Sullins, Deputy Director Division of Water Quality April 6, 2004 DWQ Project No. 04-0474 Craven County Page 1 of 2 MCAS Cherry Point Commanding General Environmental Affairs Department Marine Corps Air Station PSC Box 8006 Cherry Point, NC 28533-0006 Extend Boat Ramps at Hancock Marina, MCAS Cherry Point, Havelock, NC Hancock Creek [03-04-10, 27-115, SW NSW (nutrient sensitive)] APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer Protection Rules (15A NCAC 2B .0233) with ADDITIONAL CONDITIONS Subject Property: Dear Commanding General: You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact 0.36 acres of waters for the purpose of improving existing boat ramps and docks at the subject property, as described within your application dated March 23,2004 and received by the N.C. Division of Water Quality (DWQ) on March 29, 2004. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3376 (GC3376). The Certification(s) allows you to use Nationwide Permit(s) 3 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and CAMA regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Erosion & Sediment Control Practices - Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. No Waste, Spoil, Solids, or Fill of Any Kind - No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 3. No Sediment & Erosion Control Measures win Wetlands or Waters - Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 4. Diffuse Flow - An additional condition is that all constructed stormwater conveyance outlets shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers such that it will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233 (5). If this is not possible it may be necessary to provide stormwater facilities that are considered to remove nitrogen. This may require additional approval from this Office. Stormwater run-off must be diverted away from the boat ramp (possibly by installing small diversion berms at the top of the ramp), so that the ramp does not act as a stormwater conveyance from the upland areas to the surface water. 5. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Neuse riparian buffer protection rule as described within 15A NCAC 2B .0233. Hancock Marina is a key deployment site for the MCAS Emergency Response Team, which responds to emergency rescue and emergency spill containment events. Hancock Marina currently has two boat ramps and three loading docks adjacent to the ramps. One of the docks was partially destroyed during Hurricane Isabel in October 2003. A site visit was made on February 18, 2003 with Brad Shaver (CAMA), Scott Jones (ACOE), and Tracy Wheeler (ACOE) to discuss the project. The project scope involves paving the existing gravel drive to one of the boat ramps} elongating and correcting the slope of both boat ramps while maintaining the existing widths of the ramps, and replacing the existing docks with elongated docks of similar widths. The longer docks and ramps will enable the emergency response team to deploy and operate their largest vessel in low water events. The project will also perform maintenance excavation in the boat basin (0.36 acres in area, 574 yds3 material). The project is located in the Neuse River Basin. One boat ramp is located within a constmcted basin. the other ramp launches directly into Hancock Creek. Emergency response crews use both ramps for rapid deployment to emergency rescues and emergency spill containment. 10. Describe the overall project in detail, including the type of equipment to be used: The project site is located at the Hancock Marina on Marine Corps Air Station Cherry Point. The project scope of work consists of improving the existing boat ramps and docks such that they are more suitable to MCAS Emergency Response Teams - enabling safe, efficient, and rapid response. The improvements will remove and replace the existing boat ramps, while correcting ramp slope and length to accommodate the deployment and operation of the largest emergency response vessel during low flows. The existing docks will be replaced with docks of like width while extending them to accommodate the loading/unloading of the largest emergency response vessel. This project also performs maintenance excavation in an existing manmade boat basin; measuring 155' by 98', removing approximately 574 cubic yards of material. The construction area will be dewatered prior to beginning work on the site. The existing concrete ramps (both approximately 20 feet in width) will be removed being careful not to disturb the existing bulkheads that are adjacent to each ramp. Existing bulkheads to both boat ramps are in deteriorating condition. It is not desirable to, in any way, modify or otherwise disturb the existing bulkheads for this reason. The existing ramps will be sawcut along existing concrete beams forming the walls of the ramps. New reinforced concrete ramps will be installed maintaining existing ramp widths while improving slopes and length to better accommodate the emergency response team launching their largest vessel in low water events. A five foot width of rip rap three feet deep will line each side of the new ramps to help prevent erosion caused from power loading, currents, etc. Ramps will be constructed at 14% slopes. The design criteria used in the development of this project is taken from: . "Design Handbook for Recreational Boating and Fishing Facilities" prepared for the States Organization for Boating Access (SaBA) in April 1996. . All proposed docks will be constructed of 2 x 6 wood decking and will be supported by minimum 8" diameter Class "B" wood piles spaced seven feet on center. Cross-bracing (2 x 8) will be provided at each set of piers. All fastening fixtures will be galvanized to provide maximum resistance to corrosion. The proposed depth will allow the largest vessel of the MCAS Emergency Response Team to deploy from Boat Ramp # 1 in low water events. The proposed bottom elevation equals the existing bottom elevation of Hancock Creek, the navigational channel. All disturbed soil will be compacted to 95% prior to the re-flooding of the basin. The existing gravel access road to Boat Ramp #1 will be paved to prevent erosion. 