PROJECT SUMMARY: The applicant is proposing one slip with a boatlift to an existing pier and platform. William Teague 1403 Oglesby Rd. Page 02 9. Narrative Description: The William Teague property is located at 1403 Oglesby Rd. in Morehead City, Carteret County. The property is west and adjacent to 1405 Oglesby Road. The site is found by turning north off of Hwy. 70 East onto N. 20th Street. Follow N. 20th Street for a half a mile and Oglesby Rd. will be directly on the right. The site lies on the northern side of Calico Creek in this area. The subject property is 31,405 square feet in its entirety and averages 2.1' in elevation above NHW. The high ground portion of the site is undeveloped with the existing lawn, scrub bushes and oaks. Along the shoreline of Calico Creek is a 74' area of Coastal Marsh that contains Salt Meadow Grass (Spartina patens), Smooth Cordgrass (Spartina alterniflora), Glasswort (Salicornia ssp) and Spike Grass (Distichlis spicata). There are significant oyster beds throughout this area of Calico Creek. Currently the existing platform is located outside of the existing oyster beds with the proposed boatlift also located outside of the existing oyster bed area. The water depths are at an average of 0 inches to -6 inches at NLW in this area with an average daily tidal range of 2.5'. The shoreline has a total length along the NHW contour of 100ft. There is a single-family home to the east with a private dock and a vacant lot to the west with private dock. The Division of Water Quality classifies this area as SC and HQW waters. This area is a Primary Nursery Area and is not open to the taking of shellfish. The proposed lift would be located 300' west of where the primary nursery area begins. Calico Creek is approximately 1,170' wide at the project site. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential/Conservation within the AEC's. Substrate composition is mostly silt. 10. Proiect Description: The applicant proposes to construct one slip with a boatlift. The new slip/lift area would be located on the west side of the existing platform. The proposed lift would measure 12.5' x 13.2' for a 21' open runabout and consist of straps rather than a cradle. The applicant is also proposing a limit switch or "stops" which they feel would prevent the use of the lift at NLW and help protect the creek bed from damage. To further control or limit impacts, the applicant has also secured an agreement with the subdivision to subject all lots which border the PNA to be restricted to boat type, draft length and power restrictions if granted a permit with boatlifts. They would be recorded and would pass to any successor lot owner. The water depths around the new slip/lift area range from - 0" to -6" NLW. Calico Creek is 1,170' wide in this area with the existing pier and platform extending a length of 189' from the edge of the marsh and a total length of 242' from NHW. The new boatlift would be installed such as not to extend farther than the existing platform area. Riparian lines are drawn 90° from William Teague 1403 Oglesby Rd Page 03 the channel and appear to coincide with aerial photography and the plat dated received 9/8/09 showing the channel configuration. The proposed lift would terminate 315' landward from the edge of calico creek channel. All of the proposed work would meet the 15' minimum setback from the riparian corridors. 11. Anticipated Impacts: The proposed installation of the new boatlift would result in temporary turbidity. The effects from the shallow water depths at NLW with egress and ingress have the potential to cause excavation through prop wash kicking. The project would incorporate 169ft2 of open water. There should be no hazard to navigation resulting from this project, as the proposed work is located 320' landward of the existing channel edge. No coastal marsh or oyster rock would be filled or excavated during this project. The proposal is for the development of one slip with boatlift located within a primary nursery area. The applicant has also proposed as added protection strict regulations of boat size type etc. through the s/d HOA and covenants for properties that border the PNA. These would be enacted per the applicant if any boatlifts are granted and would transfer with the property. The development proposed within the AEC, meets most of the requirements of 7H.0208 specific use standards for piers, platforms, boatlift design and location. However this proposal is inconsistent with the general and specific use standards found in 15A NCAC 7H.0208 (a)(2) (B) which addresses site location for projects and 15A NCAC 7H.0208 (b) (1) which states that navigation channels, canals, and boat basins shall be aligned or located so as to avoid primary nursery areas. Due to the lack of water at NLW in this area any permanent mooring has the potential to cause significant excavation through prop wash kicking. This would be considered new excavation which is not allowed within primary nursery areas per 15A NCAC 7H.0208 (b) (1). Even though the applicant has proposed restrictions through the HOA for the s/d there are no governing rules to regulate this. Therefore I recommend the project be denied as proposed. Date Project Name William and Katherine Teague Applica/ t Name plicant Signature PROJECT DESCRIPTION William and Katherine Teague Crab Point Bay Lot #2 (1403 Oglesby Road) Morehead City, NC Carteret County We propose to create one boat slip for personal use by installing a boatlift at an existing pier located on our lot. A general CAMA permit previously authorized construction of our pier. The project site is located at the mouth of Calico Creek and is bordered on both sides by residential property. Normal water levels in the area of the proposed lift measure <6" - >3'6" (normal water level >2'). The proposed boatlift measures 13.2' X 12.5' and, subject to recommendation and approval, will consist of a strap (rather than a cradle) with plans to include a limit switch or "stops" to prevent use of the lift at low tide and hopefully prevent any possible damage to the creek bottom. No floating components are proposed for the pier or lift. Again, subject to recommendation and approval, a regular cradle with physical stops could be utilized as shown in the attached picture (lift and "stops" approved and utilized in PNA in Wilmington area that has less than 2' of water depth at normal low water level). The proposed boatlift has been located to avoid shellfish beds and coastal vegetation. There are no visible shellfish at the proposed location. The lift will be accessed directly from the center of Calico Creek without traveling over areas of shellfish or vegetation. A bottom map of this area of Calico Creek provided by the NC Division of Marine Fisheries (DMF) shows no vegetation or shellfish in the area of the proposed boatlift or in the center of the creek. A color copy of the DMF map and a shellfish density table are included with this application. A survey performed for the planning and permitting process identified the location of oyster beds at the site. The locations of the surveyed oyster beds are consistent with the information contained on the DMF bottom map. As shown on project plans, existing shell bottom is located landward of the location of the proposed boatlift and resulting boat traffic. Coastal wetlands are located on the waterfront portion of the property. The waterward extent of the wetlands is also behind and away from boat traffic that would result from the proposed boatlift. Additionally, to further control/limit potential adverse effects on aquatic life in the proposed area, we have secured agreement from our subdivision's neighbors (we live in a private subdivision, Crab Point Bay, that has registered restrictive covenants that provide required guidelines for certain building activities) to, subject to approval of this lift permit, amend and register our restrictive covenants such that any boatlifts built on lots that front a PNA will have boat type, draft, length, and power restrictions (example: Bay boat, 9" draft, single engine outboard, and powered not greater than specified by manufacturer).
