Director Division of Water Quality October 25, 2006 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Montclair, LLC 8368 Six Forks Road, #202 Raleigh, NC 27615 Subject Property: Rosemoor Subdivision Ut to Black Creek [030404, 27-45-(2), C, NSW] REQUEST FOR MORE INFORMATION Dear Sir or Madam: DWQ Project # 06-1666 Wake County On October 19, 2006, the Division of Water Quality (DWQ) received your application dated October 18, 2006, to impact 0.2929 acres of wetland and 0.00 square feet of Zone 1 Neuse River basin protected riparian buffers and 0.00 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed residential subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please clearly indicate Zone 1 and Zone 2 buffers on the site plan. 2. Your site appears to contain wetland acreage beyond that proposed to be impacted, yet your acreage listed in Section VI. Proposed Impacts to Waters of the United States/Waters of the State, No. 3, is the same as the acreage listed in your Impact table under No. 2 of this section. Please list the total acreage of all wetland on your site. 3. Please submit level spreader worksheets and a signed and notarized Operations and Maintenance Agreements for the level spreaders. 4. Please clarify Level Spreaders No. 12's position and placement relative to rip rap dissipater at inv out at Lots Nos. 94 and 95, and also at Level Spreader No. 1 and Level Spreader No. 2. Please respond within three weeks of the date of this letter by sending this information to me in writing and Eric Kulz of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
