Dear Mayor Thunberg:
Pursuant to Session Law 2006-246, Section 5, the Environmental Management Commission
(EMC) at their regularly schedule meeting on May 10, 2007, considered the designation of the Town of
Mooresville as a regulated public entity that owns or operates a municipal separate storm sewer system
(MS4) subject to the National Pollution Discharge Elimination System (NPDES). Following proper
deliberation in accordance with the procedures delineated in Session Law 2006-246, Section 5,,the EMC
determined that the Town of Mooresville shall be designated as a regulated public entity that owns or
operates a MS4 subject to the NPDES requirements.
Under the provisions of Session Law 2006-246, Section 5, Designation of Regulated Entities,
Town of Mooresville was identified as a candidate for potential designation because it has town has a
population of more than 10,000 and a population density of 1,000 people per square mile or more, based
on data extracted from the State Demographer's website (http://demo�4.state.nc.us). In February,
Mooresville was notified that it had been identified for consideration under the state designation
procedures. Public notice of potential designation was given and comments on potential designation
were accepted through April 30,-2007.
After review of the public comment, the EMC determined that Mooresville met the required
criteria for formal designation under Section 5(1)(d)(4) of the Session Law because Mooresville's actual
population growth rate that exceeds 1.3 times the State population growth rate for the previous 10 years
and Mooresville's MS4 discharges stormwater that adversely impacts water quality resulting in the
impaired waters of Dye Creek.

As a regulated public entity under the NPDES stormwater prograrn, the Town of Mooresville is
required to -develop a stormwater management program and apply for a storrnwater permit. The deadline
for submitting your application for a Phase If NPDES permit for stormwater management is IS months
from the date of receipt of this notification.
