Dear Dr. Robbins:
Reference your April 2, 1996 application, submitted on your behalf by
Ogden Environmental and Engineering, for Department of the Army (DA)
authorization to culvert approximately 450 linear feet of Boone Creek with a 4
barrel, 10 foot by 10 foot reinforced concrete box culvert, on the Appalachian
State University campus adjacent to the Rivers Street and U.S. 321
intersection, in Boone, Watauga County, North Carolina. The purpose for the
project is to accomodate the future NCDOT widening of U.S. 321 and facilitate
the construction of the Appalachian Convocation Center multi-purpose facility.
As a result of the project, approximately 0.32 acre of headwater stream
channel will be impacted. No wetlands will be impacted. This project has
been coordinated with the NC Wildlife Resources Commission (WRC).
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked. All the nationwide permits are scheduled to be modified,
reissued or revoked prior to 21 January 1997. It is incumbent upon you to
remain informed of changes to the nationwide permits. We will issue a public
notice announcing the changes when they occur. Furthermore, if you commence
or are under contract to commence this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation to complete the activity under the present
terms and conditions of this nationwide permit.

You have our approval to place fill material in 0.31 acres of wetlands or waters for the purpose of
constructing a convention center at Appalachian State University Campus, as you described in your
application dated 8 April 1996 with a clarification sent from your engineering consultant dated 3 July 1996.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is
issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Dear Mr. Dorney:
This letter is a follow-up as per your request to our June 28, 1996 telephone conversation
regarding the above referenced project. The information for this project was submitted to your
office via an April 8, 1996 letter from Scott Bryant of Ogden Environmental. The attachment to
that letter was a Joint Form Application for Section 404 Nationwide Permit (Nationwide Permit
#26). As detailed in the application, the impact to the waters of the US is less than one-third of
an acre and no wetlands are affected by the proposed project. The total area of impact of 0.31
acres was determined by using a typical bank-to-bank top of channel width of approximately 30
feet. Based on discussions with both the US Army Corps of Engineers and NC DEM, the
calculation for computing the area of impact seeks to use the width at the level of ordinary high
water. The width at the level of ordinary high water will thus be less than 30 feet. Therefore,
the computed area of 0.31 acres represents a very conservative and absolute maximum value.
Since the area of impact was less than one-third of an acre, written approval from NC DEM with
regards to 401 water quality certification was not required. However, we did respectfully request
your written concur-rence as per Section 401 General Certi- ication #2671. In response to our
application, you forwarded a May 16, 1996 letter to Dr. Clyde Robbins of Appalachian State
University indicating that the US Army Corps of Engineers in Asheville was likely to add the
impact from this project (0.31 acres) to the impact (0.22 acres) from the ASU steam plant
modifications. This would have then required 401 water quality certification for the proposed
Convocation Center. However, based on a June 27, 1996 telephone conversation with Mr. Bob
Johnson of the Corps of Engineers' Asheville office, he stated that the Corps could authorize the
stream restoration activities related to the steam plant modifications under Nationwide Permit #18.
The activities for the Convocation Center will be authorized under Nationwide Permit #26.
Therefore, the Corps is regarding the two project activities as separate and distinct In so doing,
the Corps will not add the two areas of impact together to arrive at a new "total" a?ea of impact.

Based on the above assessment, the area of impact to waters of the US for the Convocation Center
will be less than one-third of an acre. Thus, written approval from NC DEM for 401 water
quality certification is not required. However, we again respectfully request your written
concurrence as per Section 401 General Certification #2671. We respectfully request that this
correspondence be forwarded to the Corps of Engineers at your earliest convenience.
Thank you for your cooperation and assistance in resolving the above permitting issues. If you
have any questions or require additional information or clarification, please give me a call.

On 8 April 1996 you wrote to the Division of Environmental Management (DEM) requesting a 401
Water Quality Certification for your project to fill wetlands for burial of a portion of Boone Creek to
construct the Convocation Center at ASU in Boone in Watauga County. We believe that this project is
currently under review by the State Clearinghouse. DEM cannot issue the 401 Certification until the project
has received a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) from the State
Clearinghouse in accordance with NCAC 15A: 01C.0402. Therefore, I must hereby place this project on
indefinite hold until the State Clearinghouse has issued the FONSI or ROD. However we will continue to
review the project and make you aware of any concerns. We recommend that you notify us that the
NEPA/SEPA process is complete so we can reactivate the project. In addition, by copy of this letter, I am
also notifying the U.S. Army Corps of Engineers that this project should be placed on hold.
According to Mr. Bob Johnson of the U.S. Army Corps of Engineers in Asheville, the impact from
this project (0.31 acres) is likely to be added to the impact (0.22 acres) to Boone Creek for the ASU steam
plant modifications since these projects impact the same stream. Mr. Johnson informs me that the COE has
approved the other impacts (0.22 acres) which we have placed on hold until the EA/FONSI process is
complete (please seemy letter of 18 March 1996 to Dr. Robbins). With respect to the Convocation
since a 401 Certification will be required and additional impervious
stormwater management will be needed before DEM can grant this

