RETURN OF APPLICATION
Dear Mr. Keaton:
On August 22, 2008, the Division of Water Quality (DWQ) received your application
dated May 13, 2008, to impact 3.2 acres by dredging of residential boat canals and 1,800
square feet of shoreline stabilization. The DWQ issued you "Request for Additional
Information" letters on October 3, 2008, January 5, 2009, and August 13, 2009,
requesting a "submerged aquatic vegetation survey" (SAV survey) to be conducted
between the months of May through September. On August 26, 2009, DWQ staff
conducted a review of the proposed dredge area and found the presence of SAV, thereby
verifying the need for an SAV survey. This Office has received your request, dated
September 4, 2009, to continue to hold the subject project. As required by 15A NCAC
2H.0506 and 2B .0233(8) your application is still incomplete and since we have not
received your SAV survey we are returning your application. If you want to carry out
this proposed impact, you will need to reapply and pay the 401 Certification fee again. If
you want to reapply it will be necessary to provide the requested SAV survey.
This letter only addresses the application review and does not authorize any impacts to
wetlands, waters or protected buffers. Please be aware that any impacts requested within
your application are not authorized (at this time) by the DWQ. Please call Roberto
