The Application provides adequate assurance that the discharge of fill material into the waters of Bolin Creek in conjunction with the proposed development in Orange County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). 2. Woody vegetation shall be planted on 3 foot centers along the streambank to reduce erosion. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the U.S. Army Corps of Engineers. Plans submitted with the application show the placement of approximately 2,100 cubic yards of dredged and fill material into Bolin Creek and adjacent wetlands to construct the Bolin Creek Greenway Phase 2 and to decrease base flood elevations onsite. The proposed bicycle/pedestrian greenway trail will start at the east end of the existing trail just west of Village Green Condominiums on Elizabeth Drive. It will go approximately 4,410 feet east, generally along Bolin Creek, under the bridge at Franklin Street, to the Estes Park/Chapel Hill Community Center on Estes Drive. The proposed asphalt/concrete trail requires the filling of six separate floodplain wetland pockets, ranging from 1,160 square feet (sf) to 4,875 sf. in area, for a total of 0.29 acre (12,895 sf). The impacted areas are either hardwood wetlands or emergent marsh that have been heavily disturbed, or in some cases created, by human impact in the floodplain, including sewerlines. The proposed channel realignment involves excavation of a new channel and filling of 365 linear feet of existing channel just west of Franklin Street. This realignment is necessary to allow the proposed trail to continue east from just east of the Village Green Condominiums to the bridge at Franklin Street, without crossing Bolin Creek. Crossings of Bolin Creek were determined by the applicant to be not feasible because of the resulting increase instorm flood levels. A greenway corridor along the south side of the existing creek is not practicable because of the steep topography immediately adjacent to the creek at Franklin Street. A new channel will be excavated in a nonwetland area within 50 feet of the existing channel, and the existing stream channel would be filled to accommodate the greenway, impacting an additional 0.11 acres (4,792 sf) of waters of the U.S. The new stream channel will consist of a retaining wall on one side of the channel, the other side to be stabilized using bio-engineering practices to include riprap, plantings of native herbaceous and tree species, and rock jetties to promote low flow meanders. The proposed realignment includes design intended to create 0.42 acre (18,300 sf) of new wetlands to replace wetlands impacted by the proposal. Five distinct zones of wetland vegetation are proposed to be created on one side of the new channel using bio-engineering techniques. Native plantings will initially stabilize the mitigation area and will be supplemented over time by natural growth patterns. -2- The purpose of the work is to allow construction of a propose greenway trail and to improve flood conditions. The applicant has considered and evaluated practicable alternatives to the proposed work, including elevated walkways across wetland pockets, minor re-alignment of the greenway, and bridging of Bolin Creek. Overall plans showing the proposed construction are included with this public notice. Additional detailed plans may be reviewed at the U.S. Army Corps of Engineers Regulatory Field Office at 6512 Falls of Neuse Road, Suite 105, Raleigh, North Carolina 27615-6846, or at the offices of the North Carolina Division of Environmental Management address shown below. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer is not aware, based on available information, that the activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if ? M 1 -3- the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State, and local agencies and officials; Indian Tribes, and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition, or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Further, the consultant proposed (offered) to construct a berm in order to detain water runoff from Franklin Steet. (Note: I did not request this mitigation) This proposed mitigation will occur outside of jurisdictional wetlands This structure should enhance water quality through reduction of storm event hydrography, nutrient and sediment removal. A condition of this mitigation should include - water discharging through the check-dam of the constructed detention area should not be diverted away from the existing wetlands that already receive this runoff. Creek Channel A 365 foot long section of Bolin Creek is proposed to be moved. The consultant adequately communicated the greenway positioning difficulty with respect to why they needed to move the stream channel. -The topography on South side of the creek near Franklin Street does not provide sufficient room to skirt the creek with a path. -FEMA will not allow building of a structure (bridges) that impedes flow during high flow conditions (Bolin Creek routinely floods its banks). -Orange Water and Sewer Authority (AWSA) will not allow a bridge to be position on top of the sewer