Dear Ms. Baggett:
Appalachian State University (ASU) is planning to construct a convocation center facility just
below existing Lackey Field where university tennis courts currently exist. The proposed
construction site lies in the 100-year floodplain of Boone Creek just above the existing
intersection of Highway 321 and Rivers Street. Ogden Environmental and Engineering Services
Co., Inc. (Ogden) of Greensboro, North Carolina, has been retained to prepare the Environmental
Assessment (EA) for the convocation center construction in accordance with the requirements of
the North Carolina Environmental Policy Act (NCEPA), General Statutes 113A-1 through 113A-
12.1 Ogden submits this Scoping Notice on behalf of ASU and the design team as the first step
in the process to prepare the EA for the convocation center construction.
The purpose of this Scoping Notice is to notify interested parties and State agencies of the
convocation center construction and to solicit information and comments concerning relevant
environmental issues, structures, or features related to the construction. This Scoping Notice is
submitted to the State Clearinghouse for publication in the North Carolina Environmental
Bulletin and distribution to interested parties and State agencies. The Scoping Notice makes
public the investigation of all environmental issues associated with this project. All information
and comments received during the 30 working day review period will be considered when
preparing the EA.
SCOPE OF STUDY
This Scoping Notice includes a discussion of the project description, the need for the project, and
the general approach to the EA. Topics which will be covered in the EA include potential
impacts to land use; air quality; water quality; wetlands; floodplains; fish and wildlife including
protected, game, and nongame species; fish and wildlife habitats; archaeological and historic
sites; noise levels; waste generation; infrastructure; storm water management and flood control;
recreational facilities; and the Town of Boone. This Scoping Notice includes a discussion of
those areas that apparently are not impacted as a result of the convocation center construction
and those that are proposed for further study (which will be addressed in the final EA).
' ASU has retained the architectural, engineering, and planning firm of Hakan Corley Redfoot Zack, Inc.,
of Chapel Hill, North Carolina as the primary designer for the project. Ogden was retained to perform the
environmental consulting and engineering services required for the convocation center construction.

The project discussed in this Scoping Notice is the construction of the Appalachian Convocation
Center. Construction activities associated with two adjacent projects will also affect the subject
site. These activities will be conducted prior to, or in conjunction with, the convocation center
construction. A planned "natural mountain stream" restoration area just upstream from the
convocation center site includes the realignment of Rivers Street with US 321 (BloNving Rock
Road); this is part of the ASU Phase 2 boiler plant replacement project which is currently in
design phase. The EA submitted for the boiler plant replacement assessed the impact of creating
the natural mountain stream area by restoring an underground culverted portion of Boone Creek.
Another project is the widening of Highway 321 adjacent to the planned convocation center site.
Widening of High,.vay 321 is a North Carolina Department of Transportation (NCDOT) project.
The EA for the convocation center construction will address the impacts of work in the 100-\ car
floodplain to accommodate the construction of the convocation center and widening of Hialiv, a.
321 adjacent to the proposed center.
PROJECT DESCRIPTION AND NEED FOR PROJECT
The Appalachian Convocation Center facility will serve as a multi-purpose place of assemble for
university convocations, public speakers. various sports tournaments, trainin(i camps. famii-
entertainment shows, conventions, and trade association events and exhibits. The convocation
center will serve the Town of Boone, ASU, and the western North Carolina region.
The proposed construction site is located adjacent to Boone Creek just downstream of existing
ASU Lackey Field (baseball field) and upstream of the existing intersection of Highway 321 and
Rivers Street in Boone (Figure 1 provides a general vicinity map for the proposed construction
site). Portions of the site lie in the 100-year floodplain of Boone Creek. The proposed
construction will take place following Phase 1 and 2 of the ASU boiler plant replacement project
and concurrently with NCDOT work to widen Highway 321.
The construction of an approximate 225,250 square foot convocation center with a 10,000 person
seating capacity is planned near the entrance area on campus, now occupied by the lower portion
of Lackey Field and several tennis courts (Figure 2 shows the site as it currently exists). The
construction will require filling and grading within the 100-year floodplain to elevate the site's
topography for the convocation center and widening of Highway 321. The approximate 450-foot
open channel portion of Boone Creek currently next to the tennis courts will be placed in a box
culvert to facilitate the grading and filling and convey stream flow. The Phase 2 boiler plant
project includes the relocation of Lackey Field to another campus site. It is also anticipated that
the tennis courts will be relocated to another campus location.
The restoration of the culverted upstream portion of Boone Creek into a "natural mountain
stream" is also part of the Phase 2 boiler plant replacement and is addressed in the EA submired
for that project. This natural mountain stream will be constructed between the boiler plant and
proposed convocation center. Boone Creek will flow through this restored area which will be
landscaped with natural vegetation.
The new main campus entrance will highlight the newly restored creek area and the convocation
center facility (Figure 3 shows the proposed site conditions).

