Dear Mr. Wicker:
This letter provides the comments of the U. S. Fish and Wildlife Service (Service) on the
subject Public Notice (PN), dated April 6, 2004. The applicant, Mr. Randy Greene, has
applied for a Department of the Army (DA) permit to construct a 10-slip floating dock to
serve as a commercial docking and fueling facility. These comments are submitted in
accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as
amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your
determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public
interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources.
Additional comments are provided regarding the District Engineer's determination of
project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as
amended (16 U.S.c. 1531-1543).
Proposed Activities
The applicant proposes to renovate the existing docking system, install two underground
storage tanks, and build a convenience store at the Topsail Island Marina and Fishing
Center adjacent to Banks Channel. The Field Investigation Report (FIR) of the North
Carolina Division of Coastal Management (DCM) states that no dredging or wetland fill
would be required. Water depths within the proposed slips would average approximately
three to five feet at mean low water.
Environmental Impacts
The FIR states that there is no marsh, only open water, on the waterward side of the
existing seawall on the property. The docking and fueling pier along with the proposed
boat launch ramp would incorporate approximately 5,725 square feet (ft2) of estuarine
water and public trust areas. The applicant's statement notes that all in ground storage
tanks would be double walled and coated with a special protectant. All piping would
have the same protective measures. An interstitial monitoring system would be used to
oversee and regulate the entire fuel system. The Service is pleased that such protective
measures would be employed.
Federally Protected Species
The Service has reviewed available information on federally-threatened or endangered
species known to occur in Pender County. We have also reviewed information from the
North Carolina Natural Heritage Program (NCNHP) database which contains excellent
data on the special status species, both federal and state. This database can be accessed
by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from
USGS quads provide the most project-specific information on species which should be
considered in permitting this project. The project area is located Hampstead quad. The
occurrence data of special status species within these quads can be obtained on the
internet at < http://www.ncsparks.net/nhp/quad.html >.
Our review indicates that the only federally listed species likely to occur in the project
area is the West Indian manatee (Trichechus manatus), a federally-endangered mammal.
The species is known to occur in the coastal waters of Pender County. The shallow,
estuarine waters of the project area may provide suitable habitat for manatees that move
along the Atlantic Coast during summer months and are seasonal transients in North
Carolina, primarily from June through October. Manatees may use waters one to two
meters (3.3 -6.6 feet) deep. The species moves extensively when in North Carolina
waters and past occurrence records cannot be used to precisely determine the likelihood
that it will be presence at a particular construction site.
Service Recommendations
It appears that water depths at the project site could be used by manatees. The risk to
manatees during construction could be reduced by implementing the "Guidelines for
A voiding Impacts to the West Indian Manatee - Precautionary Measures for Construction
Activities in North Carolina Waters." These guidelines are available on our web site at <
http://nc-es.fws.gov/mammal/manatee guidelines. pdt>. The guidelines are intended
mainly to ensure that construction personnel are informed that manatees may occur in the
work area, that work should cease if a manatee approaches the work area, work should
not resume until the manatee leaves the work area, and procedures for reporting the death
or injury of a manatee. The risk to manatees would be further reduced by performing the
work during the period of November through May.
With the inclusion of the Service manatee guidelines as permit conditions and the
information contained in the FIR, we do not believe that the proposed activity will have
significant adverse and/or irreversible effects on general fish and wildlife resources under
our jurisdiction. Furthermore, the Service would concur with a determination by the
District Engineer that the action is not likely to adversely affect species designated as
threatened, endangered, or their designated critical habitat. Therefore, we have no
objection, from the standpoint of fish and wildlife resources, to the issuance of a DA
permit for the proposed work.