line easement. . -Note: there are certain other building constraints that correspond to the grant for the Greenway. The Urban setting of this stream, evidence of scour, and overbank flooding indicates dramatic astatic conditions of this drainage. I do not believe moving the stream course will result in significant impact to surface waters in this instance. Please note: With regard to restoration of the stream bank, there are some problems with the plant species proposed (lets talk). Included within this application is a request to fill 12,895 square feet or 0.29 acres of mixed forest bottomland wetlands and a request to realign and channelize a 365-foot long section of Bolin Creek (which will impact an additional 0.11 acres or 4,792 square feet of wetlands adjacent to the stream channel) in order to construct the bicycle facility. Channelization of the stream channel is necessary because other methods of con- struction have proven to be unfeasible. Channelization will benefit the flow of flood waters in this portion of Bolin Creek. The Town will disturb a total of 0.40 acres of jurisdictional wetlands to complete the project. The Town will use soil bio-engineering and BMP methods to re-establish the stream channel, mitigating and restoring 0.42 acres of jurisdictional wetlands. The following materials will serve to define the Town's intentions, clarify the alternatives to channelization that were investigated and illustrate the project parameters. The Phase 2 project will serve to extend a popular and heavily used bicycle and pedestrian transportation route from the end of Phase 1 at Elizabeth Street to the Chapel Hill Community Center. The project involves constructing an estimated 4,410 lineal feet of asphalt and concrete bikeway. In order to facilitate the construction of this bicycle facility project, several isolated pockets of native and man-made wetlands will need to be filled. Additionally, an estimated 365 lineal feet of the Bolin Creek stream channel will need to be realigned and straightened to enable bikeway devel- opment. Bolin Creek Greenway 404 Permit Application Page 4 Filling Wetland Pockets Several isolated "jurisdicitional wetland" pockets exist along the proposed route of the bikeway project. These wetland pockets range in size from 1,160 to 4,875 square feet. The total acerage of the pocket wetlands to be impacted by bikeway development is equal to 12,895 square feet or .29 acres. All of these "wetlands" were created by human activity and bisect the proposed align- ment of the bikeway. They are either drainage ditches that carry stormwater from adjacent streets or parking lots to the Bolin Creek Channel, or perched water that has resulted from previous construction activity in the Bolin Creek floodplain. Because of this, the applicant proposes to install culverts and fill these "wetland" pockets in order to facilitate cost effective bikeway construction. Alternatives to Culverts and Filling The applicant has given consideration to spanning each of the "wetland" pockets with board- walks in order to avoid or minimize impact to these wetlands. The applicant has decided against the use of boardwalks for the following reasons: 1) because the project is a bicycle facility, the applicant has determined that a frequent change of materials (ie. from asphalt to wood) poses a hazard to cyclists. Wood becomes slippery and create a hazardous surface for cycling especially when it is close to the ground, as would be the case with boardwalks spanning the wetlands in question, addi- tionally some filling in the floodplain would be necessary to elevate the boardwalks; 2) the majority of the pocket wetlands are generally very low quality environments, mostly filled with trash, sedi- ment, oil and other toxic chemicals that has washed from adjacent streets and parking lots; 3) the cost of installing boardwalks is significantly higher than the cost of installing culverts and fill mate- rials. The applicant concludes that the use of culverts and filling does not appreciably degrade the existing "wetlands" beyond that of the existing conditions. Further, the applicant will miti- gate on a one-for-one basis the loss of the total acerage of wetlands disturbed by construction of the bikeway. The applicant will also be installing additional vegetation to improve habitat for wildlife. Minor re-alignment of the trail through this area to avoid or minimize impact to these wetlands has been thoroughly explored by the Applicant. Minor re-alignment would not lessen the impact, major re-alignment would and has already been considered (please refer to Alternatives to Bikeway Development Explored on page 7 of this Application). Pocket Wetlands: Site by Site Evaluation A more complete description of each pocket wetland site is provided in the following text and in the drawings numbered 3 thru 8 on the following pages. However, the design team prepared a HEC-2 Flood Analysis Study of the proposed crossings and found that the proposed stream crossings would in fact increase the water surface elevations for a 100-year storm event within the FEMA regulatory floodway. Since