Dorney, Division of Water Quality Dept. of Environment and Natural Resourc FROM: Ron Linville, Regional Coordinator Habitat Conservation Program DATE: April 5, 2004 SUBJECT: Review of 401 Certification Application, Charlotte Country Club Driving Range Extension, DWQ No. 040418, Mecklenburg County The Country Club is requesting an after-the-fact 401 Water Quality Certification from the North Carolina Division of Water Quality. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed project includes seventy-five (75) feet of unauthorized piping to an unnamed tributary (stream A) of Briar Creek. A total of 299 linear feet of this tributary is proposed to be piped for the driving range. Mitigation is proposed through stream mitigation (Level II, enhancement or stabilization) at a separate stream apparently west of the impacted area. The mitigation stream site is not contiguous due to a section that is excluded at the end of a cul-de-sac off Dearmon Drive. While we understand site restriction implications and the expressed need for the project, we are concerned that extensive piping will essentially fragment upstream aquatic habitats (above the pipe). If potential stream relocation and avoidance and minimization cannot reduce piping impacts to a maximum of 80-100 linear feet, additional mitigation for reduced aquatic community connectivity should be considered if fish or mussel species are present that may be diminished by extensive culverting activities. If possible, the proposed mitigation stream segment should provide complete and contiguous bioengineering enhancement and preservation. This entire stream reach and restoration area should be permanently protected with deed restrictions or conservation easements. 2. Additional mitigation should be provided by placement of the upper portions of stream A and the floodplain of stream B into deed restrictions or conservation easements. 3. Buffers for mitigation streams and non-mitigation streams should be as wide as possible. We recommend preservation of entire floodplain corridors as natural undisturbed forested areas. Minimum 100 foot buffers are recommended for perennial streams. 4. Only native plant species should be used for bioengineering activities. 5. Pipes 48 inches diameter or larger should be buried a foot into the streambed. Pipes less than 48 inches diameter should be buried to a depth equal to or greater than twenty (20) percent their diameter to allow for aquatic life passage. These measurements must be based on natural thalweg depths. 6. Golf course maintenance should follow practices recommended by Audubon International. On April 6, 2004 Mr. Alan Johnson with this office conducted an inspection at the site. Issuance of the 401 Certification does not appear to be a problem. However, your application requested onsite mitigation for the impact. In discussions with your consultant, Mr. Greg Antemann, it was noted that approximately 1000 linear feet of stream would be required to mitigate for the impact depending on the degree of the enhancement project for the proposed stream. It was also discussed that another alternative would be a combination of stream enhancement and paying into the Ecosystem Ecological Enhancement Program (if possible). This project will be placed on hold until clarification is provided. Prior to issuance of the 401 Certification, it is requested that the following be submitted/ provided: • A more detailed conceptual plan of the proposed stream enhancement project. • Timeline for the completion of the project. The General Certification allows you to use Nationwide Permit Number 39 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted Certification will expire when the associated USACOE's 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter, and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed in the attached Certification, as well as the additional conditions fisted below: 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds on the property. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). For accounting purposes, this Certification authorizes the permanent impact of 299 linear feet of perennial stream in the Catawba River Basin (Cataloging Unit 03050103) and requires mitigation for 299 linear feet of stream. Please be aware that the EEP rules require rounding of stream impacts to the nearest foot (15A NCAC 2R .0503(b)). 3. The culvert required for this project shall be installed in such a manner that the original stream profile is not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including the pattern and profile) are to be maintained above and below locations of each culvert. The culvert shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes are installed in a perched manner, the pipes shall be removed and re-installed correctly. 4. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notification application. All construction activities shall be performed so that no violations of state water quality standards, statutes, or rules occur. 5. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full compliance with all specifications governing the proper design, installation, and operation and maintenance of such BMP in order to protect surface water standards: a. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow pit sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. b. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. c. The reclamation measures and implementation of these measures must be in accordance with the requirements of the Sedimentation Pollution Control Act. 6. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date the Division of Land Resources has released the project. 7. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to the 401NVetlands Unit of the NC Division of Water Quality. Please send photographs upstream and downstream of each culvert site to document correct installation along with the Certificate of Completion form. 8. Continuing Compliance. Charlotte Country Club (CCC) shall conduct its activities in a manner consistent with state water quality standards (including any requirements for compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify CCC and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 21-1.0504. Any new or revised conditions shall be provided to CCC in writing, shall be provided to the United States Army Corps of Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. F Page 3 If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. This project will involve upgrading and expanding the existing practice range facility. Mr. Mike Pilo is the Golf Course Superintendent at the Charlotte Country Club and has retained Carolina Wetland ' Services, Inc. (CWS) to provide permitting services for this project. An Agent Authorization Form has been included as Attachment B. ' The results of the on-site field investigation conducted by CWS indicate that there are two jurisdictional stream channels (Streams A and B) and one non jurisdictional stream channel (Channel C) located within the project limits (Attachment A - Figure 3). CWS is requesting written verification of the jurisdictional determination of on-site features (Attachment Q. Unavoidable impacts associated with this project total approximately 299 linear feet of Perennial Stream A. On behalf of The Charlotte Country Club, CWS is submitting an After-the-Fact Permit application with attachments in accordance with Nationwide Permit General Condition No. 13, and ' pursuant to Nationwide Permit No. 39 (Attachment C). J Charlotte Country Club Driving Range Expansion March 17, 2004 After-the-Fact Permit Application Pursuant to Nationwide Permit No. 39 Project No. 2003-0527 Existing Conditions The Charlotte Country Club is located in Charlotte, North Carolina, approximately 1 mile northwest of the Central Ave. - Eastway Dr. intersection (Attachment A - Figures 1 and 2). This project will involve upgrading and expanding the existing practice range facility. Mr. Mike Pilo is the Golf Course Superintendent of the Charlotte Country Club and has retained Carolina Wetland Services, Inc. (CWS) to provide permitting services for this project. Current Land Use The land use surrounding the project area consists of an 18-hole golf course with forested areas. Dominant vegetation within forested areas includes white oak (Quercus alba), Chinese privet (Ligustrum sinense), sweetgum (Liquidambar styraciflua), southern magnolia (Magnolia grandiflora), and willow oak (Quercus phellos). The remainder of the property is dominated by maintained fairways and greens characteristic of most golf courses. Jurisdictional Delineation On December 29, 2003, CWS's Ron Johnson and Isaac Hinson determined on-site jurisdictional waters of the U.S.' using the U.S. Army Corps of Engineers (USACE) - Routine On-site Determination Method. This method is defined in the 1987 Corps of Engineers Wetlands Delineation Manual? No jurisdictional wetland areas were located within the project limits (Attachment A-Figure B). A Routine On-Site Data Form representative of on-site non jurisdictional upland areas has been included as Attachment D. Jurisdictional waters of the U.S. were classified according to recent North Carolina Division of Water Quality (NCDWQ)3 and USACE guidance. NCDWQ Stream Classification Forms and USACE Stream Quality Assessment Worksheets for on- site streams have been included as Attachments E and F. The results of the on-site field investigation indicate that there are two jurisdictional stream channels (Streams A and B) and one non jurisdictional channel (Channel C) located within the project limits (Attachment A -Figure 3). On-Site jurisdictional waters are unnamed tributaries to Briar Creek. Briar Creek is part of the Catawba River basin W# 03050103)4 and is classified as "Class C" waters ' "Jurisdictional waters of the U.S." includes essentially all surface waters such as: all navigable waters and their tributaries, all interstate waters and their tributaries, all wetlands adjacent to these waters, and all impoundments of these waters. 