8. PROJECT SUMMARY:
The applicant proposes to:
• Install 128 new septic tanks,
• Insta1140,640 LF of sewage collection pipe,
• Construct a 50,000 gallon per day municipal wastewater treatment plant (WWTP), and
• Install 3,100 LF of pipe to discharge the WWTP effluent into the headwaters of the
Bayview Drive canal.
NOTE: An Environmental Assessment for the proposed development has been prepared by
Dare County and a Finding of No Significant Impact (FONSI) was issued by the North
Carolina Department of Environment and Natural Resources' Division of Water Quality on
August 25, 2006.
Project Setting
The proposed sewage collection system and WWTP will be installed in the Stumpy Point
community which is located in the southeast portion of mainland Dare County,
approximately 12 miles south of the intersection of U.S. Routes 64 and 264.

The Stumpy Point community consists of two separate areas: the Bayview Drive area and the
Lake Worth Drive area. The Bayview Drive area is bordered by Stumpy Point Bay to the
south, the Pamlico Sound to the east, and the Alligator River National Wildlife Refuge to the
north and west.
The properties in the Bayview Drive area extend north approximately 2,700 feet from the
shore of Stumpy Point Bay, across Bayview Drive, across the Bayview Drive canal, to the
Alligator River National Refuge property. The Bayview Drive canal is 20-30 feet wide and
runs in an east/west direction almost the entire length of Bayview Drive. The canal starts
near the confluence of Stumpy Point Bay and the Albemarle Sound and ends just east of the
intersection of U.S Route 264 and Bayview Drive. The canal system includes 15 small
canals/ditches that run perpendicular to Bayview Drive and the canal. Most of the small
canals/ditches are approximately 6 feet wide and are located on the boundaries of adjacent
properties, but three of the canals on the west end of Bayview Drive are approximately 15
feet wide. [NOTE: The "finger-shaped" areas of the Estuarine Shoreline AEC on the
attached maps depict the locations of these small canals/ditches.]
Vegetation along the small canals/ditches consists primarily of the Common Reed
(Phragmites australis), however the larger ditches have very small areas of Coastal Wetland
fringes containing Black Needle Rush (Juncus Roemerianus) and cattails (~pha species).
The area north of the Bayview Drive canal is a large expanse of U.S Army Corps of
Engineers Section 404 wetlands and Division of Coastal Management Coastal Wetlands.
Vegetation on the developed portions of the Bayview Drive lots is limited to indigenous
grasses and weeds. Vegetation on the undeveloped areas at the west end of Bayview Drive
is comprised primarily of pine trees (Pinus species) and scattered unidentified deciduous
trees. The understory in this area is dominated by the Common Reed (Phragmites australis),
but also contains Eastern Baccharis (Baccharis halimifolia), Wax Myrtle (Myrica cerifera),
Bayberry (Myricaceae species), Carolina bay (Persea borbonia), and various unidentified
oaks (Quercus species). Further east along Bayview Drive the deciduous trees disappear and
the pine trees become less dominant until they too disappear and the understory species
become dominant.
Elevations on the Bayview Drive lots range from zero along the shores of Stumpy Point Bay
and the Bayview Drive canal to three feet along Bayview drive. The portions of the lots
located north of Bayview Drive are in the AE (EL4) flood zone while the areas south of
Bayview Drive are located in the AE (ELS) flood zone.
The Lake Worth Drive area of Stumpy Point is located approximately 2,500 feet south of the
intersection of Bayview Drive and U.S. Route 264. This area is bordered by Stumpy Point
Bay to the east and the Alligator River National Wildlife Refuge to the north, south, and
west.

The Lake Worth area includes an emergency ferry dock utilized by the NC Department of
Transportation, fish houses, a North Carolina Forest Service facility, an abandoned house,
and a new single-family residence. The lots in the Lake Worth Drive area are located in the
AE (EL4) flood zone.
Vegetation on the developed portions of the Lake Worth area lots is limited to indigenous
grasses and weeds. Undeveloped areas are dominated by the Common Reed (Phragmites
australis), but also contain scattered Eastern Baccharis (Baccharis halimifolia), Wax Myrtle
(Myrica cerifera), and Bayberry (Myricaceae species).
The waters of Stumpy Point Bay are classified as SA and the majority of this area is open to
shellfishing, but the areas near the mouths of the Bayview Drive canal and the Lake Worth
canal are closed to shellfishing.
Project Description
The applicant proposes to replace the numerous failing septic tank systems in the Stumpy
Point community with a new sewage collection system and a 50,000-gallon per day WWTP.
Dare County proposes to construct the new WWTP on 1.66 acres of U.S Army Corps of
Engineers Section 404 wetlands located on the east side of U.S. Route 264, approximately
750 feet north of Bayview Drive. The WWTP will conduct typical screening, aeration, and
filtration of the wastewater but will also include membrane bioreactor tertiary treatment and
ultraviolet light disinfection.
Approximately 18,580 LF of sewage mains will be installed south along U.S. Route 264
between the WWTP and Lake Worth Drive and east along the entire length of Bayview
Drive. The sewage mains will be placed in two-foot wide trenches that will be installed in
existing right-of--ways.
Approximately 20,760 LF of 2-inch service pipe will be installed to connect the new sewage
mains to the 128 new septic tanks. Installation of the service pipe will require atwo-foot
wide trench be installed in previously disturbed areas. The new septic tanks will be installed
adjacent to the existing tanks, which will then be abandoned in place. The new septic tanks
will be equipped with low-pressure pumps to pump the wastewater from each residence and
business to the new WWTP.
Effluent from the WWTP will be pumped through 3,100 feet of pipe and discharged into the
headwaters of the Bayview Drive canal, approximately 2,100 feet east of the intersection of
Bayview Drive and US Route 264. The discharge pipe will be installed in a two-foot wide
trench that will cross the 30-foot buffer. The discharge pipe will have aflap-gate installed at
the end of the pipe to prevent backflow.