the project lies within the Town of Chapel Hill's Resource Conservation District, the Town mandates that such crossings must be accomplished with "no-rise" of the current floodway elevations. Therefore, the original proposal to span the creek was not feasible. Alternative crossings of the stream at sites up-stream from the original location were examined and also determined to be infeasible due to the same constraints found at the original location. The most feasible and cost effective solution was determined to be a re-alignment of the Bolin Creek Stream Channel. (See Drawing No. 9 "Bridging Option") To accomplish this re-alignment the existing stream channel will be straightened, and a new channel dug immediately adjacent to the existing channel. A portion of the bikeway would then be located within the approximate location of the old stream bed. A versa-lok retaining wall would be installed on the bikeway side of the new channel to provide a stable area for bikeway construction. The opposite side of the stream channel will be re-established using soil bio-engineering techniques. Primarily, native vegetation will be planted using a live stake, live fascine, live cribwall and joint planting techniques. All of these techniques have been proven through out the United States to be effective alternatives to rip rap or otherwise armoring a modified stream channel. The soil bio- engineering will serve to restore the disturbed stream environment within a year of channelization. It will also serve to improve the habitat for aquatic and terrestrial wildlife. O r O c •v a •- a r 75 CL m a Alternatives to Bikeway Development Explored For the past 4 years the Applicant has worked closely and arduously with local residents, adjacent property owners, elected officials and town staff to determine the precise bikeway route location illustrated on the enclosed drawings. The applicant has examined 7 alternatives to the bikeway development scenario presented in this application to the one illustrated within this applica- tion. These scenarios include: No Development Option A No-Development Option was considered by the applicant and deemed infeasible because of the Town's long standing committment to its community wide greenway system, and the vital alter- native transportation function that the project supports. The project supports an alternative transpor- tation route for cyclists and pedestrians that was envisioned more than a decade ago, and which the Applicant has steadily worked to develop. This is the only route of direct access to important desti- nations (shopping mall, community center, commercial areas, etc.) in this area of the community. The bikeway can not be dead-ended as this would not fulfill an important transportation need of the community. Four Alternative Routing Options Four different routes for the bikeway were considered during the initial master planning phase of the project, begun in 1992. The Applicant worked with adjacent property owners to define the most feasible route for bikeway facility development. The four routing options are included within Drawings No. 10 to 13 on the following pages. Option 1 would have made use of the existing sanitary sewer line with two span bridges over Bolin Creek. Adjacent property owners vehemently objected to this option as being too close to residential homes. The bridges would also have been infeasible due to restrictions in the Floodplain. Option 2, later selected as the preferred Option, optimizes property owned by the Applicant and places furthest away from adjacent residential homes. Option 3, explored using the north side of Bolin Creek and crossing the creek once with a bridge. The north side of the creek was deemed infeasible for bikeway routing because it is more environmentally pristine and sensitive than the south side of the creek which has been more thor- oughly degraded over time by construction activities. Option 4 would have placed the trail directly adjacent to the creek throughout most of the project length. This was deemed infeasible due to severe environmental constraints. The preferred Option, essentially Option 2, was found to be the most feasible compromise to all persons who participated in the 2 year master planning process and was approved by the Chapel Hill Town Council as the route for the bikeway. Installing Bridges Bridges installed at different locations instead of re-aligning the Bolin Creek Stream Channel. This proved infeasible due to flooplain restrictions within the Resource Conservation District. Specifically, the Applicant hired an engineer to perform a flood study on the installation of two bridges and installation of only one bridge. Both options were found to increase the base flood elevation of Bolin Creek -- unacceptable to the Applicant's RCD and Foodplain management pro- gram. The Town also examined purchasing upland property and routing the bikeway route outside Bolin Creek Greenway 404 Permit Application Page 8 of the floodplain to avoid re-aligning the stream channel. The property in close proximity to the proposed re-alignment consists of fill and debris of unknown