Dear Mr. Wicker:
This letter provides the comments of the U. S. Fish and Wildlife Service (Service) on the
subject Public Notice (PN),dated April 5, 2004. The applicant, Mr. Roger Ebert, has
applied for a Department of the Army (DA) permit to make modifications toa boathouse
and boat lift at an existing pier along the Atlantic Intracoastal Waterway (AIWW) near
the Town ofHampstead in Pender County. These comments are submitted in accordance
with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16
U.S.C.661-667d). Comments related to the FWCA are to be used in your determination
of compliance with 404(b)(1) guidelines (40 CFR230) and in your public interest review
(33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional
comments are provided regarding the District Engineer's determination ofproject
impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended
(16 U.S.C. 1531-1543).
Proposed Activities
The applicant proposes to enlarge and reorient a boathouse and the associated boat lift at
an existing pier. The Field Investigation Report (FIR) of the North Carolina Division of
Coastal Management (DCM) states that water depth at the area ofthe boat slips is about _
2 feet at mean low water (ML W). The impact of the proposed work would be the
incorporation of an additional 120 square feet of estuarine water.
Federally Protected Species
The Service has reviewed available information on federally-threatened or endangered
species known to occur in Pender County. We have also reviewed information from the
North Carolina Natural Heritage Program (NCNHP) database which contains excellent
data on the special status species, both federal and state. This database can be accessed
by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from

USGS quads provide the most project-specific information on species which should be
considered in permitting this project. The project area is located Hampstead quad. The
occurrence data of special status species within these quads can be obtained on the
internet at < http://www.ncsparks.net/nhp/quad.html >.
Our review indicates that the only federally listed species likely to occur in the project
area is the West Indian manatee (Trichechus manatus), a federally-endangered mammal.
The species is known to occur in Pender County and there have been reported
occurrences in the coastal water of the county. The shallow, estuarine waters of the
project area may provide suitable habitat for manatees that move along the Atlantic Coast
during summer months and are seasonal transients in North Carolina, primarily from June
through October. Manatees feed in water one to two meters (3.3 -6.6 feet) deep that may
support submerged aquatic vegetation. The species moves extensively when in North
Carolina waters and past occurrence records cannot be used to precisely determine the
likelihood that it will be presence at a particular construction site.
Service Recommendations
It appears that water depths at the project site are too low to provide habitat for manatee.
The Service would concur with a determination by the District Engineer that the action is
not likely to adversely affect species designated as threatened, endangered, or their
designated critical habitat.
Based on the available information, we do not believe that the proposed activity will have
significant adverse and/or irreversible effects on general fish and wildlife resources under
our jurisdiction. Therefore, the Service has no objection, from the standpoint of fish and
wildlife, to the issuance of a DA permit for the proposed work.
The Service appreciates the opportunity to comment on this permit application. Please

house modifications to an existing pier structure located across from 1098 Kings Landing Road,
adjacent to the Atlantic Intracoastal Waterway, Hampstead, Pender County, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of general permit No. 198000291. Therefore, you may commence construction
activity in strict accordance with applicable State authorization and the approved plan (enclosed).
Failure to comply with the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified.

9. PROJECT DESCRIPTION
The applicant's project is located adjacent to the Atlantic Intracoastal Waterway across from 1098 Kings Landing Road in
Hampstead in Pender County; the property is identified on the submitted survey as Tract #1 Division of Estate Tract of
L.B. King in Map Book 6 Page 34 in the Pender County Registry. To find the property, from Hampstead travel north on
Highway 17 approximately 2 miles and make a right turn onto State Road 1565. Travel about 1.2 miles and make a right
turn onto State Road 1567. Travel about 1 mile and make a right turn onto State Road 1575 (this may seem like a sharp
right turn on the same road, but the road number changes). The property is located immediately on your left after making
the turn onto State Road 1575. The property has palm trees by the road and is located immediately across from an A frame
house on the northwest side of the road at 1098 Kings Landing Road.
The property is about 80 feet wide and extends from the State Road to the High Water Line according to the submitted
survey. The upland property makes up about 160 feet of the length and ranges from about 15 feet above MSL at the State
Road to about 10 feet above MSL at the point of drop off to the wetlands. The uplands is established with traditional
landscaping, and there is an existing cement walkway on the uplands that leads to the approximately 300' long existing pier
structure. An existing gravel/dirt driveway parallels the pier on its east side and leads from the uplands to the water. The
pier structure extends in a southeast direction from the uplands. The first 20' of the 6' wide pier spans a drop in elevation
of about 7 feet that transitions the uplands to the apparent 404 wetlands. The next 80' of the pier covers the 404 wetlands
vegetated primarily with Cattails (Typha spp.) and Southern Wax Myrtle (Myrica cerifera). The pier then crosses about 90'
of high marsh; the first 30' is vegetated with a mixture of Salt Grass (Distichlis spicata) and Salt Meadow Grass (Spartina
patens) while the remaining 60' is vegetated with Black Needlerush (Juncus roemerianus). The high marsh transitions to
approximately 75' of low marsh vegetated with Smooth Cordgrass (Spartina altemiflora). There is a 10' to 15' wide sand
bar and high marsh area in the middle of the low marsh that is vegetated with Groundsel Bush (Baccharis halimifolia), Salt
Grass (Distichlis spicata), and Salt Meadow Grass (Spartina patens). At the point where the low marsh interfaces with the
open water the pier walkway makes a turn to the south, extends for 46' feet to the south, and makes a turn back to the
southeast where it transitions to the docking structure. At this point, there are two approximately 3' wide by 5' long
platforms on both sides of the pier walk that serve as the upper landings for ramps that lead to 6' x 12' floating docks.
Continuing southeast, the walkway is centered in an existing 40.5' x 13.5' boathouse with boatlifts on both sides of the
walk. Boat entry into the boathouse and associated boatlifts is possible from the east and west. Finally, a 9'x18' uncovered
deck with benches is located at the end of the structure. The existing structure provides docking space for 4 vessels.
The waters in the vicinity of the project are classified SA by the North Carolina Division of Water Quality and are Open to
the Harvest of Shellfish. The waters are not designated as a Primary Nursery Area.
PROPOSED PROJECT
In conversation with Mr. Conway (agent), I have gathered that Mr. Ebert either has purchased or will purchase a larger
boat and is requesting the proposed modifications to the existing structure in order to accommodate the new vessel. It is
proposed that the southwestern side of the boathouse and associated boatlift be enlarged and reoriented. Specifically, the
proposal is for a 23'x17' boathouse oriented such that boat entry be provided from the channel side. In order to do this, it
is proposed that approximately 4S of the 9'xI8' uncovered deck be removed to allow for the reoriented boathouse and
boatlift. This would leave an approximate 9' x 13.5' uncovered deck on the end of the pier structure. The channel side of
the boathouse addition would be brought into alignment with the channel side of the uncovered deck. The boatlift would be
appropriately enlarged and reoriented under the newly modified boathouse. The proposed pier length is less than one
quarter the width of the 347' wide water body and it does not encroach into the setback from the channel. The water depth
in the area of the boat slips is about 2' at ML W. The proposed structure would provide docking space for 4 vessels.
10. ANTICIPATED IMPACTS:
The proposal incorporates an additional 120 sq. ft. of estuarine waters and public trust area. Minor increases in turbidity
can be expected during piling placement.