9. ANTICIPATED IMPACTS
It is anticipated that the proposed project will cause the following impacts:
• The construction of the WWTP will result in the filling of 72,309 SF (1.66 acres) of COE
Section 404 wetlands. No Coastal Wetland fill is proposed.
• The proposed development will not create any new impervious surface in the 75-foot
Estuarine Shoreline AEC.
• A review of available maps indicates that no archaeological resources are located on or near
the subject property.
• The proposed development will result in the disturbance of 175,917 SF (4.04 acres),
including 26,494 SF located in the 75-foot Estuarine Shoreline AEC.
• Although the proposed WWTP will discharge a maximum of 50,000 gallons per day of
treated wastewater effluent into the headwaters of the Bayview Drive canal, the water quality
of the canal will probably improve because the existing septic systems may be discharging

1. Overview
The intent of this narrative is to supplement information previously submitted to the NC
Division of Coastal Management in the form of a Consistency Certification and
Environmental Assessment. After DCM's review of the Consistency Certification, it is the
desire of DCM that the applicant request a CAMA Major Permit for the entire proposed
wastewater collection system since several sections of the proposed collection system
encroach the Estuarine AECs. The discharge effluent pipe from the proposed wastewater
treatment facilities will discharge into Bayview Drive Canal which is part of the estuarine
AEC. The proposed wastewater treatment system itself, however, does not fall within any
CAMA AECs and is therefore not subject to be permitted as part of this application.
2. Project Background
In July 2003, the Dare County Board of Commissioners authorized a sewer feasibility study
for the community of Stumpy Point in Dare County. The objective of the study was to
determine if centralized sewage collection and treatment facilities could be constructed to
service the residents of Stumpy Point and Lake Worth. The study concluded that a new
Septic Tank Effluent Pump (STEP) collection system and advanced wastewater treatment
facilities could provide a safe and reliable means of wastewater disposal for the area.
Currently, 63 straight pipes discharge untreated and partially treated wastewater to a canal
that empties into Bayview Drive Canal. Another 15 systems have failed which has raised
public health concerns in the area.
Following the feasibility study, grant applications were submitted to the NC Rural Economic
Development Center and NC Clean Water Management Trust Fund. In addition to a local
match from Dare County, the proposed collection and treatment system was funded. An
Environmental Assessment (EA) has been through SEPA review and a Finding of No
Significant Impact has been issued by the NC Division of Water Quality. The EA was
published on the Environmental Bulletin at State Clearinghouse for public review and was
cleared on October 6, 2006. Project permitting and engineering design is currently underway.
3. Project Description
The proposed project is broken into two components - a wastewater collection system and
wastewater treatment system.
Wastewater Collection
The wastewater collection system will include 128 Septic Tank Effluent Pump (STEP)
systems consisting of a septic tank, storage tank and effluent pump. Each STEP system will
discharge through a 2 inch service lateral into small diameter (2.5-6 inch) low pressure
sewage force mains that will parallel Bayview Drive, Payne Street, First Street, U.S.
Highway 264 and Log Storage Road. The force mains will merge into a single force main at
the U.S. Highway 264/Bayview Drive intersection and discharge wastewater into a new
0.050 mgd wastewater treatment facility proposed on property owned by Dare County.
All STEP systems and collection lines will be constructed in road right-of-ways and on
previously-disturbed (developed) land. No direct, adverse impacts to wetlands are expected

from implementation of the collection system. Proposed piping includes approximately
20,760 LF of 2-inch service laterals, 19,880 LF of 2.5 to 6-inch low pressure main and 3,100
LF of 6-inch WWTP effluent force main. Several areas of the collection system will
encroach on the CAMA estuarine AEC near Lake Worth and along Bayview Drive (as shown
in the 2 attached drawings). The WWTP effluent discharge pipe will also encroach on the
estuarine AEC of Lake Worth Canal at the 114 Bayview Drive address. Shown in the table
below, and on drawing no. 1 of 2, is a summary of the collection system components
proposed to be constructed in CAMA estuarine shoreline AECs:

