On April 15, 2004, Mr. Alan Johnson with this office conducted a site inspection at the subject site. During the site visit it was noted that aquatic biota was observed.in the stream channel identified as intermittent (sheet B) on your Pre-Construction Notification form. Because of the presence of aquatic species, mitigation will be required for the impacts (#5 and #6) to this channel as well as for impacts #2 and #3 in the channel identified as perennial. The total linear feet (if) of channel to be mitigated is 297 ft. Per Mr. Chris Huysman, it is this office's understanding that an application will be submitted to the Ecosystem Enhancement Program (EEP) for payment into the mitigation fund. In addition to the above, Mr. Johnson requested that the impact to the channel that passes through lot 181 be reduced from the current 92 If to approximately 35 If. Until the DWQ is notified that the EEP will accept payment for the impacts and the information requested in this letter is provided, this office is requesting (by copy of this letter) that the Corps of Engineers place this project on hold. Also, this project will be placed on hold for our processing pursuant-to 15A NCAC 2H .0507(h). Thank you for your prompt attention to this matter. Box 224 Newton, NC 28658 Subject Project: Skycroft Subdivision (Revised acceptance) County: Union The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept payment for stream impacts associated with the subject project. Please note that the decision by the NCEEP to accept the mitigation requirements of this project does not assure that this payment will be approved by the U.S. Army Corps of Engineers and the N.C. Division of Water Quality Wetlands/401 Unit. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP for impacts associated with this project is appropriate. This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. Based on the information supplied by you in a letter dated June 8, 2004 the stream restoration that is necessary to satisfy the compensatory mitigation requirements for this project is summarized in the following table. The maximum amount of mitigation that the NCEEP will accept for this project is also indicated in this table. Deputy Director Division of Water Quality July 6, 2004 DWQ# 04-0453 WETLANDS 401 GROUP Union County Mr. Mike Reeve JUL 1 2.2004 Graham PC Investments, LLC 10800 Sikes Place, Suite 250 Charlotte, NC, 28277 MATER (QUALITY SECTION APPROVAL of 401 Water Quality Certification with Additional Conditions, Ecosystem Enhancement Program Dear Mr. Reeve: You have our approval, in accordance with the attached conditions and those listed below, to impact 297 linear feet (If) of unnamed stream to Twelve Mile Creek in order to construct the Skycroft Subdivision in Union County, as described in your application received by the Division of Water Quality (DWQ) on March 24, 2004. After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3402, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. The General Certification allows you to use Nationwide Permit Number 39 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted Certification will expire when the USACOE's associated 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed in the attached Certification, as well as the additional conditions listed below: 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds on the property. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401 /Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands. 2. The culverts required for this project shall be installed in such a manner that the original stream profiles are not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including the pattern and profile) are to be maintained above and below locations of each culvert. The culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re-installed correctly. Stormwater discharge points shall be constructed in a manner such that the potential receiving streams (of the discharge) at the site will not be impacted due to sediment accumulations, scouring or erosion of the stream banks. 4. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notification application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best management Practices (BMP) shall be performed so that no violations of state water quality standards, statutes, or rules occur. 5. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface water standards: a. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. b. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. c. The reclamation measures and implementation of these measures must be in accordance with the requirements of the Sedimentation Pollution Control Act. 6. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date the Division of Land Resources has released the project. 7. We understand that you have chosen to contribute to the Ecosystem Enhancement Program (EEP) in order to compensate for the impacts to streams. In accordance with 15A NCAC 2R.0402 and 15A NCAC 2B .0242(7), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h) and 15A NCAC 2B .0233(10). Until the EEP receives and clears your check (made payable to: DENR - EEP, stream impacts (including fill) shall not occur. Ms. Deborah Anderson should be contacted at (919) 733-5208 if you have any questions concerning the EEP. You have one month from the date of this Certification to make this payment. For accounting purposes, this Certification authorizes the fill of 297 linear feet of perennial streams in the Catawba River Basin (Cataloging Unit 03050103) and 297 linear feet of stream mitigation is required. 8. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to the 401NVetlands Unit of the NC Division of Water Quality upon completion of the project. Please send photographs upstream and downstream of each culvert site to document correct installation along with the Certificate of Completion form. 9. Continuing Compliance. Graham PC Investments, LLC shall conduct its activities in a manner consistent with state water quality standards (including any requirements resulting from compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify Graham PC Investments and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to Graham PC Investments in writing, shall be provided to the United States Army Corps of Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Proposed Impacts Impacts for the project include 145 linear feet of perennial streams and 1039 linear feet of intermittent / un-important streams; the COE verified these determinations on January 21, 2004. Additional impacts to 0.02 acres of wetlands and 0.04 acres of open water are sought for the purpose of constructing lots. Perennial stream impacts are limited to road crossings and driveway crossings; the current design uses headwalls to eliminate side-slope fills. Intermittent stream impacts include 795 linear feet for a pond, 152 linear feet for a road crossing and 92 linear feet for a single lot. Impacts are described and illustrated in the attached PCN and maps. Mitigation Impacts to perennial streams are assessed to be minimal due to the construction methodologies. The proposed mitigative measures include 1) the preservation of over 3500 linear feet of streams, 2) the preservation of over 1 acre of wetlands, 3) the preservation of over 2 acres of open water, 4) the creation of over 5 acres of ponds and 5) the creation of over 0.5 acres of littoral wetlands within amenity ponds.
