appropriateness of including the Town of Mocksville in the Phase II Stormwater program at this
time.
Please review the attached letter and accept this request to remove the Town of Mocksville
from Phase II consideration and confirm its removal in writing.

Dear Christine:
The North Carolina Division of Water Quality has nominated the Town of Mocksville and
its planning jurisdiction into the Phase II Stormwater program because of aquatic water
quality impairment to Bear Creek measured at its confluence to the South Yadkin River.
Aquatic stream samples were taken below the Town's Bear Creek wastewater
treatment plant and many years prior to the elimination of that discharge. The treatment
facility was deactivated approximately two years ago and the discharge eliminated.
Tributary to the treatment facility was Ingersoll Rand, a categorical metal finishing plant.
There appears to be substantial disagreement between biological indices measuring
degree of impairment and samples indicating impairment seem to all have been taken
prior to the elimination of the wastewater discharge. It is, therefore, unreasonable to
classify the creek as impaired based on conflicting and outdated information.
The Town of Mocksville should be removed from consideration as a Phase 11 community
until adequate, relevant and current data is obtained. It is our understanding that the
Environmental Sciences Section is planning to resample Bear Creek in the spring or
summer of 2011.
We recommend that the Town and all affected parties request removal of Mocksville
from the list of candidates for consideration as a Phase II community at this time.
Please request a written response from the Division of Water Quality documenting the
final resolution of your concerns.