Wastewater Treatment
After an exhaustive search, the wastewater treatment facility will be constructed in 404
jurisdictional wetlands as delineated by Spruill and Associates and confirmed with the U.S.
Army Corps of Engineers. The proposed 50,000 gpd facility will consist of screening,
aeration, filtration, disinfection and sludge stabilization/storage facilities. Treated effluent
discharged from the facility will be disposed of in Bayview Drive Canal. Sludge disposal will
be contracted to an outside party for offsite disposal.
The proposed fill area for the wastewater treatment facility has been carefully selected to
avoid encroachment into any AECs as defined by the Coastal Area Management Act. The
proposed site is greater than 75 feet from the canal paralleling Bayview Drive and outside the
two Public Water Supply AECs. Furthermore, the amount of proposed fill material and
acreage (1.66 acres) has been minimized to the practical extent possible. Select fill material
will be required to support the structures and to elevate the facilities above the 100 year wind
tide elevation of 5 feet MSL.
Mitigation proposed for wetlands disturbance activities consists of preservation of the
northernmost 17 acres of the existing 34 acre site adjacent to the Alligator River National
Wildlife Refuge. This type of onsite mitigation is desired by the County and US Fish and
Wildlife Service because it will essentially provide an undisturbed, contiguous extension of
the Wildlife Refuge. The U.S. Army Corps of Engineers has also agreed to the principle of
onsite preservation and supports the 10:1 mitigation ratio.

4. Permitting
Permitting activities are ongoing as noted below:
Environmental Assessment
Status: Complete
A FONSI for the Environmental Assessment (EA) was issued by NCDWQ for the EA in
September. The EA was processed and cleared through the State Clearinghouse in October
2006. No additional environmental documentation is required to apply for necessary permits.
US Fish & Wildlife Service Encroachment Agreement
Status: Under Review
An application requesting encroachment of US Fish & Wildlife ARNWR property along US
Highway 264 for construction of a low pressure sewer main in the NCDOT right-of-way was
submitted to the Manteo Office in September 2006. This application is currently under
review.
US Army Corps of Engineers Section 404 Individual Permit
Status: Under Review
A Section 404 Individual Permit was submitted to the USACE Washington Field Office in
August 2006 to fill 1.66 acres of wetlands necessary to construct the wastewater treatment
facilities. Public comment for the Permit is scheduled to begin the 3~d week of December
2006 for 30 days.
NCDWQ Section 401 Wetlands Certification
Status: Under Review
Concurrent with the Section 404 Individual Permit, a Section 401 Wetlands Certification was
submitted to the NCDWQ in December 2006 to fill 1.66 acres of wetlands necessary to
construct the wastewater treatment facilities.
NCDWQ NPDES Permit Application
Status: Under Review
A NPDES Permit Application was submitted to NCDWQ in October 2006. A draft NPDES
Permit has been published for 45 days of public review and comment which began December
6, 2006. If determined necessary by NCDWQ, a public hearing may be required based upon
the number of comments received. Public comment will end in late January 2007.
NCDWQ Authorization to Construct
Status: To be submitted January 2007
Once the public comment period nears closure for the NPDES Permit, engineering plans and
specifications will be submitted to NCDWQ for review and comment. After technical
comments are resolved, an Authorization to Construct (ATC) permit will be issued allowing
the County to advertise the project. This review period is expected to last from 4 to 6 months.
NCDLQ Sediment & Erosion Control Permit
Status: To be processed daring ATC Review
A Sediment and Erosion Control Permit will be required for construction of the collection
system and wastewater treatment plant. This Permit will be coordinated through the NCDLQ
during the ATC review period.

