Dear Mr. Baker:
The North Carolina Department of Transportation (NCDOT) is proposing to widen, grade
and pave SR 1347, Goshen'Road, in Macon County. This proposal entails widening and
paving the existing gravel road to a standard 18-foot roadway. The proposed
improvements of SR 1347 have been identified as necessary maintenance and safety
improvements. Funds have been allocated for this project, and NCDOT would like to
perform these activities in 2010.
I am enclosing a pipe installation detail, photographs, a marked county map and USGS
topographic map. We propose to replace and/or extend seven culverts slightly below the
existing streambed elevations where bedrock is not encountered to minimize impacts to
aquatic habitats and allow the existing stream gradients to remain as unchanged as
physically possible.
The North Carolina Natural Heritage Database was checked for records of federally
threatened and endangered species. There are no records listed for Huckleberry or
Beasley creeks. There are records for the spotfin chub (Er•imonax monachus), a federally
threatened species, and for the sickle fin redhorse (Moxostoma sp.), a federal candidate
species, in Cowee Creek, approximately four miles downstream of the project. There is a
record for the bog turtle (Glyptemys muhlenbergii) approximately two miles downstream
of the project.
The streams in the project area are relatively high gradient and smaller than the typical habitat for
the spotfin chub or sickle fin redhorse. There are no wetland areas that will be disturbed by the
project. Therefore, habitat for the listed species appears to be lacking within the project area. Best
management practices for high quality water will be used on this project and will help minimize
adverse effects to streams on and downstream of the project. Four of the streams are small and do
not appear to have sufficient flow to support fish. For these reasons, we believe this project will
have "no effect" on listed species. A small portion of this project falls within U.S. Forest Service
property and a biological assessment is being prepared for those parcels. We anticipate those
findings to also support a "no effect" determination.
Impacts to historic or cultural resources are not anticipated. If the State Historic Preservation Office
(SHPO) and the Office of State Archaeology determines that further investigations are required,
NCDOT will conduct the appropriate site investigations and obtain compliance from SHPO prior to
project construction. An archaeological and historical review will be conducted for the portion of
the project that is bordered by USFS property.
The best management practices will be used to minimize and control sedimentation and erosion at
this site. The construction foreman will review all erosion control measures daily to ensure
sedimentation and erosion is being effectively controlled. If the planned devices are not functioning
as intended, they will be immediately replaced with better devices: The rock silt screens and other
erosion control devices will be in place prior to pipe culvert construction and will remain in place
until the project is stabilized.
Impacts to Waters of the United States
Huckleberry and Beasley creeks are shown on the USGS topographic map as perennial streams.
These streams have sufficient flow to support fish including trout. The four unnamed tributaries of
Beasley Creek are small but they have well-defined channels and are shown on the topographic map
as perennial streams. The channel substrate of the streams to be effected is primarily composed of
gravel, sand and silt. Huckleberry Creek flows into Beasley Creek approximately 550 feet below
SR 1347. The unnamed tributaries flow into Beasley Creek within approximately 400 feet of the
road crossings. Beasley Creek flows into Cowee Creek approximately 0.7 miles downstream of SR
1347. Cowee Creek in turn flows into the Little Tennessee River approximately 4.1 miles
downstream from the confluence with Beasley Creek. The Little Tennessee River meets the
definition of a Traditional Navigable Water. For these reasons, we believe that Huckleberry Creek,
Beasley Creek and the unnamed tributaries of Beasley Creek are Relatively Permanent Water and
are under the jurisdiction of the U.S. Army Corps of Engineers. In order to make the needed safety
improvements to SR 1347, it will be necessary to impact waters of the United States in the Little
Tennessee River Basin. Specifically, NCDOT is requesting to replace and/or extend seven culverts.
The proposed impacts are listed below. Sites 2 and 3 are at stream crossings with no impacts
requested; therefore, the numbering of sites is not consecutive.

McHenry, Mountain Region Coordinator, of the North Carolina Wildlife Resources
Commission (NCWRC) to comment directly to you concerning the 404 Nationwide Permit request.
Also, by copy of this letter, I am requesting authorization under Section 401 of the Clean Water Act
from the North Carolina Department of Environment and Natural Resources (DENR), Division of
Water Quality (DWQ). In addition, I am asking Mr. McHenry and Ed Ingle, Roadside
Environmental Field Operations Engineer (NCDOT), to comment directly to me concerning this
permit request.
