Box 429 Kings Mountain, North Carolina 28086 Subject: NPDES Phase 13 Stormwater Program State Designation Process Town of Kings Mountain, Cleveland County Dear Mayor Murphy: Pursuant to Session Law 2006-246, Section 5, the Environmental Management Commission (EMC) at their regularly schedule meeting on May 10, 2007, considered the designation of the Town of Kings Mountain as a regulated public entity that owns or operates a municipal separate storm sewer system (MS4) subject to the National Pollution Discharge Elimination System (NPDES). Following proper deliberation in accordance with the procedures delineated in Session Law 2006-246, Section 5, the EMC determined that the Town of Kings Mountain shall be designated as a regulated public entity that owns or operates a MS4 subject to the NPDES requirements. Under the provisions of Session Law 2006-246, Section 5, Designation of Regulated Entities, Kings Mountain was identified as a candidate for potential designation because it has a population more than 10,000 and a population density of 1,000 people per square mile, based on data extracted from the State Demographer's website (http://demog.state.nc.us . In February, Kings Mountain was notified that it,, had been identified for consideration under the state designation procedures. Public notice of potential designation was given and comments on potential designation were accepted through April 30, 2007. After review of the public comment, the EMC determined that Kings Mountain met the required criteria for formal designation under Section 5(i)(d)(4) of the Session Law because Kings Mountain's MS4 discharges storn.water that adversely impacts water quality resulting in the impaired waters of Crowders Creek. An Equal Opportunity Affirmative Action Employer As a regulated public entity under the NPDES stonnwater program, the Town of Kings Mountain is required to develop a stormwater management program and apply for a stormwater permit. The deadline for submitting your application for a Phase II NPDES permit for stormwater management is I8 months from the date of receipt of this notification. Application and certification documents, as well as additional information on the NPDES program, are available for download at our web site.
