After a review of your permit application materials I found that with changes to Section 7,
there is sufficient content to continue with the review and drafting of your permit.
Appendix A. BMPs and Measurable Goals for Public Involvement. BMPs for Public
Involvement and Participation Program should provide opportunities for the public to participate
in program implemenlation (i.e., volunteer program I community involvement: organize and
implement a volunteer stormwater related program designed to promote ongoing citizen
participation).
Appendix A. BMPs and Measurable Goals for Illicit Discharge Detection and
Elimination. There is no BMP for dry weather flow (i.e., implement inspection program to detect
dry weather flows at system outfalls and establish procedures for tracing the sources of illicit
discharges).

Illicit Discharge Detection and Elimination Program
Objectives
The permittee shall develop and implement a program to detect and address illicit

Storm Sewer System Information:
' 1.1 Population Served: The Town of Waxhaw has a population of 2,625 according to the 2000
U. S. Census. There is no fluctuation in population due to seasonal changes
' 1.2 Growth Rate: The Population of the Town of Waxhaw has grown from 1,294 in 1990 to
2,625 in 2002 according to the U. S. Census. The relative change in population over the ten
year period was 10.28%.
' 1.3 Jurisdictional and MS4 Service Area: The Jurisdictional service area for the Town of
Waxhaw is 2.82 Square Miles. Approximately 5 1 % of the area is residential, 14% of the
' area is commercial, 3% of the area is industrial and approximately 32% of the area is
undeveloped or open space.
' 1.4 MS4 Conveyance System: As precipitation falls on the Town of Waxhaw a very complex
process takes place. Some of the rainfall is intercepted by vegetation, some infiltrates and is
retained as soil moisture and some is retained in surface depressions. When rainfall is more
' intense that the basin's capacity to retain it, a complex process of surface and subsurface
runoff begins. Runoff begins as sheet flow across vegetated areas, woodlands or open fields
and then takes several paths to reach the receiving streams. In most undeveloped areas of the
' Town the stormwater route would begin with sheet flow to swales (grassed or unlined), then
to open ditches (lined or unlined), then to the receiving streams. The second route would
begin with sheet flow across vegetated and unvegetated areas then to improved ditches or
' curbs, then to storm drainage pipes, then to ditches (lined or unlined), then to the receiving
streams. The third possible route would be the same as method two except there would be a
stormwater detention facility between the discharge from the storm culvert discharge point
and the receiving stream.
' 1.5 Land Use Composition Estimates: The Jurisdictional service area for the Town of Waxhaw is
2.82 Square Miles. Approximately 5 1 % of the area is residential, 14% of the area is
commercial, 3% of the area is industrial and approximately 32% of the area is undeveloped
' or open space.
1.6 Estimate Methodology: The "Zoning Map" for the Town of Waxhaw dated December 6,
1 2000 was used to estimate the percentage of MS4 service area that is under residential,
commercial, industrial and open space land use. Land that was undeveloped was included in
the Open Space classification.

' 1.7 TMDL Identification: To the best of our information, knowledge and belief, the receiving
streams in the Town of Waxhaw do not have a Total Maximum Daily Load allocation set by
the Environmental protection Agency of the North Carolina Department of Environment and
' Natural Resources (NCDENR).
' 2.0 Receiving Streams
The stormwater runoff from the Town of Waxhaw discharges into the Catawba River Basin
' near the North Carolina, South Carolina State Line. Table 1 as shown below list the primary
streams that receive stormwater runoff from the MS4 jurisdictional area for the Town of
Waxhaw.

' 3.0 Existing Water Quality Programs
3.1 Local Programs: The Town of Waxhaw has a "Storm Water Design Manual" with the
intended purpose of serving as a guide for the planning and design of stormwater control
structures and systems within thejurisdiction of the Town of Waxhaw. Also, the Town has
delegated the review of sediment and erosion control plans for new development within the
Town's jurisdiction to the NCDENR. The Town has in place Ordinances that require that
any development that has more than 20,000 square feet of impervious area must provide
' stormwater detention.