8. PROJECT SUMMARY:

9. PROJECT DESCRIPTION
The applicant's project is located at 912 South Anderson Blvd in the Town of Topsail Beach adjacent to Topsail Sound in
Pender County. To find the property from Surf City, travel south on NC Highway 50 approximately 7 miles. The Topsail
Beach Town Hall will be <?n your right. Travel another 0.2 miles and the project location is located on your right at 912 S.
Anderson Blvd (NC Highway 50).
The property on which the project is proposed is 0.65 acres, approximately 100' wide by 280' deep; the property is
adjacent to Topsail Sound and is about 7' above mean high water (MHW). The existing development on the property is
Bush's Repair Center. To the southwest side of the property, from S. Anderson Blvd., there is a fenced boat trailer parking
area, followed by a warehouse structure. The warehouse structure contains a show room (28'x36'), followed by a service
department (48'x32'), and fmally a boat bay (30'x34'). There is an area of sand and grass that extends along the southwest
side of the property behind these structures. Several UST's were once located to the northeast of the boat bay portion of the
warehouse structure. There is existing contamination from these removedUST's; the process of monitoring and cleanup of
this contamination is ongoing. There is a gravel drive/parking area on the northeast side of the property that leads to and
includes an area behind the boat bay portion of the warehouse. The gravel drive also leads to a 22' wide concrete boat
ramp at the north corner of the property that is enclosed on both sides by an existing sea wall; the sea wall runs along the
entire waterward edge of the property. There is a boat launch pier adjacent to'the boat ramp and several fmger piers with
mooring pilings adjacent to the sea wall. To the southwest of the boat ramp and between the gravel drive/parking area and
the sea wall, there is an area of sand and grass, much of which is presently used for parking boat trailers. The MHW
comes to the sea wall and up the boat ramp about 24 feet. There is no marsh, only open waters, on the waterward side of
the sea wall. Topsail Sound is about 1300 feet wide in this area.
The waters of Topsail Sound are classified SA by the North Carolina Division of Water Quality. Topsail Sound in the
vicinity of the project is Closed to the Harvest of Shellfish. The waters of Topsail Sound are not designated as a Primary
Nursery Area.
PROPOSED PROJECT
I ..
The applicant proposes a 10 slip commercial docking and fueling facility as well as the addition of a 25'xI4' convenience
store. The applicant would eliminate the existing pier/docking structures; the existing boat ramp and sea wall would
remain. A 6' wide boardwalk would be located immediately behind the sea wall; the board walk would begin at the west
corner of the boat ramp and would extend about 60' to the southwest. The applicant would install a new 30'x 6' floating
structure along side the boat ramp to assist in the use of the ramp. Also, a new 10 slip floating dock would be constructed;
the new dock would originate about 50' from the west corner of the boat ramp. The 6' wide pier would extend into the
water to a distance of about 145' from the sea wall. The first sixty feet of the 6' wide pier would be dedicated strictly for
docking vessels for fueling purposes. The remaining portion of the pier would be used for fixed docking purposes. Six 3'
wide fmger piers, three on each side of the 6' wide pier, ranging from 20' to 30' in length would be constructed to create
10 slips. The slips would each be about 15' wide. Water depths within the slips would average approximately 3' to 5' at
mean low water (ML W). Seven mooring pilings would be added to provide additional tie offs for the docked vessels. The
existing warehouse structure consisting of show room, service department, and boat bays would remain. The proposed
fueling system would start with one 10,000 gallon UST for regular gasoline and one 12,000 gallon UST compartmentalized
for 6,000 gallons each for Premium and Diesel. The UST's would be located along the northeast side of the property across

