Siler City Facility, Certificate of Coverage-NCG060383 NPDES Stormwater General Permit-NCG060000 Chatham County Mr. Nelson: On August 7, 2019 a site inspection was conducted for the Mountaire Farms, Inc. facility located at the 1101 E. Third Street Facility, Chatham County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG060000, Certificate of Coverage-NCG060383. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Loves Creek, a Class C waterbody in the Cape Fear River Basin. As a result of the inspection, the facility was found to be in non compliance with the conditions of the NCGO60000 permit. We request a response to the comments within 30 days from the receipt of this document. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. Clearly there have been errors implementing the permit requiremnets concerning sample locations, and after a review of the site map with an enlarged view of the stormwater system, it appears that there should be additional sample points added that are not depicted on any maps. lncluded in the samples should be the untreated stormwater discharging off site that is being introduced into the bypass storm drain from the Hwy 64 at MJB-1. That stormwater outlets below the facility and dischrges below East Raleigh Street. The stormwater that is being treated from MJB-1 is only the first 30 minutes of a rain event, so untreated overflows into MJB-2 and into the bypass storm drain that should somehow be treated as well. A detailed investigation into exactly where all the disharge points are and where untreated stormwater is entering the system should be undertaken. Once all the discharge points have been identified and the issue with discharging untreated stormwater has been resolved a detailed report should be sent to DENR regional office.. The documents not found were provided in a follow up email. The enlarged site map that was provided at a leter date shows the new outfall and stormwater drains a patterns at a readable scale. It a ears that there are storm drains from the Processinci Oant that dischar a untreated stormwater from the processing plant that enter a main storm drain line and discharges off site.