11. Explain the purpose of the proposed work: The existing boat ramps are in a state of disrepair. There are severe scour holes at the end of each ramp. Ramps are too short for many of the trailers deploying larger boats. Property has been damaged from trailers riding off the ramp and into the scour hole while trying to launch/retrieve boats from the water. Ramps are steeper than recommended, which increases the potential for power loading and resulting scour problem at toe of ramp, and makes retrieval of the boats more dangerous to those loading. Loading docks are in disrepair and in need of improvements from safety prospective. Emergency response teams respond to environmental accidents (such as fuel spills) and search and rescue (such as downed aircraft). The new boat ramp designs will replace both existing ramps and docks according to current design and safety recommendations. Docks will be replaced and extended to the appropriate length. While the facility also serves for recreational deployment, the improvements are designed to better serve the emergency rescue mission of rapid, efficient and safe response to emergency situations in high and low water conditions. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). Proposed Impacts to Waters of the United States/'Vaters ofthe State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are proposed to these systems. Each constmction area will be enclosed by a temporary cofferdam and dewatered. New concrete will be poured in the dry condition. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Impact to the Neuse River is unavoidable with this proiect because the proiect involves the repair of existing boat ramps into the Neuse River. The land-use of the site will not be changing due to the proposed construction. Improvements are necessary for safe deployment ofMCAS Emergency Response Teams, particularly during nighttime conditions and when visibility is poor. No trees will be destroyed during construction of the proposed upgrades. See attached. Page 6 of9 VID. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and fimction and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h20.enr.state.nc.us/ncwetlands/strml?:ide.html. 1. Provide a brief description of the proposed mitigation plan. These docks are used during deployments for a variety of applications during emergency responses, including: . Efficient and rapid launching of boats from water. This requires the safe movement of two or more crew members on the boat docks at any given time during deployments while loading/off- loading equipment and victims. . Retrieving boats from the water. . Loading spill containment booms onto response boats. Two types of spill containment booms are used by the Emergency Response crew, including: snake booms and harbor booms. Snake booms are fabric absorbent booms that are packed in large plastic bundles that are approximately three (3) feet in height and four (4) feet in diameter. Typically more than one bundle is loaded for a spill containment response. Harbor booms are large, plastic containment booms. These booms are 1,000 feet long booms packed onto two trailers during transport to an emergency deployment. These booms, averaging 7 feet in width (packed), must be loaded onto emergency response boats once the emergency response boat is in the water. . Off-loading contaminated booms after emergency spill containment events. . Off-loading victims after an emergency rescue deployment. This requires several crew members to be on the dock and in the boat to handle the victim during transport from the boat to an emergency vehicle. Each dock is designed with a unique deck elevation to enable launching at a variety of water levels. MCAS Cherry Point, NC Projcct Namc: Extcnd Boat Ramps at Hancock Marina Projcct Numbcr: CP04500M Detcrmination of No Practical Altcrnatives The project site is located at the Marine Corps Air Station in Cherry Point, North Carolina, at Hancock Marina. Hancock Marina currently has two boat ramps in operation and three docks, though one dock was partially destroyed during Hurricane Isabel in October 2003. The marina is used for both recreational and emergency deployment. The project scope of work consists of improving the existing boat ramps and docks such that they to meet the needs of MCAS Emergency Response Teams - enabling efficient, rapid response. The improvements will remove and replace the existing boat ramps, while correcting ramp slope and length to accommodate the deployment and operation of the largest emergency response vessel during low flows. The existing docks will be replaced with docks generally of like width while extending them to accommodate the loading/unloading of the largest emergency response vessel. This project also provides for the paving of an existing gravel access road to one of the boat ramps. Environmental impacts associated with the proposed project includes 0.36 acre of open water impacts, Coastal Shorelines, Estuarine Waters and Public Trust Areas. The existing docks have severe drop-offs at the end of each ramp and are too short to accommodate the launching/retrieval of the largest emergency deployment vessel during low flow/low water events. In addition, the docks adjacent to each ramp are too short to fully accommodate the loading/unloading of the emergency deployment vessels and spill containment booms, especially during low water events. Removal and replacement of the ramps and docks will enable the emergency response team's mission to provide rapid and efficient response to emergency situations. The improvements are designed to allow the MCAS Emergency Response Team to safely, efficiently, and rapidly enable their operations using their largest watercraft in low water conditions. The MCAS Emergency Response Team deploys from Hancock Marina and responds to both emergency spill containment situations and emergency rescues. There are no practical alternative to the proposed project. This site currently serves as a key deployment site for the MCAS Emergency Response Team. Building the ramps in a new location, using existing ramps elsewhere, or not making improvements at this site will directly impact the ability of the MCAS Emergency Response Team's ability to deploy safely, efficiently, and rapidly to emergency situations. Improving the ramps and docks in their existing locations, as proposed with this project, minimizes the environmental impact. Because coffer dams will be constructed to isolate each boat ramp, construction and excavation of the boat ramps will take place in the dry which will minimize environmental impacts and the potential for sediment transport. No wetlands will be disturbed during this project and minimal impact will be made to stream buffers as no trees will be destroyed during construction. These measures minimize impacts as much as possible while maintaining the mission of the MCAS Emergency Response Team. Therefore, there are no practical alternatives to the proposed project.
