Keene, PE PO Box 1198 Pineville, NC 28134 NORTH CAROLINA Environmental Quality RESPONSE TO COMMENTS June 28, 2019 Subject: Request for Additional Information Stormwater Permit No. SW3190505 Courtyards on Lawyers Road Union County Dear Mr. Keene: The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application for the subject project on May 30, 2019. A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. The directions to the project site are not from an intersection of two major roadways. Major roads are 1, 2, and 3 digit North Carolina highways, or any US, or Interstate highway. (Section I, 3). For example, you could use the intersection of NC 51 and NC 218 as a starting point. Directions to project site have been revised on Application Form as requested. 2. Please adjust the location map on the cover sheet to include the major intersection used above (Section VI, 8, c). Vicinity map has been revised as requested. 3. Please verify that Scott Twiddy is the owner and developer for this property. If he is, please make the following changes so the application is consistent with the plans (Section II). If not, please clarify and adjust the application as needed. Changes have been made to application as described below. a. Section II, 1a — Use the developer organization, "Epcon Communities" b. Section II, lb — Use the contact information for the above property (Charlotte, NC address) c. Section II, 2b — Use the contact information for "Epcon LR2, LLC" (Dublin, OH address) 4. There is a discrepancy between the overall percent impervious shown on the plans and in the application. Please revise for consistency (Section IV, 8). Percent impervious has been revised to resolve discrepancy. Please show and delineate the total surface water area (0.93 acres as per the application) that is being excluded from the total property area (Section VI, 8, h). Please label the acreage for each area. Total surface water area has been delineated and labeled on the Post -Development plans. 6. Please confirm the extents of the wetlands shown in the east side of the project site. Please also provide the name, mailing address, and phone number of the individual who makes this determination (Section VI, 8, h). Wetland areas have been identified on plan per delineation from Wetland Scientist and USACOE. Contact information for Wetland Scientist provided on Cover Sheet. 7. Please confirm the extents of the intermittent streams shown in the area south of the clubhouse and the perennial stream on the east side of the project site (Section VI, 8, p Stream areas have been identified on plan per delineation from -Wetland Scientist and USACOE. 8. Please provide the BUA per lot on the signed deed restrictions. If the BUA is not the same for each lot, please include an attachment to the deed restriction that lists each lot and its BUA limit. BUA per lot has been added to deed restrictions. 9. The forebay volume should be provided in addition to the main pool volume. Please ensure that your sizing calculations do not include the forebay volume in the main pool volume. Sizing calculations have been revised to ensure forebay volume is not included in the main pool volume. 10. While the wet ponds may be used for peak attenuation, the design volumes used in the Su lement-EZ Form are larger than the required water quality volumes. Because of the site's -location in the Goose Creek Watershed, the VVQv is defined as the difference in stormwater runoff between the pre -development and post -development conditions for the 1 year, 24 hour storm. 11. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents. Pdfs must be uploaded using the form at: https:Hedocs.deg.nc.gov/Forms/SW Project Submittal While it is not required, it is recommended that wet pond 1 and 2 include the following design features: 1. An emergency spillway — While the wet ponds are designed to handle the 100-year storm event, a more intense storm or a malfunction in the outlet could cause embankment overtopping and the pond to fail catastrophically. 2. Safety features — In order to discourage children from playing in the wet ponds or falling from the top of the head walls, certain safety features, such as a fence or warning signs, may be helpful. Please also check with the local review authority to see if they require any safety features around the wet ponds. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to July 28, 2019, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Please reference the State assigned project number SW3190505 on all correspondence. If you need additional time to submit the information, please submit your request for a time extension to the Division at the contact below. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