EXISTING ENVIRONMENT
ASU is located in the Town of Boone, Watauga County, which is in the northwestern part of
North Carolina. Watauga County is part of the mountainous Blue Ridge land resource area
which includes rolling hills and broad valleys. The scenic Blue Ridge Parkway and Pisgah
National Forest are located within five miles of the ASU campus. The campus topography is
characterized by a long valley located near the Eastern Continental Divide. The proposed site for
the convocation center is currently owned by ASU and occupied mainly by part of Lackey Field,
several university tennis courts, and a portion of existing Rivers Street. The surrounding town of
Boone is commercially developed. There are several recreational ski resorts in the surrounding
area. Currently, soils at the proposed convocation center site are being reclassified by the
Natural Resource Conservation Service (formerly the Soil Conservation Service). Most of the
site has been owned by ASU for over 75 years and was developed by ASU for recreational
purposes including Lackey Field and tennis courts. Boone Creek, a tributary of the New River,
runs through the proposed site.
ENVIRONMENTAL CONSIDERATIONS
Changes in Land Use
The proposed site is located at the main entrance of the ASU campus which is in an urban area.
Current land use at the proposed site is recreational. Construction of the convocation center will
alter current land use. The open channel portion of Boone Creek, flowing through the proposed
site, will be placed in a box culvert. The existing 100-year floodplain in the immediate site area
will be removed and the stream will be contained within a box culvert following fill and grading
activities. As part of the boiler plant replacement project, the culverted portion of Boone Creek
immediately upstream of the convocation center site will be restored to an open channel. The
location for the natural mountain stream area and a portion of the convocation center is currently
occupied by part of Lackey Field. The convocation center development will replace the lower
portion of Lackey Field and several university tennis courts. These recreational facilities will be
eliminated as a result of the planned construction; this loss will be mitigated by the construction
of similar facilities elsewhere on campus. Aesthetically and ecologically, the campus will be
positively impacted by the creation of the convocation center and natural mountain stream area.
The EA for the convocation center construction will therefore further evaluate the impact of
culverting the open channel portion of Boone Creek and modifying the existing floodplain
environment.
Wetlands
Mr. Steve Chapin of the U.S. Army Corps of Engineers (COE) stated in a letter to Ogden dated
September 8, 1995, (and again at a meeting held at ASU on February 22, 1996) that there are no
wetlands on the proposed site. Therefore, unless additional comments are received as a result of
this Scoping Notice, this category will not require further evaluation during the EA.

Waters of the U.S./State
Activities that result in the discharge of fill material into waters of the U.S./State require a
Section 404 permit from the COE and, in some cases, a 401 Water Quality Certification from the
North Carolina Division of Environmental Management (NC DEM). As part of the convocation
center and Highway 321 widening projects, the open portion of Boone Creek adjacent to the
tennis courts will be culverted and the elevation of the area raised by fill and grading activities.
The total affected waterway for the convocation center project is less than one-third of an acre.
This estimate was calculated based on the existing 450 linear feet of open channel and an
ordinary high water level width of 30 feet or less, on the average.
On February 22, 1996, a meeting was held at ASU with the COE and ITC DEM to discuss the
project scope, discuss permitting requirements, and visit the proposed construction site. During
this meeting the COE stated that the project is eligible for permitting through Nationwide Permit
26 (NWP26), Headwaters and Isolated Waters, under the Section 404 program. Although the
impacted waterway is estimated at one-third of an acre or less, a joint application for the NWP26
under Section 404 and the WQC A'2671 General Certification under Section 401 will be
submitted for this project as agreed upon by COE and DEM. Therefore, unless additional
comments are received as a result of this Scoping Notice, this category will not require further
evaluation during the EA.
Prime or Unique Agricultural Lands
The project does not encompass any agricultural lands. Therefore, unless additional comments
are received as a result of this Scoping Notice, this category will not require further evaluation
during the EA.
Public Lands and Scenic Recreational Areas
The North Carolina Park Service indicated that there are no State parks within a five mile radius
of the ASU campus. Using the 7.5' U.S. Geological Survey (USGS) topographic map (Boone,
NC Quadrangle) it was determined that Pisgah National Forest is within one mile of the ASU
campus. Another 7.5' USGS topographic map (Deep Gap, NC Quadrangle) was used to locate
the Blue Ridge Parkway, which is within five miles of the ASU campus. No impact to these
areas is anticipated as a result of this project. Therefore, unless additional comments are
received as a result of this Scoping Notice, this category will not require further evaluation
during the EA.
Infrastructure
During construction, temporary increases in traffic concentrations will occur due to construction
traffic and minor road closures/rerouting. Traffic disruptions should be minimized, however,
because the Rivers Street realignment with Highway 321 will be completed prior to significant
work on the convocation center site. After the convocation center project is completed, traffic
concentrations should return to normal in light of the planned improvements to Highway 321 and
Rivers Street. During events held at the convocation center, there will be increased traffic in the
area. However, road improvements made in conjunction with this project should accommodate