3.2 The NCDENR administers plan review and permitting of land disturbing activities within the
Town's Jurisdiction.
4.0 Permitting Information:

Appendix B of this Narrative Application Supplement. A list of measurable goals and the
contact person that is responsible for implementation of each goal can be found in Appendix
A of the Narrative Application Supplement.

7.0 STORMWATER MANAGEMENT PROGRAM PLAN:
7.1 Public Education and Outreach on Stormwater Impacts: A summary of the BMP's for Public
Education and outreach on Storm Water Impacts is contained in Appendix A of this
Narrative Application Supplement.

7.1.2 Target Audience: The Town of Waxhaw has targeted school children, households,
business leaders, land developers and Town employees as the focus group for the Town's
Public Outreach Program. An awareness program at the lower grade levels will work
similar to the "Litter Bug" program of several years ago. The younger students will
become aware of the importance of the streams in their neighborhoods and will learn just
what a stormwater collection system is and what should or should not be discharged to
the stormwater drainage system. Households will be given pamphlets and other handouts
to explain the proper use of fertilizers, pesticides and the proper disposal of petroleum
products. The educational program that targets the younger school children will reinforce
this program. Information on the Town's Phase II program will be made available to the
business leaders and land developers and the Town will seek input and participation in
implementing the requirement of the Phase Il program. Town employees will be given
classes that explain the basics of the Town's stormwater system and will be trained to
took for problems such as illicit dumping of petroleum products and will know the
process for reporting such activity to the proper authority. Also, Town employees will be
drained to look for problems with the storm drainage system such as clogged drains or
erosion problems and be instructed in how to report possible problems.
7.1.3 Target Pollutant Source: The obvious targeted pollutant is sediment that results from
construction sites and from un-vegetated areas on previously developed sites. The Town
will structure its education program to address the importance of maintaining lawns and
grasses to filter pollutants from stormwater run off before the pollutants reach the
streams. Also, the Town, through is education program, will distribute brochures and
other printed materials to local business and homes that will provide information on the
proper use of fertilizers, pesticides and the proper disposal of petroleum products.
7.1.4 Outreach Program: The Town of Waxhaw will be developing an "Outreach Program"
that will have two main focuses. The first focal point will be the distribution of
pamphlets, brochures and other printed material to the households and businesses within
the Town's jurisdictional area. The second focus area will be the development of
programs to be presented to the schools in the area that describe what a water shed is and
how the water shed can be protected. The Town will develop a program that younger
school age children can participate in a "Club" with newsletters and an annual
competition for the best poster relating to watershed protection. Attempts will be made
to involve the local Cub Scout and Boy Scout Troops in this program.
7.1.5 Decision Process: The BMP Summary detailing this process can be found in Appendix A
of this Narrative Application Supplement. Mike Simpson will be the person responsible
for developing the Public Education and Outreach Program (Program) for the Town of
Waxhaw. Mr. Simpson is aware of the requirement of the Phase lI NPDES permitting
process and will develop the Program meeting the Phase 11 requirements. Mr. Simpson

