On September 2, 2009, the Division of Water Quality (DWQ) received your application dated August 11, 2009, to impact
479 square feet of coastal wetlands, 52,000 square feet of uplands and 75,000 square feet of uplands for spoil disposal to
create an upland basin for a 58 boat slips and additional infrastructure as described in your application. The DWQ has
determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ
will require additional information in order to process your application to impact protected wetland, streams, and/or
buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to
move toward denial of your application as required by 15A NCAC 2H.0506 and 2B .0259(8) and will place this project
on hold as incomplete until we receive this additional information. Please provide the following information so that we
may continue to review your project.
Additional Information Requested:
1. In accordance with 15A NCAC 02B .0201 (b) this office requires three-dimensional flushing model and
Dissolved Oxygen (DO) model for the proposed basin. It is required that proposed water quality sampling points
for DO and other parameters be submitted to this Office for approval before data is collected and used in the
models.

Construction of the proposed marina expansion will require the restoration of a 50 foot buffer around the marina
expansion in accordance with 15A NCAC 02B .0259 (4)(5) Tar-Pamlico Buffer Rules. It is required that the
applicant receive Authorization Certification and a Buffer Restoration Plan be submitted to this Office for
approval. The Buffer Restoration Plan should completed in accordance with 15A NCAC 02B .0259 (9) Tar-
Pamlico Buffer Rules.
3. Please indicate all impervious surfaces that are proposed to be constructed such as parking lots, access roads,
marina storage, and/or other auxiliary buildings are indicated on your site plans. Please also indicate how
stormwater will be managed from areas of impervious surface at the proposed marina expansion and indicate the
points of diffuse flow through the riparian buffers on the site plans. These provision are requested in accordance
with 15A NCAC 02H. 0506(b) (2-5) and 15A NCAC 2B.0259(5).
Please respond in writing to the DWQ within four weeks of the date of this letter to with the requested information. If we
do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will
consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected
buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
