On April S, 2004, Joanne Steenhuis of the Division of Water Qua.lity (DWQ) Wilmington
Regiona.l Offlce, investigated the proposed project site to review the project for the Division of Water
Quaiity concerns. The inspection of the site revealed that potential wetlands exits on the site.
This Office will require a. wetlands delineation to be done for the site and signed off by the Corps
of Ellgineers. In the interest of time, a consultant can be hired to delineate the wetllU1ds and the Corps
oontacted for approval ofthe wetland line.
If there are wetlands on site, this Office would require a modification of the proposed project and
ifw~tlands are to be impacted you will need to apply for a 401 or 401 Express certification. Please do not

9. PROJECT DESCRIPTION
Brian Keesee, representing Brian Keesee Construction, Inc., has requested that the attached application be processed under
the Express Permit Review Pilot Program.
The applicant's project is located at 105 SE 58th Street, approximately 0,10 mile east of the intersection of E, Oak Island
Road and SE 58th Street, in Oak Island, Brunswick County. To find the property, take Highway 74/76 west from
Wilmington and turn left on N.C, State Highway 133, Head south on Hwy 133 and turn right onto E. Oak IslandlYaupon
Drive. Travel west approximately one and a half (1.5) to two (2) miles and Wrn left onto SE 58th Street. The subject
property is bordered by both residential and commercial properties,
Oceanwalk Condos is being proposed on a 3.38 acre tract, located between SE 58th Street and SE 57th Street in Oak Island,
North Carolina, The applicant has submitted a work plat drawing indicating the proposed development areas within the 3.38
acre tract. A portion of the tract is located in the "VE" Zone, as indicated by the FEMA Flood Insurance Rate Maps
(F.I.R.M), and is contiguous with the Atlantic Ocean. The location of the tract in relation to the geological conditions in the
area surrounding this particular portion of Oak Island necessitated the preparation of a CAMA MaJor Permit Application.
An Area of Environmental Concern (AEC) Hazard Notice was provided to the applicant, informing him that the project site
is located in a High Hazard Flood Area. According to information, accepted by the Coastal Resources Commission, the
annual erosion rate in the vicinity of the property is approximately 2.0' per year. Given the annual erosion rate, studies
indicate that th.e shoreline could move as much as 300' landward during a _~ajor storm ~vent. Flood waters associated with
a major storm could potentially reach 17' in the area surrounding the project site. According to the survey provided by the
applicant, the Vegetation Line is approximately 450' south of the southern most property line.
The subject property is currently cleared and was previously used as an RV campground and/or mobile home site. The only
remaining structures on the property are an abandoned RV and Concession Stand. The applicant has indicated that the
concession stand would be demolished prior to construction of the condominium complex. The property is comprised of all
high ground and exhibits no signs of any "404" Type wetlands or coastal wetlands. High ground vegetation at the site
consists primarily of Wax Myrtles (Merica cerifera) and Red Cedar (Juniperus virginiana). Lawn grasses cover the
remaining portions of the tract. The closest portion of the tract to the nearest body of water is approximately 600'
(measured to the Atlantic Ocean), Elevation at the site averages approximately 10,0' above Mean Sea Level.
PROPOSED PROJECT
The applicant proposes to develop the 3.38 acre tract by constructing five (5) condominium units with associated driveways,
parking areas, utilities and pedestrian accesses. The applicant also proposes to construct a swimming pool and pool house.
Development would include grading and filling the entire 3.38 acre tract to cover road construction and lot preparation. FilI
material brought to the site would be clean of any contaminants and would be provided by an upland source. The fill would
also be compatible with the native sands. The five (5) .condominium units would be structurally independent and would
provide approximately 120 units for single family/multifamily use. According to the application, the density of proposed
development would equal 35.5 units/acre. Access to the complex would be provided by the construction oftwo(2) entrance
drives, located off of SE 58th Street. Two (2) exit drives would be constructed and located on the western side of the tract
along SE 57th Street. The asphalt drives would circle the entire condominium complex. Parking would be confined to the
areas between the condominiums and to the outer limits of the property. The northern most portion of the property would
contain the swimming pool (20' x 40') and pool house. Access to the swimming pool and pool house would be provided
by pedestrian access walkways as well as the inner parking drive, located between the condos. The applicant has indicated
that municipal water would be provided by the Town of Oak Island, The Town of Oak Island has issued a conditional use
permit to the applicant, for the development of a 120-unit residential condominium complex at the proposed development
site,

The permit was issued as per recommendation to extend the vested rights period from two (2) to four (4) years, due to
future availability of wastewater flow. The applicant does not currently have sewer service at the project location, however
the Town of Oak Island has allocated a portion of the new waste treatment facility for Oceanwalk Condos. The applicant
anticipates that the sewage connection will be made sometime during the next three (3) months. .
The applicant has submitted an Express High Density Stormwater Permit to the North Carolina Division of Water Quality.
The Express Stormwater permit application was received on 3/15/2004 and is pending due to an incomplete application,
The applicant has also submitted a non-express Sedimentation and Erosion Control Plan (SECP) to the Division of Land
Quality, At the time that the CAMA field investigation report was prepared, a SECP had not yet been approved for the
proposed development associated with Oceanwalk Condominiums.
10. ANTICIPATED IMPACTS:
The initial grading of the property would result in the disturbance of approximately 3.38 acres of high ground. The
proposed condos, driveways, pedestrian walkways, swimming pool and pool house, would result in the creation of
approximately 135,878 square feet of impervious surface. . The applicant has applied for an Express State Stormwater
Permit with the Division of Water Quality (Stormwater permit # SW8 040213), however a permit has not yet been issued.
The applicant anticipates that once issued under the high-density option, the Stormwater Permit would restrict the total
maximum built-upon area of the subdivision to 135,878 or 92 % coverage for the entire tract. If issued, future development
would require a modification of the CAMA Major Development Permit{from the Division of Coastal Management.

This notice is intended to make you, the applicant, aware.
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents, The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued. .
The Commission's rules 011 building standards, oceanfront '
setbacks and dune alteration are designed to minimize, but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
erosion rate for the area where your property is located is
" feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studie:3~dicate that the shoreline could move as
much ~feet landward in a major storm. .
The flood waters in a major storm are predicted to be about
./.L feet deep in this area. .
Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storrns and erosion. Permits issued for development in this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site, If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPQ will inform you that you may begin work. It is impor-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line 'established. It is unlawful to continue work
after permit expiration without this approval.
