire unless otherwise
specified in the General Certification. This approval is only valid for the purpose and design that you described
in your application, If you change your project, you must notify us in writing, and you may be required to send
us a new application for a new certification, If the property is sold, the new owner must be given a copy of the
Certification and approval letter; and is thereby responsible for complying with all conditions,
For this approval to be valid, you must follow the conditions listed in the attached Certification, as well as
the additional conditions listed below:
1, No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Preconstruction Notification application. All construction activities
shall be performed so that no violations of state water quality standards, statutes, or rules occur.
2, The design, installation, operation, and maintenance of the sediment and erosion control measures must
be such that they equal, or exceed, the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Planning and Design Manual (the Manual), The measures shall be
maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-
owned or leased borrow pits associated with project.
3. Sediment and erosion control measures should not be placed in wetlands or waters, However, if
placement of sediment and erosion control devices in wetlands and waters is unavoidable, the devices
shall be removed and the natural grade restored within six months of the date the Division of Land
Resources has released the project.

Completion" form to notify NCDWQ when all work included in the 401 Certification has been completed.
Please send photographs upstream and downstream of each culvert site to document correct installation
along with the Certificate of Completion form.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing,
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N,C. 27699-6714, This certification and its conditions are final
and binding ~Iess you ask for a hearing.

Executive Summary
The 716 Regency Drive Maintenance Project is located in southeast Charlotte, North Carolina, at the
intersection of Glenridge Road and Regency Drive (Attachment A - Figures 1 and 2), The purpose
of this project is to stabilize an eroding stream bank that currently threatens a residential swimming
pool and property. The proposed stabilization plan includes 75 linear feet of gab ion wall along the
right channel bank. In addition, the remaining channel banks will be excavated to a 2: 1 slope and
stabilized with Permanent Turf Reinforcement Matting. Charlotte Storm Water Services (CSWS)
contracted Carolina Wetland Services, Inc. (CWS) to provide permitting services for this project.
The results of the on-site field investigation conducted by CWS indicate that there is one
jurisdictional stream channel (Stream A) located within the project limits (Attachment A - Figure 3).
Approximately 175 linear feet of Stream A is located on site and evaluated to be perennial. On
behalf of CSWS, CWS is submitting a Pre-Construction Notification application with attachments in
accordance with Nationwide Permit General Condition No. 13, and pursuant to Nationwide Permit
No. 13 and Water Quality Certification No. 3353 (Attac1unent B), CSWS believes that this project is
self-mitigating given the water quality improvements that will result from construction of the project.

Existing Conditions
I
The 716 Regency Drive Project is located in southeast Charlotte, North Carolina, at the intersection
of Glenridge Road and Regency Drive (Attachment A - Figures 1 and 2). The purpose of this
project is to stabilize an eroding stream bank that currently threatens a residential swimming pool
and property, Carolina Wetland Services, Inc, (CWS) has been contracted by Charlotte Storm Water
Services (CSWS) to provide permitting services for this project.

Current Land Use
I
The project area is mainly comprised of single-family residences with maintained lawns and small
wooded areas, Dominant vegetation within the wooded riparian area includes: white oak (Quercus
alba), red cedar (Juniperus virginiana), shagbark hickory (Carya ovata), flowing dogwood (Cornus
jlorida), American holly (Ilex opaca), cat briar (Smilax rotundifolia), Chinese wisteria (Wisteria
sinensis), English ivy (Hedera helix), and Japanese honeysuckle (Lonicerajaponica). According to the
Soil Survey of Mecklenburg County1 (Attachment A - Figure 2), soils within the project area consist
entirely of Cecil sandy clay loam with 2 to 8 percent slopes and eroded. Generally, these soils are well-
drained and have medium surface runoff~ moderate permeability, and moderate shrink-swell potential.
The water table is below 6 feet.

