i agree with your thoughts on the release schedule but do not agree (surprise!) about the service area.
granted there is some karstic topography near wilmington but this is hardly the majority of the landscape.
how about a higher ratio (2 times) for activities outside the traditional service area but still within the
ecoregion/river basin. i am convinced that we all need to be more flexible with the service areas (within
limits of course) and the Corps guidance does talk about ecoregions. again this new ecoregion map was
not available earlier. finally this may be a larger issue that needs to be addressed in a forum other than this
one for this bank. your thoughts?

During our December 10 meeting, we had discussed if Phase II would be incorporated with Phase I as an
amendment or if it would be set up under a separate MBI. In subsequent discussions with Brooke (Office of
Counsel) and reviewing the original MBI, Phase I was established with anticipation for adding adiacent land to the
bank and is reflected in Section 2.2 of the original signed MBI. Therefore, a MBI will not be required for Phase II.
However, in Sec. 2.2, it is stated that additional phases must provide a "proposed site-specific restoration plan"
which must include "specific provisions concerning credit ratios, a schedule for release of credits, financial
assurances, and property disposition." I think the biggie with Phase II will be the credit release. My thoughts on
this is not to hold them to the more stringent release of credits that the recent banks are being allocated. Reason I
say this is from the standpoint that this bank has shown a high degree of success in meeting the success criteria
(outside of having to replant an area). I'm not saying that we hold to their current request, but I think we should
consider the high probability of the success when consenting on the credit release.
Kathv and John: As far as the service area, it is my position that it remain the same. They used the EcoRegion
designation as the backbone for including New Hanover Co. in the service area. With the Karst topography of this
area, this bank being at the upper reach of the HUe, and the lengthy discussions of the previous MBRT meetings
establishing the area for Phase I, I seen no reason to extend down to Carolina Beach. It was clearly disclosed to
them of the possibility of using the bank for Wilmington impacts if warranted on a project specific basis.
Land Management has sent me a copy of the second draft of the mitigation plan (dated Feb. 03). He has informed
me that a copy will be sent to each of you. Take a look at the plan, and please provide me your comments by
March 1. At this time, I don't see any reason to hold another meeting. I'll just wait and see. Call if you have
