Ecosystem Enhancement Program
Dear Mr. Poole:
You have our approval, in accordance with the attached conditions and those listed below, to permanently
fill 0.5 acre of wetland in order to construct the University Exchange Commercial Development in Mecklenburg
County, as described in your application received by the Division of Water Quality (DWQ) on April 1, 2004.
After reviewing your application, we have determined that this project is covered by Water Quality General
Certification Number 3402, which can be viewed on our web site at http://h2o,enr,state,nc,us/ncwetlands, The
General Certification allows you to use Nationwide Permit Number 39 once it is issued to you by the U.S. Army
Corps of Engineers, Please note that you should get any other federal, state or local permits before
proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control,
Non-Discharge, and Water Supply Watershed regulations.
The above noted Certification will expire when the associated 404 permit expires unless otherwise
specified in the General Certification. This approval is only valid for the purpose and design that you described
in your application. If you change your project, you must notify us in writing, and you may be required to send
us a new application for a new certification, If the property is sold, the new owner must be given a copy of the
Certification and approval letter; and is thereby responsible for complying with all conditions,
For this approval to be valid, you must follow the conditions listed in the attached Certification, as well as the
additional conditions listed below:
1, A final written stormwater management plan shall be approved in writing by this Office prior to the
construction of any permanent facilities at the subject site. The stormwater facilities must be designed to
treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water
Quality. Also, before any permanent building is occupied at the subject site, the facilities (as approved by
this Office) shall be constructed and operational, and the stormwater management plan (as approved by
this Office) shall be implemented, The structural stormwater practices as approved by this Office as well as
drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall
be made without written authorization from the Division of Water Quality,
2, We understand that you have chosen to contribute to the Ecosystem Enhancement Program (EEP) in
order to compensate for the impacts to the wetland. In accordance with 15A NCAC 2R .0402 and 15A
NCAC 28 .0242(7), this contribution will satisfy our compensatory mitigation requirements under 15A
NCAC 2H ,0506(h) and 15A NCAC 28 ,0233(10). Until the EEP receives and clears your check (made
payable to: DENR - Ecosystem Enhancement Program), wetland impacts (including fill) shall not occur,

You have one month from the date of this Certification to make this payment. For accounting purposes,
this Certification authorizes the fill of 0.50 acre of wetlands in the Yadkin River Basin (Cataloging Unit
03040105) and requires 1.0 acre of wetland mitigation. Please be aware that the EEP rules require
rounding of wetland impacts to the nearest 0,25 acre (15A NCAC 2R ,0503(b)).
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Preconstruction Notification application, All construction activities
shall be performed so that no violations of state water quality standards, statutes, or rules occur,
4. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full
compliance with all specifications governing the proper design, installation and operation and maintenance of
such BMPs in order to protect surface water standards:
a. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of
the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all
construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or
leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina Surface
Mining Manual.
c, The reclamation measures and implementation of these measures must be in accordance with the
requirements of the Sedimentation Pollution Control Act.
5. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable, If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
they shall be removed and the natural grade restored within six months of the date the Division of Land
Resources has released the project.
6, Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion" form to the 401IWetlands Unit of the NC Division of Water Quality. Please send photographs
upstream and downstream of each culvert site to document correct installation along with the Certificate of
Completion form,
7, Continuing Compliance, Mark Pierce Poole Properties, Inc. (MPPPI) shall conduct its activities in a manner
consistent with state water quality standards (including any requirements for compliance with section 303(d)
of the Clean Water Act) and any other appropriate requirements of state and federal law. If DWQ determines
that such standards or laws are not being met (including the failure to sustain a designated or achieved use)
or that state or federal law is being violated, or that further conditions are necessary to assure compliance,
DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with
such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the
certification, DWQ shall notify MPPPI and the US Army Corps of Engineers, provide public notice in
accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A
NCAC 2H.0504, Any new or revised conditions shall be provided to MPPPI in writing, shall be provided to
the United States Army Corps of Engineers for reference in any permit issued pursuant to Section 404 of the
Clean Water Act, and shall also become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter, To ask for a hearing, send a written petition that
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings,

SUMMARY OF PERMITTED IMPACTS AND MITIGATION REQUIREMENTS
In accordance with 15A NCAC 2 H ,0500, Mr, Grey Poole of the Mark Pierce Poole Properties, Inc, has
permission as outlined below to fill 0.5 acre of wetland in order to construct the University Exchange
Commercial Development project in Mecklenburg County, North Carolina. All activities associated with these
authorized impacts must be conducted in accordance with the conditions listed in the attached certification.
THIS CERTIFICATION IS NOT VALID WITHOUT THE ATTACHMENTS.

As required by 15A NCAC 2H .0506, and the conditions of this certification, you are required to compensate for
the above impacts through the restoration, creation, enhancement or preservation of wetlands as outlined
below prior to conducting any activities that impact or degrade the waters of the state.
Mitigation:
0.5 acre of wetland mitigation is required, at a minimum, by the EEP for the 401 Water Quality
Certification. In correspondence dated March 25, 2004, the EEP indicated that up to 1.0 acre of
compensatory wetland mitigation will be accepted by the EEP if required for the 404 Permit.
Note: Linear foot requirements proposed to be mitigated through the Ecosystem Enhancement Program must
be rounded to the nearest foot and acreage requirements must be rounded to one-quarter acre increments
according to 15 2r ,0503(b).
One of the options you have available to satisfy the compensatory mitigation requirements is through the
payment of a fee to the Ecosystem Enhancement Fund per NCAC 2R .0503, If you choose this option, please
sign this form and mail it to the Ecosystem Enhancement Fund at the address listed below. An invoice for the
appropriate amount of payment will be sent to you upon receipt of this form. PLEASE NOTE, THE ABOVE
IMPACTS ARE NOT AUTHORIZED UNTIL YOU RECEIVE NOTIFICATION THAT YOUR PAYMENT HAS

compensatory wetland mitigation will be accepted by the EEP if required for the 404 Permit.
Note: Linear foot requirements proposed to be mitigated through the Ecosystem Enhancement Program must
be rounded to the nearest foot and acreage requirements must be rounded to one-quarter acre increments

vu. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts, It may be useful to provide

The proposed commercial project is at the intersection of two major arterials/thoroughfares in
the University Boulevard area of Charlotte. The proposed project will serve the University area
and adjacent housing. Based on engineering and grading standards. required parking. utility and
stormwater management facilities. and matching grades with adjacent properties grading and
filling the wetland area is unavoidable. To compensate for the unavoidable impacts to wetlands,
a contribution to the NCEEP is proposed at a 2: 1 ratio. In addition as required. a stormwater
treatment facility is proposed to treat polluted runoff from the project according to NCDENR
requirements, The facility will include a wet pond. forebay. and littoral zone,

DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams,
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed, Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed,

General Wetland Classification and Description
The upland areas of the site are within headwater drainage areas of Mallard Creek in the Yadkin River
Basin. The site is within a Water Classification - C watershed. The current land-use is former or current
agricultural land, residential, and urbanized disturbed areas in early to middle succession. The riparian
wetland areas can be classified as Palustrine Broad Leaved, Scrub Shrub, and Emergent (PFOIA, PSSIA,
PEMIC). Streams were not identified on the site. The wetland appears to be the upper wetland seep area
that was associated with a stream that was removed to construct the apartment complex downstream. The
hydric soils appear to be an inclusion of Helena B at the head of the intermittent stream within the Enon
soils.