origin. The cost of property acquisi- tion and the potential development of the bikeway over the fill material was deemed to be too costly. On-Road Routing On-road routing was also considered, however the steep grade of Elizabeth Street and the heavy automobile traffic on Franklin Street makes this option infeasibile for the vast majority of users who would be served by the bikeway facility. On-road routing would eliminate use of the facility by children, the elderly and disabled persons -- the primary beneficiaries of bikeway development. The Applicant employed an engineer to evaluate the relation- ship of flooding to re-channelization. The engineer determined that "rechannelization will decrease base flood elevations up to .37 feet" throughout the project study area. Drawing No. 14 illustrates the existing channel and the re-located channel, the proposed bikeway and a versa-lok retaining wall. The applicant estimates that an additional .11 acres or 4,792 square feet of wetlands adjacent to the stream channel would be disturbed during construction of the new channel. Drawing 15 illustrates the location of cross sections that were prepared by the engi- neer in designing the channelization. Drawings 16 to 18 illustrate the cross sections. Drawing 19 illustrates the proposed restoration of the stream channel and mitigation plan for the total wetlands disturbed by the project. The applicant proposes to restore and mitigate .42 acres (18,300 square feet) of wetlands adjacent to the Bolin Creek channel. This will include using 1) soil bio-engineer- ing techniques to restore the north bank of the stream channel; 2) small rock jetties to promote a meander of the creek during low flows and promote aquatic habitat within the re-located stream channel; 3) installation of native grasses, legumes, shrubs and trees to promote wildlife habitat; 4) stream channel construction techniques that will promote the growth of wetland vegetation native to the Bolin Creek stream channel. Drawings 20 thru 23 illustrate the different types of wetland areas that will be created and the vegetation that will be installed in these areas. The applicant proposes to create .42 acres of new wetlands that closely match the existing wetlands found adjacent to the Bolin Creek stream channel. The applicant will recreate five (5) distinctive zones: a) a swamp forest zone; b) shrub zone; c) emergent plant zone; d) floating plant zone; and e) submerged plant zone. The applicant will create these zones through the use of soil- bio-engineering techniques, illustrated in Drawings 20 thru 23. The majority of these new zones will occur through construction of the new channel, this will be supplemented over time by the maturing and natural growth patterns within the new channel. While this newly created wetland does not replace or directly mitigate the pocket wetland sites defined earlier in this application, it does restore and mitigate the damage caused by channelization and adds higher quality wetlands to the Bolin Creek stream channel/floodplain environment. These wetland pockets range in size from 1,160 to 4,875 square feet. The total acerage of the pocket wetlands to be impacted by bikeway development is equal to 12.895 square feet or .29 acres. All of these "wetlands" were created by human activity and bisect the proposed align- ment of the bikeway. They are either drainage ditches that carry stormwater from adjacent streets or parking lots to the Bolin Creek Channel, or perched water that has resulted from previous construction activity in the Bolin Creek floodplain. Because of this, the applicant proposes to install culverts and fill these "wetland" pockets in order to facilitate cost effective bikeway construction. Alternatives to Culverts and Filling The applicant has given consideration to spanning each of the "wetland" pockets with board- walks in order to avoid or minimize impact to these wetlands. The applicant has decided against the use of boardwalks for the following reasons: 1) because the project is a bicvcle facility, the applicant has determined that a frequent change of materials (ie. from asphalt to wood) poses a hazard to cyclists. Wood becomes slippery and create a hazardous surface for cycling especially when it is close to the ground, as would be the case with boardwalks spanning the wetlands in question, addi- tionally some filling in the floodplain would be necessary to elevate the boardwalks; 2) the majority of the pocket wetlands are generally very low quality environments, mostly filled with trash, sedi- ment, oil and other toxic chemicals that has washed from adjacent streets and parking lots; 3) the cost of installing boardwalks is significantly higher than the cost of installing culverts and fill mate- rials. The applicant concludes that the use of culverts and filling does not appreciably degrade the existing "wetlands" beyond that of the existing conditions. Further, the applicant will miti- gate on a one-for-one basis the loss of the total acerage of wetlands disturbed by construction of the bikeway. The applicant will also be installing additional vegetation