Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The project site encompasses approbmately 28.997 acres and is located at 1021 S. Main Street, within the southern portion of the Town of Fuquay-Varina, in Wake County, North Carolina. The project site is a single phase with no additional phases. Appropmately 90% of the project site is comprised of forested land. The remaining 10% consists of agricultural land consisting of a cultivated field. The project site is bound to the north and east by low density residential land, to the south by forested, agricultural, and low density residential land, and to the west by low density residential land. An unnamed perennial tributary of Kenneth Creek flows from northwest to southeast through the northeastern portion of the project site. Two forested wetland areas are located in the vicinity of this tributary, one surrounding the central and southern portions of the stream, and one located up -gradient of the stream along a portion of the northern property boundary. The project site is located within the Cape Fear River Basin (12 -digit HUC 030300040501), and drains to Kenneth Creek which has a Stream Classification of Class C. According to FEMA FIRM Panel #s 3720066600J and 3720065600J (effective 5/2/2006), the site is located within Zone X areas located outside of the 100 -year floodplain. A wetland delineation was completed by Timmons Group on October 2, 2018. Confirmation of the delineated boundaries was received from James Lastinger of the USACE on January 24, 2019. Explain the purpose of the proposed project:* The purpose of the project is to construct a mixed-use project consisting of single-family and multi -family (townhomes) dwellings in Fuquay-Varina. 41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The proposed residential development, known as Perry Property/Phillips Place will consist of 24 single-family lots and 129 townhomes and the associated amenities, roadway, stormwater control measures (SCMs), and utility improvements (i.e. public water supply and sanitary sewer alignment). The project is located to the southeast of the intersection of South Main Street and Judd Parkway. One (1) road crossing of a stream and surrounding wetland area is proposed to connect the northeastern portion of the development to the remaining portions of the development. The attached Construction Drawings and Impact Maps include the specific details of proposed construction. The crossing will involve the installation of two 42" reinforced concreate pipes (RCPs). One RCP will be countersunk underneath the road to maintain the hydrologic connection between the up -gradient and down -gradient portions of the stream. The second pipe Wil be installed to service high flow conditions. No rip -rap proposed as the main pipe will be placed in the existing channel. All work will be conducted in accordance with local, state, and federal regulations. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment, graders, and earth provers. SCM's are required and will be used. Two wet ponds are proposed. 4j. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to jurisdictional features have been avoided and minimized to the ma>amum extent practicable by incorporating resourceful site planning, including the utilisation of the wetland delineation to adjust the layout to avoid and minimize impacts. Avoidance and minimization measures were also accomplished during the design phase of the project. The proposed impacts are required in order for the projects goals to be realized. The single crossing is necessary for connectivity of the project. The crossing location chosen is the least impactful to the e>asting wetlands and stream. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, clearing only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris and other pollutants from entering the adjacent jurisdictional features. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project construction activities initiated within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of disturbance within the jurisdictional streams. 2. The species listed by IPaC include, the red -cockaded woodpecker, Cape Fear shiner, Atlantic pigtoe, and Michau)[s Sumac. No critical habitats were found within our project area. The red -cockaded woodpecker's habitat includes pine trees 60 years old or older. The project site is mostly mixed hardwood forests, which is not preferred by red -cockaded woodpeckers. The Cape Fear shiner's habitat includes streams with gravel and cobble and slow pools, riffles, and slow runs. This species is not observed in Wake County. The Atlantic pigtoe prefers habitat with excellent water quality, which does not include the stream on our site. Michau (s sumac prefers disturbed open areas or edges, which does not include the habitat of our project area. NCNHP does not indicate presence of any of the species mentioned above within a one -miles radius of the project area.
