I, Anthony Lester, their engineer, am writing in regard to the River View Subdivision Water Quality Fond and the existing littoral shelves that lie six to twelve inches above the water level. In response to your latest letter dated September 23, 1997, Kavanagh Associates proposes the I, following plan to remedy this situation. li We propose to raise the water level in the pond 12" in order to submerge these shelves. This will be accomplished by attaching an additional band of pipe to the existing riser and thus increasing the overall height of the riser 1.0' and thus raising the water level in the pond by one foot. Careful attention will be paid to ensure that the seal between the old riser pipe and the new pipe . ? ?I; II will be watertight. Also; as a result of raising the water level one foot in the pond, we will also j raise the emergency spillway one foot in order to maintain the same storage capacity in our pond. ?f Please review this correspondence and respond as to whether this method will be acceptable. This certification carried the additional condition that littoral shelves be built around the upper edge of the pond. On November 11, 1996 Mr. Pete Colwell from this office conducted a Compliance Evaluation Inspection of the River View Subdivision. During the inspection Mr. Colwell noted that the required littoral shelves were 6 to 12 inches above the water level, grassed with fescue, and regularly mowed. On April 10, 1997 the Division of Water Quality issued an inspection report requesting that you bring your project into compliance with the 401 Water Quality Certification by either raising the water level in the pond to flood the shelf or lower the shelves to the existing pond elevation. In an August 7, 1997 letter the Division of Water Quality requested for a second time that you bring your project into compliance with the conditions of your 401 Water Quality Certification. You were further asked to provide this office with information detailing what measures you have implemented to bring your project into compliance. As of this writing, this office has still yet to receive any correspondence from you regarding these ongoing problems. On September 17, 1997 Mr. Pete Colwell and Mr. Eric Fleek from this office conducted another Compliance Evaluation Inspection at the subject subdivision. It was documented that you still have not fixed the littoral shelves in your stormwater pond. These shelves are still above the water line of the pond. In order to be compliant with Section 401 of the Clean Water Act you must ensure that these shelves be BELOW the level of water. This office recommends that you raise the level of water in the pond to flood these shelves. In addition, it was noted that a small pocket of wetlands has established itself above the upper edge of your stormwater pond. You are reminded that any impacts to this wetland will require application to the Division of Water Quality and that any impacts over 1 acre require compensatory mitigation. As you have already been authorized to impact 1.4 acres of wetlands any additional wetland impacts at this site will require mitigation at a 4:1 ratio (i.e. 4 acres mitigated for every acre impacted). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. An additional condition is that final written DEM approval for the stormwater plan must be received from DEM before construction begins. Littoral shelves shall be built around the upper edge of the pond to offset wetland losses and protect water quality. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
