Each of your comments is reproduced below with an associated response below the numbered item. 1. Please verify that the scale on Sheets 1, 2, 4, and 5 of the drawings is 1"=60' and revise the drawings to include this information. The scale for all other drawings does not appear to be accurate. All drawings should be accurately scaled and capable of being printed in 11x17" format. Please revise and include a visible creation and revised date on each drawing. - Please see the revised plans attached. 2. Bank stabilization impacts should be counted for each bank. If the 1"=60' scale is accurate, it appears the project will impact more like 725-750 linear feet. Bank stabilization in excess of 500 linear feet and in excess of one cubic yard per running foot requires a waiver from the permit limit. Please clarify so that the Corps can request concurrence from the resource agencies. Please note that the agencies have 10 calendar days to provide comment from the date of receipt of our request. - Impacts are now presented as 635 linear feet of bank stabilization reflecting the total of both banks. 3. Please provide written specifics for the "impervious barrier" that will be utilized to allow work to be conducted in the dry. The Corps will utilize this information to determine if a restoration plan for restoring temporary impacts is required. Please clarify impact amounts associated with temporary in -stream work/structures. Please provide written specifics and clarify impact amounts associated with temporary access fills. Also, include access locations on the overall drawings. The overall drawings show only one access point/impact, whereas, the cross-sections show multiple locations. Additionally, it is hard to tell what is being proposed for temporary access on the overall. A written description and a detailed inset would assist the reviewer. - Please see the attached written narrative from the engineer after consultation with a contractor to ensure practicable methods. 4. Please include the various impact amounts on the overall drawings. - Impacts have been added to the plan sheets at the top of each page including breakdown by bank for the permanent stabilization and temporary impacts for construction access. 5. for your edification, please note that stream bank stabilization impacts are permanent impacts, not temporary; however, these type of impacts should not result in a permanent loss of waters. - Understood. We request that the permit when issued reflects permanent impacts. The use of a singular bank in this sentence leads me to interpret the limits as 500 If of stabilization in total. I just talked with Liz Hair who works DOT. She said this very topic came up in one of their internal DOT meetings a few years ago, and they were instructed to interpret/permit as I do. It doesn't surprise me that some regulators may not have not adjusted 'their way' and continue to permit these projects incorrectly. It's wrong, but it's a bad habit that isn't that big of a deal, I guess, because it's only an administrative step to get the waiver that's being skipped. Have a great day! Emily - one clarification. On the impact per running foot, the engineer works on a lot of NCDOT projects and said that they usually calculate riprap impacts based on the stream channel footage regardless of one side or two being stabilized for those projects. Just wanted to clarify if that is a different interpretation or some other circumstance. Also, should the cubic footage be halved (approximately) since we are counting each bank separately? Hurricane Mathew and subsequent tropical storm flooding have caused the banks of Cross Creek to scour and slough, threatening the stability of the building structures. The planned protection consists of soil nail wall with shotcrete facing in the vicinity of the building at 325 Cool Spring street (east bank of Cross Creek). The remainder of the property banks will be stabilized by laying the banks back on a 1.5:1 slope and armoring with class II rip rap and filter fabric. Construction access to the site will be via an undeveloped parcel with frontage on Ann Street that is also owned by the Heritage Place Group and is located adjacent (north) to 240 Ann Street (35.05565, - 78.87507). Approximately 0.75 acres will be cleared and used as access and a laydown area for construction staging. Silt fence, special sediment control fence, rock check type -A and pipe inlet protection will be utilized in the staging area (see plans). Due to limited access and high steep stream banks, the project will be constructed from the stream side of bank with an impervious barrier consisting of sheet pile wall or sand bag wall in the approximate center of the stream. Construction will be limited to one side of the stream at a time with the east bank being first due to the eminent threat to the building on that side. The temporary access depicted in the construction phasing cross sections will be rock fill placed on geotextile material to provide a surface to work from. The maximum access fill is shown in the construction phasing cross sections for permitting purposes. It is anticipated that the actual amount of temporary fill for access will be much less, and is dependent on the contractor. Once construction stabilization of the east bank is complete, the temporary access fill will be removed along with the geotextile material. 2-48" temporary pipes will be installed to provide access to the west bank. Then both end sections of the impervious barrier will be removed (downstream first) so that low flow of the stream will flow through the 2 -48" temporary pipes and along the east side of the impervious barrier. The remainder of the impervious barrier required for construction of the west bank will be installed (upstream section first). Construction along the west bank will follow methods of east bank construction. Once bank stabilization is completed, temporary access, impervious barrier and temporary 2-48" pipe will be removed. Once the project has been constructed, the laydown/staging area will be seeded with permanent vegetation. It should be noted that this site is located in a FEMA regulated flood hazard zone with a detailed study. A CLOW has been obtained for this project from DHS -FEMA.
