received August 7, 2019. However, additional information is required before the review may be completed.

rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. hi addition, any omissions made in responding to the outstanding items,
or failure to provide the additional information on or before the above requested date may result in your

A. Application (15A NCAC 02T .0105):
1. Daniel Sumerel is not an authorized signature authority per 15A NCAC 02T .0106(b). According
to the North Carolina Secretary of State records, Thomas Niederkofler is the President and Alois
Reider is the Vice President. Provide either a letter giving Daniel Sumerel signature authority or a
renewal application signed by an authorized signature authority.
2. Per Application Item II.5., provide an Operational Agreement.
3. Provide a copy of the easement as requested in Application Item IV. 1.
B. Permit Schedules:
1. The permit dated March 12, 2015 required submittal of an engineering certification for the proposed
facility modifications. Provide.
2. The permit dated March 12, 2015 required submittal of the Bylaws of Scotch Hall Preserve PUD
Development. Ensure that the bylaws meet the requirements specific in the Developer's Operations
Agreement.
C. Setbacks:
1. Verify that all irrigation fields meet the 25-foot setback to surface water diversions per 15A NCAC
02T .0506(a).
