The attached map shows property owned by Cabarrus County and related
governmental units. It also shows the corporate limits of the three municipalities
in the County affected by Phase 11 storm water regulation — Concord, Kannapolis
and Harrisburg. The hatching on the map is the urbanized area as defined by
Census data. As you will note, there are no County owned properties that fall
outside of a corporate limit, but within the urbanized area. Based on this, it is my
understanding that Cabarrus County is not required to submit a Phase II Storm
Water application.
I would very much appreciate it if you could review this information and provide a
written response confirming that we do not need to complete the Phase 11
application. If you need additional information, please do not hesitate to contact

I assume that the first item of business is for us to identify all properties owned by Cabarrus County ,
and our subdivision Cabarrus County Schools, that are in the unincorporated urbanized area and send
you a letter indicating our need to comply with Phase II. The follow up to that would be our application
or co -application if it is agreeable with the City of Concord as they have been the lead agency in this
area for application and compliance. If this is incorrect or there are actions that I need to take please let
me know.
I appreciate your willingness to meet with the stakeholder group yesterday. It was more helpful than any
hearing or meeting I have attended to date.

In 1990 the U.S. Environmental Protection Agency's (E-PA) Phase I stonnwater program was promulgated under the
Clean Water Act. Phase I relies on National Pollutant discharge Elimination System (NPDES) permit coverage to

serving populations of 100.000 or greater, (2) construction activity disturbing 5 acres of land or greater, and (3) ten
categories of industrial activity. The NPDES Stormwater Phase Il Final Rule was promulgated in December 1999 and is
the next step in ETA's effort to preserve, protect, and improve the Nation's water resources from polluted storm water
runoff. The Phase 11 program expands the Phase I program by requiring additional operators of MS4s in urbanized areas
and operators or small construction sites, through the use of NPDES permits, to implement programs and practices to
control stormwaler runoff. Phase II is intended to further reduce adverse impacts to water duality and aquatic habitat by
instituting the use of controls on the unregulated sources of Stormwater discharges that have the greatest likelihood of
causing continued environmental degradation.
The NPDES Stormwater Phase 11 Final Rule requires nationwide coverage of all operators of small MS4s that are
located within the boundaries or a Bureau of the Census defined "urbanized area" based on the latest decennial Census.
We are writing to you to remind you that Cabarrus County has been identified as being located within it census
designated urbanized area in both the 1990 and 2000 decennial census. As it regulated community, you are required to
develop,a stormwater management program and apply for stormwaler permit coverage, if you own and operate a small
MS4 or file a certification that Cabarrus County does not own or operate a small MS4. The deadline for submitting your
application package or non -ownership certification is March 10, 2003. Application and certification documents, as well
as additional information on the NPDES stormwaler program, are available for download at our web site . Our web