FINDING OF NO SIGNIFICANT IMPACT AND ENVIRONMENTAL ASSESSMENT
DARE COUNTY -STUMPY POINT WATER AND SEWER DISTRICT
Pursuant to the requirements of the North Cazolina Environmental Policy Act (N.C.G.S. § 113A-1, er seq.), an environmental assessment (EA) has
been prepared by Dare County for the proposed wastewater collection and vestment facilities proposed for the community of Stumpy Point. A Septic
Tani: Effluent Pump system will collect the wastewater in Stumpy Point and deliver it to a membrane bioreactor wastewater treatment plant (WWTP)
[hat would provide advanced tertiary biological treatment and accomplish disinfection by an ultraviolet light system. Biosolids generated during the
process will be aerobically stabilized, and an outside sludge handling firm will manage their disposal.
The proposed facilities will serve approximately 190 people. Currently, 63 of the l IO known septic systems are known to have straight pipe
discharges which drain to a canal that empties directly into Stumpy Point Bay or have failed. The Stumpy Point area does not have any central
wastewater collection or treatment facilities. This project will remove a significant source of fecal coliform contamination from Stumpy Point Bay,
removing a general public health threat, and may lead to the re-opening of two closed sections of the bay by the State for use as shellfish harvesting
waters.
Five alternatives were considered for the type of wastewater treatment facility for Stumpy Point: no action, a transportation alternative, an onsite
treatment and disposal alternative, a reuse alternative, a land application alternative, and a point source discharge alternative. Within the point source
discharge alternative, analyses were conducted regarding the site of the treatment facility and the site of the discharge point. The no action alternative
was rejected because this would allow at least sixty-three illegal discharges to waters of the state to continue operation, further polluting the
environment and endangering public health. The altemative of transporting Stumpy Point's wastewater to either Manteo or Engelhard was rejected
because neither town has adequate auxiliary treatment capacity to accept flow from Stumpy Point. Also, it would cost in excess of $3.81 and $2.45
million, respectively, to transport collected wastewater to these towns. The muck-type soils and limited available local land area make the onsite
treatment and disposal alternative infeasible. The reuse alternative is also not feasible in Stumpy Point because there is not a wastewater treatment
plant to provide reuse water to any potential users, and there are no water-intensive commercial or industrial operations present in the community.
Land application is not a feasible alternative for Stumpy Point because of the lack of suitable soils and the limited available land area for spray
irrigation. Upon consideration and evaluation of each alternative, a tertiary wastewater treatment plant with a point source discharge was found to be
the most viable alternative.
In its search for the best site for the proposed facilities, Dare County determined that it would be best to select a site without jurisdictional wetlands
and that is publicly-owned. It was determined that Site 1, a 34-acre parcel owned by Dare County and located just north of the Highway
264/Bayview Drive intersection best met the County's long-term needs. Dare County has 3 discharge options: I) Lake Worth Canal, 2) Wetlands on
U.S. Air Force Bombing Range Property, and 3) Bayview Drive Canal. The County determined that the Bayview Drive Canal was the most suitable
discharge location.
A Septic Tank Effluent Pump system will be installed as the collection system for the Stumpy Point community.
Construction of the new facilities at the Stumpy Point W WTP may result in temporary increases in sedimentation and erosion and noise levels in the
immediate vicinity of the construction area, as well as permanent wetlands loss. These and other direct impacts have been avoided and minimized to
the extent practicable during project planning and design. An erosion and sediment control permit will be obtained from the Division of Land
Resources, in accordance with Coasts] Area Management Act guidelines to protect estuarine areas, prior to construction. Noise levels will increase in
the immediate vicinity of the proposed WWTP site during construction, but will return to normal following completion of the project. Noise
associated with operation of the WWTP will be negligible. All waterways and canals will be crossed by directional drilling to avoid disturbing these
sensitive areas. Approximately one acre of ]and owned by Dare County intended for the WWTP will be raised for stabilization and protection from
the 100-year wind tide elevation. Al] land disturbance activities will be coordinated with the U.S. Army Corps of Engineers. To mitigate this l-acre
wetlands loss, the County will place ten acres of this ssme parcel under a conservation easement, with concurrence from the U.S. Army Corps of
Engineers. The proposed project should not result in negative long-term impacts on local land use because the collection lines will be placed in road
rights-of way and the lines and tanks that will serve each residence will be placed on previously disturbed lots. The W WTP site is expected to be
approximately one acre in size. There also will not be any significant direct negative impacts on prime or unique agricultural lands; public lands;
known areas of archaeological or historic value; or areas providing wildlife and other natural habitat. Once construction of the collection system and
WWTP is complete, the project should not have any negative impacts upon scenic and recreational areas. Also, the proposed project should not result
in the introduction of any toxic substances during either the construction or operation of the facility. The proposed project should benefit
groundwater quality, surface water quality, and shellfish and Yinfish and their habitats.
The proposed project should not result in significant secondary and cumulative impacts since the remaining vacant lots in Stumpy Point can only be
used for residential development in accordance with existing zoning regulations the Sewer Use Ordinance. All land surrounding Stumpy Point is
owned by the Federal Government and held for uses that preclude development activities.
Based on the findings of the EA, the impact avoidance/mitigation measures contained therein, and reviewed by governmental agencies, the Division
of Water Quality has concluded that the proposed project will not result in significant impacts to the environment. This EA and Finding of No
Significant Impact (FONS[) are prerequisites for the issuance of Division of Water Quality permits necessary for the project's construction. An
Environmental Impact Statement will not be prepared for this project. This FONSI completes the environmental review record, which is available for
inspection at the State Clearinghouse.