from the existing warehouse structure; the closest point of either of the UST's to the water would be about 60'. A 65'xlO'
concrete pad would be placed over the UST's. Fuel transport lines would be installed to connect the UST's with the fuel
dispensers. The fuel dispensers would sit on concrete pads, 4'x7' and 4'xlO', located just landward ofthe boardwalk at the
juncture with the pier. Reel dispensers would be used to fuel vessels at the dedicated fuel docking area. The applicant also
proposes to add a 25'x14' convenience store to assist in the oversight of the facility. The convenience store would be
located over the location of the removed UST's, the source of present contamination, to the northeast of the boat bay
portion of the warehouse. All impervious and pervious areas would remain as impervious and pervious, respectively, with
the exception of the concrete fuel dispenser pads, 4'x7' and 4'xlO', being located over an existing sand and grass area.
10. ANTICIPATED IMPACTS:
The upland development would disturb a combined area of about 1908 sq.ft.; this includes about 650 sq.ft. (65'xlO') for the
UST's and concrete covet, 500 sq. ft. (5' x 100') for the fuel transport lines, 68 sq. ft. (4'x7' and 4'xlO') for the concrete
fuel dispenser pads, 340 sq.ft. (6'x58') for the boardwalk, and 350 sq.ft. (25'x14') for the convenience store. The total
impervious surface coverage within the 75' Estuarine Shoreline AEC associated with the development would be 48 %; this
represents an increase in impervious coverage of less than 1 % over the amount of existing impervious coverage. This
increase in impervious area is due to the addition of the concrete fuel dispenser pads adjacent to the boardwalk. The
proposed 10 slip docking and fueling pier and the proposed boat ramp launch pier combined would incorporate about 5,725
sq.ft. of estuarine waters and public trust area. Minor increases in turbidity can be expected during piling placement.
The wastewater treatment would be handled through an existing on site- septic system. The drinking water supply is
provided by the Town of Topsail Beach. The applicant has applied for a State Stormwater Permit from the Division of
Water Quality. Previous permits for the site include two CAMA permits GPD20333 and GPD16245 for a bulkhead and a
pier, respectively.

Topsail Island Marine and Fishing Center is proposing the following changes and
renovations for the spring of2004. Renovation of the existing dock system, installation
of in ground storage tanks for a fuel system, and installation of a temporary marina store.
The renovation of the dock system will be used to provide additional slips
available for the community to rent out on a nightly basis and to provide a safe
environment for fueling boats on the water. The construction will be with certified
floatation, strong aluminum brackets, and treated lumber for the decking and framing.
The docking system will be anchored by in ground pilings. Dale Merritt a local dock
builder will be performing the construction process and has been responsible for several
dock construction projects on the island.
The in-ground storage tank system will be used to provide the island with an on
the water fueling center. Two tanks are being proposed: a 10,000 gallon tank for regular
gas and a 12,000 gallon tank for 6,000 gallons of premium and 6,000 gallons of diesel.
All in ground storage tanks proposed are double walled and coated with a special
protectant. All piping is also doubled walled and coated with a special protectant. A
state of the art interstitial monitoring system will be used to oversee and regulate the
entire fuel system. Jones and Frank out of Raleigh, NC is scheduled to complete the
installation process.
A small 25 X 14 temporary building is planned to oversee and collect fees for the
entire marina operation. Leonard, an industry leader in producing this type of buildings
will complete construction relative to North Carolina building codes. The building is 130
mph wind rated and will be anchored with hurricane tie downs. Leonard will also be
responsible for the installation of the building as well.

THE SPLIT STRAP ANCHOR SYSTEM PROVIDES A METHOD TO ATTACH AND TIGHTEN
THE TANK ANCHOR STRAPS TO DEADMEN WITHOUT ENTRY INTO THE EXCAVATION.
NOTES:
-Lay dead men along each side af tank
-Make sure they are parallel to tank
-Deadman is to be full length of tank an each side
-For tanks requiring 4 or more anchor points per deadman, two
deadmen sections of equal length may be butted end to end
-Moke sure eoch deadman section has at least 2 anchor points
-The tonk must not overshadow the deadman anchor
-Each tank requires two dead men or,
(1) If one deadman is used for adjacent tanks.
it must be doubled in width, and
(2) A separate anchor point must be provided for each strap
-Use straps provided by the tank manufacturer
