9. SITE DESCRIPTION:
For detailed information on current site conditions and site specific characteristics, please refer to the most
recent Field Investigation Report (FIR) for NNP IV Cape Fear River, LLC, prepared by Jason Dail and
circulated on 6/19/2007.
The waters of the Cape Fear River (in the vicinity of the project) are classified SC, by the N.C. Division of
Water Quality. The area IS designated as a Primary Nursery Area, by the N.C. Division of Marine
Fisheries and these waters are CLOSED to the harvesting of shellfish. The Wilmington-New Hanover
County Land Use Plan classifies the area as Conservation.
CAMA Major Permit #92-07 authorized a 4-slip docking facility, crabbing pier with gazebo and a section
of boardwalk along the waterfront in the marina village. Subsequently, a minor modification was issued on
March 3, 2009, and authorized the re-alignment of both piers, directional bore for utilities, and for the
relocation of a section of boardwalk. Until now, the permittee has not requested any additional
modification or refinements.
PROPOSED PROJECT:
The applicant is proposing to construct a residential docking facility, commercial dry stack marina, loading
platform, transient dock, boatlifts (72), observation piers w/ platforms (2), kayak/skull launch, boardwalks,
utilities and infrastructure, on and adjacent to the subject property. The proposal to develop the property as
requested constitutes Phase I of the overall site development. A rudimentary master plan has been
provided, and shows the layout of the subdivision; however, only the items being applied for are included
in the application package. No additional high ground work, outside of what is being proposed in
conjunction with the dry stack facility, is being included in this request.
According to the application package, the applicant proposes to construct a one-hundred twelve (112) slip
community boating facility with 467 linear feet of temporary side-to dockage (potentially creating 18
additional slips), a 20' x 40' kayak/skull launch, an 84-slip commercial dry stack storage facility with a
282 linear foot section of side-to dockage, two crabbing piers with observation platforms, seventy-two
boatlifts and a riverfront boardwalk. The applicant states that the 112 permanent wet slips would provide
water access for the residents of "Riverlights", as would the 467 linear foot section of side-to dockage. If
all of the wet slips are accounted for, using 25 linear feet of dockage as a potential slip, then the total
number of residential docking spaces would total 130. In addition to the residential docking structure, the
applicant states that the skull/kayak launch and observation pier would be for the exclusive use of the
Riverlights residents as well as for the use of the UNCW crew team. As proposed, the marina facility and
associated amenities would not be open to the general public.
To prevent confusion, and to eliminate the need to cover every proposed span of dockage, please refer to
sheets 3-6 of 14 for a detailed depiction of the proposed docking system, including the skull launch,
boatlifts and observation piers/platforms.
The applicant states the residential portion of the docking facility would be separated from the commercial
aspect by a secure gate, which would be located along the main "dock spine". The gate would prohibit
commercial access beyond the commercial side-to dockage. Approximately 273 linear feet (potentially 10
wet slips) of side-to dockage would be associated with the commercial marina facility as would a 15' x
329' fork lift pier and 28' x 44' fork lift drop pad. The fork lift pier would span a 70' section of Coastal
Wetlands prior to terminating at the fork lift drop pad. Approximately 1,080 sq. ft. of vibrant Smooth
Marsh Cordgrass and Black Needle Rush would be impacted as a result of the fork lift pier construction.
As stated, handrails would be placed on the landward side of the dock spines to prevent possible dockage.

It should be noted that a 121,000 sq. ft. area of open water would be eliminated by the construction of the
previously permitted 4-slip pier and/or the requested fork lift pier. Approximately 2.7 acres of open water
area would be enclosed and deemed unusable by the general public, or those wishing to access the area
using a powerboat. There is sufficient water (approximately 1'-3' at Normal Low Water) in the enclosed
area and access should not be eliminated. Please note the writer is requesting that the fork lift pier, or 4-slip
pier, be elevated a minimum of 6-8' above the elevation of Normal High Water to allow safe passage to
and from this area. The request is stated in the Recommendation Section of the Field Investigation Report.
Access to the residential marina facility, skull launch and observation piers would be provided via a
mulched driveway and wooden boardwalk. Please refer to the attached plans (sheets 3-6 of 14) for a
detailed view of the proposed boardwalk. Please note that the boardwalk is not being proposed over and
areas of Coastal Wetlands, nor does the boardwalk extend waterward of the Normal High Water (NHW)
line.
The proposed high ground dry storage building (130' x 160' x 40') would house up to eighty-four (84)
vessels and would be located approximately 300' landward of the NHW line. Parking for the facility has
been proposed on the western and eastern sides of the dry stack building, outside of both the Conservation
Overlay District (COD) and the 75' Estuarine Shoreline AEC. A concrete fork lift lane would extend from
the west side of the building and would terminate landward of the 30' buffer. From that point, a wooden
fork lift pier would extend towards the Cape Fear River. Water depths in the vicinity of the proposed
docking structures and fork lift platform range from -2.5' to -6.0', relative to Normal Low Water (NLW).
Please note that the water depths in the vicinity of the folk lift drop zone range from -2.0` to -3.0' at NLW,
resulting in shallow bottom impacts (due to constant disturbance from fork lift).
Very little information has been provided in this application package that details the activities occurring
outside of the 75' AEC. However, an agreement document between NNP and the City of Wilmington has
been prepared and submitted to the City for review and a FONSI has been approved by State Clearing
House. Furthermore, there appears to be impacts to "404" wetlands as a result of the dry storage facility
construction and adjacent development. No Nationwide permits, or other approval indicators, were
attached with the information included in the CAMA permit application. Lastly, it is not known whether or
not the applicant has received approval from the Land Quality Section, Public Water Section, Division of
Water Quality non-discharge unit, New Hanover County Zoning, etc. Again, the applicant has provided
adequate information regarding development proposed within the 75' AEC; however, any and all
additional development located landward of the AEC remains uncertain. I recommend that each agency
carefully reviews the documentation provided to ensure that the proposed development is consistent with
all local, State and Federal Laws, Regulations and Codes.