to improve habitat for wildlife. Minor re-alignment of the trail through this area to avoid or minimize impact to these wetlands has been thoroughly explored by the Applicant. Minor re-alignment would not lessen the impact, major re-alignment would and has alreadNr been considered (please refer to Alternatives to Bikeway Development Explored on page 7 of this Application). Pocket Wetlands: Site by Site Evaluation A more complete description of each pocket wetland site is provided in the following text and in the drawings numbered 3 thru S on the following pages. See Drawing ?No. 3 for the location of all pocket wetlands within the project area. SITE # 1: An intermittent stream bed that originates from Franklin Street stormwater discharge. This site also begins the boundarv of the Riverine Svstem, which is Seasonally Flooded. Approximate size of area affected by greenway development = 4,875 square feet. Dominant vegetation surrounding this site includes: Platanus occidentalis (Sycamore), Acer rubrum (Red maple), Liriodendron tulipifera (Tulip poplar). Soils classification is Chewlaca loam with mixed fill and debris from adjacent land use. SCS Soil Survey was used to confirm identification. Soil probe to 12-inches and Munsell charts determined: IOYR 4/4, dark brown, yellow, brown, mottled, with concretions. The soil mass was contaminated with debris, oils and other foreign matter carried by stormwater flow. The soil mass was saturated at the surface. (NOTE: Slope above this area extensively degraded by refuse dumping and possible veterinary chemical residues.) (See Drawing No. 4) SITE # 2 AND # 3: These sites are located within an existing sewer line corridor, Due to recent sewer line construction, the soil mass has been disturbed and compacted. As a result, water is perched on top of the soil mass, and a emergent wetland is evident. Approximate size of these two areas that will be affected by bik=eway development = 1175 sq. ft. (#3) & 1,740 sq. ft. (#4). Dominant vegetation includes: Acer rubrum (Red maple), Liquidambar styraciflua (Sweetgum), Liriodendron tulipifera (Tulip poplar), Quercus rubra (Red oak), Festuca spp. (Fescue grasses), Juncus effusus (Soft rush). Soils are mixed due to sewer construction. A soil probe to 6-inches (could not penetrate further) revealed a l 0YR 6./4 yellow. brown. grey mottled mass with concretions. Water was standing throughout both sites. (See Drawing No. 5) SITE # 4: An intermittent stream bed that carries stormwater from a Village Green Condominium parking area to the Bolin Creel: stream channel. The approximate size of the area affected by bikeway development = 1,160 square feet. Dominant vegetation includes: Acer rubrum (Red maple), Carva ovata (Shagbark hickory), Celtis occidentalis (Hackberry), Liriodendron tulipifera (Tulip poplar), Juglans nigra (Black Walnut), Quercus rubra (Red oak), Aesculus pavia (Buckeye), Carpinus caroliniana (Ironwood), Padus serotina (Black cherry), Vitis rotundifolia (Muscadine grape), Podophyllum peltatum (Mayapple), Ligustrum sinese (Privet). Lycopodium obsurum (Running cedar), Smilax rotundifolia (Greenbrier). Soils are slightly mixed in this area, however, the dominant type is Chewlaca loam. Standing water was the condition at Site # 6 due to downstream blockage from trashirefuse/ Bolin Creei, Greenwav 404 Permit Application Paoe 0 J Re-aligning Bolin Creek Stream Channel Originally, the Bolin Creek Greenway bikeway was proposed to span over Bolin Creek with two prefabricated cor-ten steel bridges -- as was accomplished in Phase I. However, the design team prepared a HEC-2 Flood Analysis Study of the proposed crossings and found that the proposed stream crossings would in fact increase the water surface elevations for a 100-year storm event within the FEMA regulatory floodway. Since the project lies within the Town of Chapel Hill's Resource Conservation District, the Town mandates that such crossings must be accomplished with "no-rise" of the current floodway elevations. Therefore, the original proposal to span the creel: was not feasible. Alternative crossings of the stream at sites up-stream from the original location were examined and also determined to be infeasible due to the same constraints found at the original location. The most feasible and cost effective solution was determined to be a re-alignment of the Bolin Creek Stream Channel. (See. Drawing No. 9 "Bridging Option") To accomplish this re-alignment the existing stream channel will be straightened, and a new channel dug immediately adjacent to the existing channel. A portion of the bikeway would then be located within the approximate location of the old stream, bed. A versa-lok retaining wall would be installed on the bikeway side of the new channel to provide a stable area for bikeway construction. The opposite side of the streams channel will be re-established using soil bio-engineering techniques. Primarily, native vegetation will be planted using a live stake, live fascine, live cribwall and joint planting techniques. All of these techniques have been proven through out the united States to be effective alternatives