will be responsible for developing or securing handout material for the various phases of
the program, developing and presenting programs to the school children, coordinating the
"Youth Club" activities, developing programs to be presented to the community and to
coordinate and obtain Town approval for all of the activities listed above.
7.2.0 Public Involvement and Participation: The Town of Waxhaw will conduct a "Public
Hearing" in accordance with the Phase lI NPDES permitting requirements. The Public
Hearing will be advertised prior to the hearing in a newspaper of general circulation
within the Town of Waxhaw's jurisdiction for a minimum period of two weeks. Copies
of the appropriate documentation of the Public Hearing will be kept by the Town and
forwarded to appropriate officials of the NPDES Phase it Permitting process when
documentation is complete.
1 7.3.0 Illicit Discharge Detection and Elimination:
I
7.3.1 BMP summary Table: A copy of the BMP Summary table is enclosed in Appendix A of
this Narrative Application Supplement.
' 7.3.2 The Town of Waxhaw will develop during the first year of the Permit a map of the
stormwater system within the Town's jurisdiction. The Town will utilize the Town
Engineer, the Town Coordinator and Town Staff to develop the system map. The Map
should be available for review and use during the second year of the Permit. The Town
will; through the Town Engineer, Town Coordinator and Town Staff; collect information
on the major receiving streams within the Town's jurisdiction. Potential sources of
information are USGS Maps, FEMA Flood Plain Maps and NCDENR stream monitoring
and database available through the Internet.
' 7.3.3 Regulatory Mechanism: The Town of Waxhaw does not have an illicit dumping
ordinance at this time. The Town will develop an illicit dumping ordinance and have it in
place during the third year of the Pen -nit. The Town will coordinate the development of
' this proposed ordinance with Union County and with the City of Charlotte to make an
effort to see that the proposed ordinance meets the Phase II permit requirement and is
compatible with County ordinances and with ordinances in adjacent jurisdictions.
1 7.3.4 Enforcement: In developing the proposed ordinance for illicit dumping the Town will
include a section of the ordinance setting penalties for violation of the proposed
ordinance that are consistent with the remedies prescribed by Law for violation of a
Town Ordinance. The Town Coordinator will conduct classes with Town Staff,
including the Police Department, to educate them as to the requirements of the proposed
' Ordinance and the procedures to be followed in a violation of the Proposed ordinance is
discovered. The Town can impose fines, withhold certificates of occupancy, obtain

injunctions and utilize other remedies offered by the Judicial System of the State of North
Carolinas to prosecute violates of the Town's Ordinances,
7.3.5 Detection and Elimination:
7.3.5.1 Procedures for Locating Priority Areas: The Town of Waxhaw will use a combination of
visual inspections and selective sampling to detect and eliminate illicit dumping in the
Town's stormwater system. The Town will, through sampling and visual inspection
determine if pollutants are present in the significant receiving streams within the Town's
jurisdiction. After the initial sampling and visual inspection phase if any significant
receiving streams exhibit concentrations of pollutants, additional testing and inspections
will be conducted to locate the source of the problem and take whatever steps necessary
to eliminate or significantly reduce the magnitude of the problem. The Town
Coordinator will be responsible for administering the testing and inspection program. He
will be responsible for the training of Town Staff in the detection of problems such as
"gray water" oil sheens and other signs of pollution. The Town Staff will be trained in
the proper procedure for reporting potential problem areas to the appropriate authorities.
Also, the Town Coordinate will maintain contact with personnel responsible for
monitoring of the Catawba River Basin and develop lines of communication for sharing
of information regarding significant receiving stream quality outside of the Town's
jurisdiction and the Town Coordinator will utilize this information in the detection and
elimination of illicit discharges.
7.3.5.2 Procedures for Tracing the Source of Illicit Discharge: If the Town of Waxhaw
determines in the Town's initial sampling and visual observation process that there is a
significant stream with illicit discharge, the Town will initial a program to identify the
source of the discharges. The Town will divide the receiving stream into reaches and
sub -reaches and begin a sampling program to narrow down the area of interest. Once the
probable area of discharge is identified, the Town Staff will begin visual observations of
the target area and, with additional sampling, should be able to identify the source of the
discharge. The Town will then contact the violator and explain the significance of the
illicit discharge and seek the cooperation of the violator in eliminating the discharge. If
the desired result is not achieved, the Town will enforce the Illicit Discharge Ordinance,
obtain assistance from NCDENR or seek remedies through the court system. Also, the
Town's Public Outreach Program will be utilized to notify the participants of potential
problems and seek the public's help in identification and elimination of illicit discharges.
7.3.5.3 Procedure for Removing the Illicit Discharge: If the Town of Waxhaw discovers an illicit
discharge, the Town will then contact the violator and explain the significance of the
illicit discharge and seek the cooperation of the violator in eliminating the discharge. If
the desired result is not achieved, the Town will enforce the Illicit Discharge Ordinance,
obtain assistance from NCDENR and/or seek remedies through the court system.

