McDaniel Integra Land Company, LLC 1525 International Parkway, Suite 2001 Lake Mary, FL 32746 Subject Property: Integra Springs at Kellswater (formerly part of Kellswater Commons Development) STORMWATER MANAGEMENT PLAN (SMP) - Modification to BMP #1 On July 24, 2009, the Division of Water Quality (DWQ) issued a SMP APPROVAL to Mr. James Merrifield of Merrifield Partners, LLC, to satisfy a stormwater condition in the Water Quality Certification issued by the DWQ on August 11, 2008. The DWQ is aware, by way of a "declaration of protective covenants and deed restrictions" recorded in Cabarrus County on August 19, 2009, that you are the new or current owner of the portion of the original project (Drainage Zone #1) that drains to the stormwater Best Management Practices (BMP) device #I (SMPBMP # 1). Consequently, you are responsible for the maintenance of the said structure. On September 28, 2009, the Division of Water Quality DWQ received a request from Mr. Adam Nowocin, PE of N-Focus Design, Inc. for acceptance into the Express Review Program regarding a modification to the SMPBMP #1. This letter advises you that your project will be accepted into the Express Review Program once the following items are received: a. The application fee of $500.00 made payable to the North Carolina Division of Water Quality [Stormwater Management Plan (SMP) Modification fee for one (1) drainage area]; b. Two (2) complete and collated copies of the Express Review Stormwater Management Plan Application [ http://www.ncwaterquality.org/ncwetlands/documents/ExpRevSWMAppV2.pdf]; c. Two (2) collated copies of all supporting information pertaining to this project including i. Design calculations for the BMP sized for both on-site and off-site drainage, if any; ii. Most current BMP Supplement completed for the BMP including Design Summary and Required Items Check List (available at http://h2o.enr.state.ne.us/su/bmp forms.htm) along with all required items; iii. Signed and notarized Operation & Maintenance Agreements for the BMPs, also available at the above website link in c.ii. d. Proposed site grading plan showing existing and proposed contours, and delineated drainage area to the BMP; iii. Erosion and sediment control plan; iv. Detailed plan and cross sectional views of the BMP showing pertinent structures, zones, pool levels, bottom and top elevations, etc (at appropriate scales as listed in the Required Items Checklist); V. Construction sequence and planting schedule for the BMP; e. One (1) data CD of full size plans in TIFF Group 4 format (black and white, not grayscale or color). If the plans are too large to store in TIFF format, they can be stored in PDF. Please be advised that all Stormwater BMPs must be designed, at a minimum, to remove 85% TSS, in accordance with the most recent version of the NC DWQ Stormwater Best Management Practices (BMP) Manual. Please note that a pre-application meeting is scheduled for October 5, 2009 prior to the submittal of your completed application. Since this is a modification, the owner of the project is not required to be present at the pre-application meeting. The clock for this project will not start until receipt of the completed application package and required fee. If the drainage areas exceed what is indicated on the Initial Interest Form and/or the services are different you may be required to remit an additional fee.