to rip rap or otherwise armoring a modified stream channel. The soil bio- engineering will serve to restore the disturbed stream environment within a year of channelization. It will also serve to improve the habitat for aquatic and terrestrial wildlife. Bolin Creek Grecmvav 404 Permit Application Page AIternatives to Bikeway Development Explored For the past 4 years the Applicant has worked closely and arduously with local residents, adjacent property owners, elected officials and town staff to determine the precise bikeway route location illustrated on the enclosed drawings. The applicant has examined 7 alternatives to the bikeway development scenario presented in this application to the one illustrated within this applica- tion. These scenarios include: No Development Option A No-Development Option was considered by the applicant and deemed infeasible because of the Town's long standing committment to its community wide greenway system, and the vital alter- native transportation function that the project supports. The project supports an alternative transpor- tation route for cyclists and pedestrians that was envisioned more than a decade ago, and which the Applicant has steadily worked to develop. This is the only route of direct access to important desti- nations (shopping mall, community center, commercial areas, etc.) in this area of the community. The bikeway can not be dead-ended as this would not fulfill an important transportation need of the community. Four Alternative Routing Options Four different routes for the bikeway were considered during the initial master planning phase of the project, begun in 1992. The Applicant worked with adjacent property owners to define the most feasible route for bikeway facility development. The four routing options are included within Drawings No. 10 to 13 on the following pages. Option 1 would have made use of the existing sanitary sewer line with two span bridges over Bolin Creek. Adjacent property owners vehemently objected to this option as being too close to residential homes. The bridges would also have been infeasible due to restrictions in the Floodplain. Option 2, later selected as the preferred Option, optimizes property owned by the Applicant and places furthest away from adjacent residential homes. Option 3, explored using the north side of Bolin Creek and crossing the creek once with a bridge. The north side of the creek was deemed infeasible for bikeway routing because it is more environmentally pristine and sensitive than the south side of the creek which has been more thor- oughly degraded over time by construction activities. Option 4 would have placed the trail directly adjacent to the creek throughout most of the project length. This was deemed infeasible due to severe environmental constraints. The preferred Option. essentially Option =, was found to be the most feasible compromise to all persons who participated in the 2 year master planning process and was approved by the Chapel Hill Town Council as the. route for the bikeway. Installing Bridges Bridges installed at different locations instead of re-aligning the Bolin Creek Stream Channel. This proved infeasible due to flooplain restrictions within the Resource Conservation District. Specifically, the Applicant hired an engineer to perform a flood study on the installation of two bridges and installation of only one bridge. The property in close proximity to the proposed re-alignment consists of fill and debris of unknown origin. The cost of property acquisi- tion and the potential development of the bikeway over the fill material was deemed to be too costly. On-Road Routing On-road routing was also considered, however the steep grade of Elizabeth Street and the heavy automobile traffic on Franklin Street makes this option infeasibile for the vast majority of users who would be served by the bikeway facility. On-road routing would eliminate use of the facility by children, the elderly and disabled persons -- the primary beneficiaries of bike,?vaN- development. Bolin Creel; GrecnN i\ 404 Permit Application Page 9 Creek Channelizati©n/Wetland Nfitibati©n The following drawings (No. 14 thru 22) illustrate the proposed re-channelization of Bolin Creek to permit bikeway construction. The Applicant employed an engineer to evaluate the relation- ship of flooding to re-channelization. The engineer determined that "rechannelization will decrease base flood elevations up to .37 feet" throughout the project study area. Drawing No. 14 illustrates the existing channel and the re-located channel, the proposed bikeway and a versa-lok retaining wall. The applicant estimates that an additional .11 acres or 4,792 square feet of wetlands adjacent to the stream channel would be disturbed during construction of the new channel. Drawing 15 illustrates the location of cross sections that were prepared by the engi- neer in designing the channelization. Drawings 16 to 18 illustrate the cross sections. Drawing 19 illustrates the proposed restoration of the stream channel and mitigation plan for the total wetlands disturbed by the project. The applicant proposes to