APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Lord:
You have our approval, in accordance with the attached conditions, to shade 0.04 acre of river bottom in order to
construct a boardwalk adjacent to the Roanoke River in the Town of Plymouth in Washington County, as described in your
application received by the Division of Water Quality on March 2S, 2004. After reviewing your application, we have
determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our
web site at http://h20.enr.state.nc.us/ncwetlands.This Certification allows you to use your CAMA Permit when issued by
the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply
Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying
CAMA Permit expires unless otherwise specified in the General Certification.

This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us anew application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 1SA NCAC 2H .OS06 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
,sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur;

4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project;
5. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [15A
NCAC 4B .0024]; see NCDOT publication, Best Management Practices for the Protection of Surface Waters
(March 1997).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Project setting
The project site is located off Water Street, adjacent the Roanoke River in the Town of Plymouth in
Washington County, North Carolina. The project site is located on the North side of commercial buildings in the
downtown district of Plymouth. Existing features in the project area include a paved road, pier, boat ramp and
gazebo. Vegetation on the site primarily consists of ornamental shrubs and grasses.
The Environmental Management Commission classifies the Roanoke River as C-Sw. This area of the
Roanoke River is not open to shell fishing and is not a primary nursery area, but represents a critical section of
one of the State's most significant commercial and recreational anadromous fish habitats.
Project description
The Town of Plymouth proposes to construct a 6 feet wide by 260 linear feet boardwalk along the
Roanoke River. The boardwalk will be located approximately 2 feet waterward of the normal water level. The
boardwalk will cross seven different properties in the downtown district. The Town of Plymouth has obtained all
easements for the construction of this boardwalk across private properties. There will be a total of four
boardwalk access points including the existing gazebo. The boardwalk will be begin and terminate at a distance of
15 feet or greater from adjacent riparian property lines.
Anticipated impacts
The boardwalk to be constructed over the Roanoke River will result in some localized short term turbidity
due to installation of pilings and the shading of:l::l,596 fl? of river bottom.

Numerous tOUlists use the existing boardwalk. However, once the existing
boardwalk ends, tourists and residents of the Town are required to walk on the barik of
the Roanoke River, loosening soil and creating the potential for erosion ofthe River
Bank. Demand for easy viewing of the Roanoke River is intensified during various
Tournaments, especially during the annual National Drag Boat Race TOUli1ament.
Approximately 8,000 people attend the annual (2) Day Tournament, using the existing
boardwalk and the Iiverbank to view the races. Over Two Hundred (200) boats
participate in the Drag Races, coming from as far as Texas to compete.
Therefore, the extension of the existing boardwalk is needed to help facilitate the
flow of foot/toUlist traffic, and to ease crowding on the existing boardwalk. The
proposed boardwalk consists of Two Hundred Eighty-Nine (289) Linear Feet, with
Lighting, adjacent to the currently existing boardwalk, which would adequately handle
the current need and any future increase in tourist traffic. In addition, this proposed
boardwalk is a continuation of previous projects funded by the NOlth Carolina Public
Beach and Coastal Waterfront Access Program; is addressed in the Town's 1992 CAMA
Land Use Plan Update, i.e., Pages 8-13, 8-17,8-18; and addressed in Section 7.10 of the
Town of Plymouth's Municipal Zoning Ordinance, entitled "Riverfront Development
Overlay District."
Additionally, several improvements are taking place in Downtown Plymouth to
provide for more access to the river and to improve recreational oppOliunities in the area.
Downtown Plymouth is a prime spot for boat ingress and egress to the Roanoke River
and river recreation. Increasing the length of the boardwalk will help ensure that local
citizens and tourists have safe and adequate access to the river.