2 Environmental Laboratory. The Charlotte Country Club is requesting written verification of the jurisdictional determination of the on-site features (Attachment G). Stream A flows east for approximately 740 linear feet until its confluence with Stream B. (Attachment A - Figure 3). Stream A was evaluated to be Perennial. Stream A exhibited moderate flow during the investigation, weak sinuosity, and substrate ranging from silt to large cobble (Attachments E and F - SCPl). Biological sampling within Stream A resulted in a moderate presence of benthic macroinvertabrates. Perennial Stream A scored 27.5 out of a possible 71 points on the NCDWQ Stream Classification Form and 43 out of a possible 100 points on the USAGE Stream Quality Assessment Worksheet. A photograph of Stream A has been included as Attachment H - Photograph A. Stream B flows south through the center of the golf course for approximately 1,640 linear feet (Attachment A - Figure 3). Stream B was evaluated to be Perennial and exhibited strong flow during the investigation, weak sinuosity, strong bed and bank, and a substrate ranging from silt to small boulders (Attachments E and F - SCP2). Biological sampling within Stream B exhibited a weak presence of crayfish, benthic macroinvertabrates and a moderate presence of fish. Perennial Stream B scored 41 out of a possible 71 points on the NCDWQ Stream Classification Form and 51 out of a possible 100 points on the USACE Stream Quality Assessment Worksheet. A photograph of Stream A has been included as Attachment H - Photograph B. Non-Jurisdictional Channel C is a grass-lined ditch that flows from behind a storage building north of Stream A (Attachment A - Figure 3). This channel was evaluated to be non jurisdictional based on its lack of channel substrate and groundwater discharge. This channel also lacks biological indicators and hydric soils (Attachments E and F - SCP3). Channel C scored 9 out of a possible 71 points on the NCDWQ Stream Classification Form and a 21 out of a possible 100 on the USACE Stream Quality Assessment Worksheet. 4 J I Charlotte Country. Club Driving Range Expansion March 17, 2004 After-the-Fact Permit Application Pursuant to Nationwide Permit No. 39 Project No. 2003-0527 Agency Correspondence Cultural Resources A letter was forwarded to the State Historic Preservation Office (SHPO) on January 21, 2004 to determine if areas of architectural, historic, of archaeological significance are located within the project area and that would be affected by the project. In a letter dated February 19, 2004, the SHPO stated that they "are aware of no historic resources, which would be affected near the Charlotte Country Club Driving Range Expansion Project" (Attachment I). Protected Species A letter was forwarded to the North Carolina Natural Heritage Program (NCNHP) on January 21, 2004 to determine if any federally-listed species or critical habitat were located within the project area. In a letter dated January 22, 2004, the NCNHP stated that they "do not have any records for rare species, high quality natural communities, or significant natural heritage areas (SNHAs) near the Charlotte Country Club Driving Range Expansion Project" (Attachment I). Purpose and Need for the Project The purpose of this project is to upgrade and expand the existing practice facility. The expansion of the existing practice range facility is necessary to accommodate future golfing events at the Country Club. Eligibility to host these events requires certain specifications for the practice facility. Current practice facilities are undersized and below event requirements. Additional impacts to Stream A are necessary to accommodate maintenance vehicle access to the indoor tennis facility. Avoidance and Minimization Impacts to on-site jurisdictional waters of the U.S. have been reduced to the maximum extent practicable. Impacts have been limited to Stream A and are within the thresholds of Nationwide Permit No. 39. Proper sediment and erosion control measures will be used to minimize disturbances to downstream waters. 5 Charlotte Country Club Driving Range Expansion March 17, 2004 After-the-Fact Permit Application Pursuant to Nationwide Permit No. 39 Project No. 2003-0527 I I I I I I I I I Proposed Impacts to jurisdictional Waters Proposed impacts will total approximately 299 linear feet of Perennial Stream A. Approximately 75 linear feet of Stream A was piped prior to this application submission. Ms. Amanda Jones of the USACE Asheville Field Office issued a Notice of Unauthorized Activity on November 24, 2003 (Action ID 200430113). Impacts will result from the expansion of the existing practice range facility in order to accommodate future events at the Country Club (Attachment J - Figure 4). On behalf of The, Charlotte Country Club, CWS is submitting After-the-Fact Permit application with attachments in accordance with the written