Jurisdictional Delineation
On March 25, 2004, CWS investigated on-site jurisdictional waters of the U.S.2 using the U.S. Army
Corps of Engineers (USACE) Routine On-Site Determination Method. This method is defined in the
1987 Corps of Engineers Wetlands Delineation ManuaP No wetland areas were identified within the
project limits, A Routine On-Site Data Form representative of on-site non-jurisdictional upland areas
has been included as Attachment C. Jurisdictional waters of the U,S. were classified according to
recent North Carolina Division of Water Quality (NCDWQ)4 and USACE guidance, A NCDWQ
Stream Classification Form and USACE Stream Quality Assessment Worksheet representative of
Stream A have been included as Attachment D.

The results of the on-site field investigation indicate that there is one jurisdictional stream channel
(Stream A) located within the project limits (Attachment A - Figure 3). Stream A is an unnamed
tributary to McAlpine Creek, which is part of the Catawba River basin (HU# 030501035) and is
classified as "Class C" waters by the NCDWQ,

Stream A enters the proposed project area (716 Regency Drive) from a 48-inch reinforced concrete
pipe (RCP) under Regency Drive and flows south for approximately 175 linear feet before leaving
the project area (Attachment A - Figure 3), In addition, a 24-inch RCP empties into this segment of
Stream A. The on-site segment of Stream A is significantly incised and displays major bank failures.
On the day of the field investigation, Stream A exhibited moderate flow, a strong bankfull bench,
and a moderate presence of amphibians (frogs) (Attachment 0 - SCP 1). Channel flow was very
slow and a moderate presence of leaf litter was observed, Stream A scored 34 points out of a
possible 100 points on the USACE Stream Quality Assessment Worksheet and 28,5 out of a possible
71 points on the NCDWQ Stream Classification Form, Stream A was evaluated to be Perennial.

A letter was forwarded to the State Historic Preservation Office (SHPO) on March 25, 2004, to
determine the presence of any areas of architectural, historic, or archaeological significance that
would be affected by the project. To date, no response has been received from SHPO.

A letter was forwarded to the North Carolina Natural Heritage Program (NCNHP) on

The project is located within a residential area that is experiencing severe stream bank erosion during
storm events, The purpose of this project is to reduce stream bank erosion and protect residential
structures and property. Both sides of the channel are steep and experiencing bank failures.
Sloughing along the right bank currently threatens an adjacent privacy fence and swimming pool
(See Attachment E - Photograph B). The proposed project will stabilize both channel banks,
eliminate hazards to personal property and safety, and improve water quality by reducing
sedimentation,

Impacts to on-site jurisdictional waters of the V,S, have been reduced to the maximum extent
practicable, The length of hard stabilization (gabion wall) has been reduced to the amount necessary
to alleviate the immediate threat to adjacent residential structures (privacy fence and swimming
pool), Soft stabilization will be used in lieu of hard stabilization to stabilize the remainder of the
channel. Natural channel design is not a practical alternative for this project, due to the close
proximity of existing houses and topography.
Proposed Impacts to Jurisdictional Waters
Proposed impacts to Stream A include 175 linear feet of channel re-shaping, 75 linear feet of gabion
wall, and 275 bank feet of soft stabilization (Attachment A - Figure 4). The channel banks will be
excavated to a stable 2: 1 slope and trash and sediment will be removed from the channel bed. The
channel bottom width and longitudinal profile will remain the same, The gabion wall will be placed
along the right channel bank immediately adjacent to the privacy fence and swimming pool to ensure
their protection, The remainder of the excavated channel slopes will be stabilized using Permanent
Turf Reinforcement Matting and will be bioengineered in the fall of 2004. Due to site constraints,
construction equipment will be placed temporarily in the channel bed to carry out proposed activities.
On behalf of CSWS, CWS is submitting a Pre-Construction Notification application with
attachments in accordance with Nationwide Permit General Condition No. 13, and pursuant to
Nationwide Permit No. 13 and Water Quality Certification No, 3353 (Attachment B).