7.3.5.4 Procedures for Evaluation of the Plan: The Town Coordinator will monitor test results
from stream sampling over the five year Permit period. If the results of the sampling
indicate that stream quality has improved or there was no further degradation of the
stream then the program will have accomplished its objectives.
7.3.6 Nan-Stormwater Discharges: At this time the Town of Waxhaw has not identified any
non-stormwater discharges that are contributing pollutants to the Town's stormwater
system. If during the sampling described in 7.3.5 above it is found that there are non-
stormwater discharges to the Town's stormwater system that are introducing pollutants
into the Stormwater system, the Town will amend its proposed Illicit Discharge
Ordinance to cover the specific pollutants discovered.
7.3.7 Occasional Incidental non-stormwater discharges: At this Time the Town of Waxhaw
has not identified any occasional incidental non-stormwater discharge that are significant
sources of pollutants to the Town's Stormwater system. . If during the sampling
described in 7.3.5 above it is found that there are occasional incidental non-stormwater
discharges to the Town's stormwater system that are introducing pollutants into the
Stormwater system, the Town will amend its proposed Illicit Discharge Ordinance to
cover the specific pollutants discovered.
7.3.8 Outreach: The Town of Waxhaw will be developing and "Outreach Program" that will
distribute pamphlets, brochures and other printed material to the households and
businesses within the Town's jurisdictional area. These brochures and pamphlets will
explain the importance of the stormwater system to the ecosystem and how illicit
discharge of pollutants to the stormwater system can disturb or destroy the ecosystem of
the streams that receives the stormwater discharge. The brochures will present
information on the Town's efforts to reduce pollutants form their Town's vehicle parking
areas and the Town's efforts to train its personnel in the proper use of fertilizers,
petrochemicals and other pollutants.
7.3.9 Decision Process: The BMP Summary detailing this process can be found in Appendix A
of this Narrative Application Supplement. Mike Simpson will be the person responsible
for developing the Public Education and Outreach Program (Program) for the Town of
Waxhaw. Mr. Simpson is aware of the requirement of the Phase I1 NPDES permitting
process and will develop the Program meeting the Phase II requirements. Mr. Simpson
will be responsible for developing or securing handout material for the various phases of
the program, developing and presenting programs to be presented to the community and
to coordinate and obtain Town approval for all of the'activities listed above.
7.4.0 Construction Site Stormwater Runoff Control:
7.4.1 The BMP Summary detailing this process can be found in Appendix A of this Narrative
Application Supplement. The Town has delegated the permitting of "Construction Site
Stormwater Runoff Control" to the North Carolina Department of Environment and
Natural Resources (NCDENR).
7.4.2 Regulatory Mechanism: The Town of Waxhaw has delegated Regulation of
' "Construction Site Stormwater Runoff Control" to NCDENR. There is no legal
agreement between the Town and NCDENR for this service provided by NCDENR.
' 7.4.3 Plan Review: The Town of Waxhaw has delegated flan Review relating to
"Construction Site Stormwater Runoff Control" to NCDENR. There is no legal

NCDENR. Any violations will be reported to NCDENR for enforcement.
7.5.0 Post -Construction Storm Water Management in New Development and
Redevelopment: The Town of Waxhaw does not have a "Post -Construction Storm
Water Management Program" in place at this time. The program will be developed
during the second year of the Permit. Development of the Program will be the
responsibility of the Town Coordinator, Mike Simpson.
7.6.0 Pollution Prevention/Good Housekeeping for Municipal Operations: The Town of
' Waxhaw does not have a Pollution Prevention/Good Housekeeping Plan for Municipal
Operations in place at this time. The program will be developed during the first year of

1 A RESOLUTION
AUTHORIZING THE SIGNING AND DELEGATION OF AUTHORITY
FOR
' NPDES PERMIT APPLICATION
' Whereas, the Board of Commissioners of the Town of Waxhaw, North Carolina, find that in
executing the requirement for the NPDES Phase 11 Permit the Commission approves the signing
' of the Permit Application by the Mayor and further more authorizes the appointment of Mike
Simpson to serve as Town Coordinator for the NPDES Permit Program.
' WHEREAS, the Federal, and State governments have required local governments to complete
and implement a Storm Water permit.
' WHEREAS, the implementation of the Permit will be an ongoing project.
NOW THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Town of
' Waxhaw, the Town Coordinator is authorized to assume the responsibilities of development,
implementation, maintenance of programs required by the Phase II NPDES Permit.