10. ANTICIPATED IlVIPACTS:
Construction of the subdivision, as proposed, would result in the disturbance of approximately 101 acres of
high ground. The proposed docking systems would incorporate approximately 38,471 sq. ft. of open water
and public trust area. Approximately 0.001 % of impervious coverage (that associated with the dry stack
storage phase of this project) would be located within the 75' AEC. Approximately 121,000 sq. ft. of
public trust water would be eliminated as a result of the construction of the proposed fork lift pier.
Additional high ground impacts are uncertain due to the limited amount of knowledge known to the writer.

Major Modification to CAMA Permit # 92-07

This Major Modification proposes a 112 slip community boating facility with 467 linear
feet of temporary tie-up, a kayak/skull launching dock, a dry storage facility with 84 slip
storage capacity and approximately 282 linear feet of temporary tie-up dockage, two
crabbing docks and a riverfront boardwalk. Although there are only 112 permanent wet
slips available for ownership for residents of RiverLights, there are a total of 467 linear
feet of side-to temporary dockage available along the outermost t-docks (attenuators), etc
that could numerically represent an additional 8 slips. The community boating facility,
therefore, has the potential to accommodate 120 slips. Again, only 112 pennant wet slips
will be available for ownership. RiverLights will be a mixed-use community. All
features of the marina will be private use for residents and guests of RiverLights with the
exception of the dry storage facility, which will be commercial use. Individuals who are
not residents of River Lights will have the opportunity to purchase/lease a dry storage slip
and access the temporary dockage along the waterfront. A gate will be located on the
dock structure to separate the commercial use dry storage facility from the private use
community boating facility. This gate will be locked during daily use but will be
accessible to emergency responders. There will be approximately 282 linear feet of
temporary tie-up dockage which will offer a temporary staging area for the dry storage
facility. The kayak/skull launching dock will be available to residents of the RiverLights
and will also be open to the crew team at the University of North Carolina Wilmington.
The two additional crabbing docks will remain private use by the residents of RiverLights
and will be accessed by a mulch/gravel drive. The marina facility and associated
amenities will not be open for general public use. The site is located adjacent to the Cape
Fear River, New Hanover County, North Carolina. Phase IA is included as upland
development associated with the project.
CAMA Permit # 92-07 authorized a 4-slip docking facility, a crabbing pier with a
covered gazebo, and boardwalks along the waterfront in the Marina Village site. A
Minor Modification was submitted in January 2008 requesting changes to the alignment
of both piers and boardwalks to reflect the current plans as shown in the Environmental
Assessment. Also requested with the Minor Modification was authorization for
directional bores for utilities under Barnards Creek and Mott Creek. Approval for this
Minor Modification was received from DCM on 3 March 2009.
The RiverLights development has been annexed by the City of Wilmington and a
development agreement was entered into on 10 June 2009. Approximately 184.7-ac
within the development, including the Marina Village, are zoned MX-CD. The
remaining 1,155.6-ac, including Phase IA, are zoned R7-CD.
Waters of the Cape Fear River in the vicinity of the subject property are classified as SC
by DWQ and DMF has classified the marshes and bottom areas as Primary Nursery Area
(PNA). All floating structures will be located in a minimum depth of -2' Mean Low
Water (MLW). The federally maintained Cape Fear River channel is over

of the proposed project. Several small undeveloped islands exist between the federally
maintained navigation channel and the subject property. Jason Dail verified the coastal
wetland line in the field with Greg Finch from LMG in July 2007 as part of the CAMA
Express Permitting; however, the primary focus was in the marina village. The coastal
wetlands to the south (in the vicinity of the 2 crabbing docks) were delineated by LMG in
July 2007 but this line has not been verified by DCM staff.
The marina facility will provide water access and low impact recreational opportunities to
residents of the RiverLights community and also to individuals outside of the community
who choose to lease/purchase dry storage slips. The community marina facility received
a "Finding of No Significant Impact" on 2 June 2008. Stormwater permits for the Marina
Village and Phase IA have been obtained. The Sedimentation and Erosion control plan
has not been finalized. RiverLights will be serviced by the Cape Fear Public Utility
Authority. The pumpout facility located at the marina will tie into the community
sanitary services.

CAMA Major Permit 92-07, see Sheet 2). The building dimensions are 160'x 130' with an elevation of 40'. The facility will
accommodate 84 vessels. Haul out services will be supplied and will access the water via Pier 1 (see Sheet 2). Temporary
tie-up will be located at Dock 1 and Dock 2 (see Sheet 2). A locked gate will be located on Dock 2 to separate the
commercial dry storage temporary tie-up from the residential use wet slips and tie-ups.