notification requirements of Nationwide Permit No. 39. Compensatory Mitigation Restoration activities were considered for this project to fulfill mitigation requirements. Restoration activities including natural channel design requires a wide stream corridor. The only available location for mitigation is located off Masonic Drive, near the southeast comer of the Charlotte Country Club. The current stream profile at this location runs near the property boundary of the Charlotte Country Club. The existing floodplain is not wide enough to implement this type of design while avoiding existing residential structures and controlling flooding. Future plans for the property just west of the stream channel involve the installation of a concrete bicycle trail to connect with Masonic Drive. Restoration proved not to be a viable option considering the location of the available site, future project plans, and proximity to existing structures. Compensatory mitigation for the aforementioned impacts will be accomplished through stream enhancement (Level II) at a 2.5:1 ratio. The proposed stream enhancement includes approximately 750 linear feet of an unnamed tributary to Briar Creek (Attachment J - Figure 5). This stream is experiencing severe erosion and has a riparian buffer dominated by Chinese privet. Chinese privet has a high degree of reproductive vigor and a wide range of adaptability. It can dominate the shrub layer of an invaded habitat, thus altering species composition and natural community structure by choking out native plant species. The proposed mitigation would remove and replace invasive plants growing within a 50-foot buffer along the stream enhancement project with native hardwood species. Proposed channel work would include the construction of floodplain benches and bioengineering techniques to alleviate erosion. Table 1 is a list of proposed native riparian tree and shrub species to be installed along the restored riparian buffer. Plants will be planted at random and on 6-foot centers. The project will be deemed a success if a survival rate of 320 woody stems ' per acre is achieved. If adequate numbers are not present, replanting will occur until this goal is met. CWS will prepare monitoring reports one year post planting and every successive year until the five year monitoring period is complete. This report will be submitted to the USACE and NCDWQ on an annual basis. These reports will be generated during the early fall of each year. Representative ' photographs of the site will be taken at permanent photographic monitoring stations established during the initial planting and included with the reports. Impact Justification (Avoidance and Minimization) ' Impacts to on-site iurisdictional waters of the U.S. have been reduced to the maximum extent practicable. Impacts have been limited to Stream A and are within the thresholds of Nationwide Permit No. 39. Proper sediment and erosion control measures will be used to minimize ' disturbances to downstream waters. Page 4 of 7 A VIII. Mitigation Compensatory mitigation for the aforementioned impacts will be accomplished through stream ' enhancement (Level II) at a 2.5:1 ratio. The proposed stream enhancement includes approximately 750 linear feet of an unnamed tributary to Briar Creek (Attachment J - Figure 5). This stream is experiencing severe erosion and has a riparian buffer dominated by Chinese privet Chinese privet has a high degree of reproductive vigor and a wide range of adaptability. It can dominate the shrub laver of an invaded habitat, thus altering species composition and natural community structure by choking 0 native plant species. The proposed mitigation would remove and replace invasive plants growing withi ' a 50-foot buffer along'the stream enhancement project with native hardwood species Proposed channel work would include the construction of floodplain benches and bioengineering techniques to alleviate erosion. Table 1 is a list of proposed native riparian tree and shrub species to be installed along the restored riparian buffer. Plants will be planted at random and on 6-foot centers. A Nationwide Permit No. 27 will be applied for as necessary once the design of the proposed mitigation plan is finalized Plantings will occur in the Fall of 2005 and will be monitored for a five year period to ensure adequate ' survival rates. The project will be deemed a success if a survival rate of 320 woody stems per acre is achieved. If adequate numbers are not present replanting will occur until this goal is met CWS will prepare monitoring reports one year post planting and every successive year until the five mar monitoring period is complete. This report will be submitted to the USACE and NCDWQ on an annual basis. These reports will be generated during the early fall of each year. Representative photographs of the site will be taken at permanent photographic monitoring stations established during the initial ' planting and included with the reports. 1.