restore and mitigate .42 acres (18,300 square feet) of wetlands adjacent to the Boffin Creek channel. This will include using 1) soil bioengineer- ing techniques to restore the north bank of the stream channel; 2) small rock jetties to promote a meander of the creek during low flows and promote aquatic habitat within the re-located stream channel; 3) installation of native grasses, legumes, shrubs and trees to promote wildlife habitat; 4) stream channel construction techniques that will promote the growth of wetland vegetation native to the Bolin Creek stream channel. Drawings 20 thru 23 illustrate the different types of wetland areas that will be created and the vegetation that will be installed in these areas. The applicant proposes to create .42 acres of new wetlands that closely match the existing wetlands found adjacent to the Bolin Creek stream channel. The applicant will recreate five (5) distinctive zones: a) a swamp forest zone; b) shrub zone; c) emergent plant zone; d) floating plant zone; and e) submerged plant zone. The applicant will create these zones through the use of soil- bio-engineering techniques, illustrated in Drawings 20 thru 23. The majority of these new zones will occur through construction of the new channel, this will be supplemented over time by the maturing and natural growth patterns within the new channel. While this newh, created wetland does not replace or directly mitigate the pocket wetland sites defined earlier in this application, it does restore and mitigate the damage caused by channelization and adds higher quality wetlands to the Bolin Creel: stream channel/floodpiain environment. BAR 41996 Mr. Chuck Flink 121 Edinburgh South, Suite 210 Cary, North Carolina 27511-6451 Dear Mr. Flink: On October 26, 1995, you applied, on behalf of the Town of Chapel Hill, for authorization from this office in the form of a Department of the Army permit for your proposal to construct the Bolin Creek Greenway Phase 2 trail and realign a portion of Bolin Creek, involving the discharge of dredged or fill material into waters of the United States, including wetlands, within and adjacent to Bolin Creek, in Chapel Hill, Orange County, North Carolina. As I discussed with you by telephone on November 8, 1995, additional information will be required to continue processing of your application, as follows: 1. Are the properties on the north side of Bolin Creek included on the list of affected property owners? 2. Additional information on alternatives to the proposed jurisdictional waters/wetlands impacts must be submitted before we can make a permit decision. Specifically, you must provide information on the following alternatives, that avoid or minimize impacts: a. Elevated walkways and/or minor realignment of the trail where it impacts the "wetland pockets". b. Specific alternative crossings of the stream that were examined, and the reasons they were rejected. Alternative routing options, including using the north side of the creek, the disturbed areas on the sewerline, or partial use of local roads. Indicate specific reasons that these are not practicable. e. Bridging of Bolin Creek to avoid realignment. Provide specific information about the floodplain restrictions that made this infeasible. 3. Provide plan views of each wetland crossing showing the specific wetland delineation and the impact area. 4. Clarify the acreages discussed in the application: a. 4410 vs. 4400 linear feet of trail. b. 0.36 vs. 0.37 acres of wetland impact c. 0.3 acre waters - 40' wide channel X 320' long? d. 0.42 acre restor. "jur. w/1" 5. Fully explain the acreages and functions of the mitigated/restored wetlands, and how they replace the impacted areas. How do you know the areas will be "wetland"? 6. The latitude and longitude, or UTM coordinates, at each end of the trail should be provided. 7. Does the purpose of the proposed channel realignment include flood improvements? 7 -3- Drawings: 8. The drawing at Page 11, showing a plan view of the proposed channel modification, does not clearly show the location of the existing channel. The drawing should include the name of the creek, direction of flow, dimensions of the proposed work, including the length, area, and acreage of the proposed channel relocation, and north arrow, and should be to scale and include a graphic scale. The drawing may be more clear if the topographic lines are removed and the existing and proposed tops-of-bank are shown. 9. The general configuration of the relocation on Sheet 4 of 5 does not match Page 11. 10. New sheets which are submitted should include a title block of each sheet should identify the proposed work and contain the name of the body of water, name of the county and state, name of the applicant, number of sheets in set, and the date the plans were prepared. The cross-section views should be redone to include title blocks. A 1-inch margin should be left at the top edge of each sheet for purposes of reproduction and binding. A 1/2-inch margin should be left on the three other edges. 11. A graphic scale should be used and indicated. Is the scale (1" = 501) on shts. 3-5/5 correct?