an increased traffic volume. Therefore, unless additional comments are received as a result of
this Scoping Notice, this category will not require further evaluation during the EA.
Areas of Archaeological or Historical Value
The State Historic Preservation Office (SHPO) in Raleigh was contacted to verify that the ASU
campus is not a Historic District nor are any campus buildings on the state list of potential
historic sties. Generally, buildings must be more than fifty years old before they are considered
for listing on the National Register of Historic Places. No known archaeological sites are present
on the ASU campus. Therefore, unless additional comments are received as a result of this
Scoping Notice, this category will not require further evaluation during the EA.
Air Ouualitv
No potential air quality impacts have been identified in relation to the convocation center
construction. Therefore, unless additional comments are received as a result of this Scoping
Notice, this category will not require further evaluation during the EA.
Groundwater Quality
No impact on groundwater is expected as a result of this project. Therefore, unless additional
comments are received as a result of this Scoping Notice, this category will not require further
evaluation during the EA.
Noise Levels
The Town of Boone ordinance 1989-04 (An Ordinance Regulating Unreasonably Loud and
Disturbing Noise in the Town of Boone) establishes the noise level requirements for this project.
Temporarily, there will be construction noise from on-site activities, but the noise is not
anticipated to be above levels set in the ordinance. Once the convocation center is complete, no
noise above the levels in the ordinance is anticipated when the center is in use and filled to
capacity. Therefore, unless additional comments are received as a result of this Scoping Notice,
this category will not require further evaluation during the EA.
Water Supplies
Potable water supplies will not be affected by this construction project. There are no known
water supply wells in the proposed site. ASU supplies its own water to most of the campus.
Water quality standards and classifications are set by NC DEM under the North Carolina
Administrative Code (NCAC) Section 15A NCAC 2B.0301 through .0317. Boone Creek is
identified as a Class C Tr + water. "C" means it is suitable for aquatic life propagation and
survival, fishing, wildlife, secondary recreation, and agriculture. "Tr" stands for Trout Waters
meaning it is suitable for natural trout propagation and maintenance of stocked trout. The
symbol indicates it is a water subject to special management strategy specified in 15A NCAC

For Boone Creek, the ORW rule prohibits new discharges or expansions of existing discharges.
The ORW rule requires the development of an Erosion and Sedimentation Control Plan in
accordance with the rules established by the North Carolina Sedimentation Control Commission
or an appropriate local erosion and sedimentation control program. The construction will require
the diversion of Boone Creek when it is "in the dry" to culvert the open channel. During the
construction, storm water runoff is the only discharge expected. After the construction is
completed, storm water discharges are still the only discharges anticipated. The construction of
the convocation center is not expected to have any significant adverse impacts on Boone Creek
or the water supplies downstream. Best Management Practices (BMPs) incorporated into the
Erosion and Sedimentation Control Plan will be implemented during construction. Any potential
impacts from erosion and sedimentation will be addressed in the Erosion and Sedimentation
Control Plan for this project. Therefore, unless additional comments are received as a result of
this Scoping Notice, this category \yill not require further evaluation during the EA.
Shellfish or Fish and Their Habitats
The regulations at 15A NCAC 2B.0307 indicate Boone Creek is classified as Trout Waters b%
the North Carolina Wildlife Resources Commission (INC WRC). Trout Waters are those waters
of the State suitable for natural propagation and maintenance of stocked trout. Mr. Joe Mickey,
Fisheries Biologist for District 7 (xvhich includes Watauga County), stated that this section of
Boone Creek does not have any kno%vn trout populations at this time. He did state that Boone
Creek feeds into Trout Waters downstream. No adverse impacts to these downstream waters are
anticipated. No significant loss of fish or shellfish habitat from the culverting of this portion of
the creek will occur. The natural mountain stream habitat created as part of the Phase 2 boiler
plant replacement project upstream will create a more diverse aquatic habitat. Any potential
impacts from erosion and sedimentation will be addressed in the Erosion and Sedimentation
Control Plan for this project. Therefore, unless additional comments are received as a result of
this Scoping Notice, this category %yill not require further evaluation during the EA.
Wildlife and Their Habitats
At the meeting on February 22, 1996, Mr. Joe Mickey of the NC WRC stated that there are no
known federal or state-listed threatened or endangered species in the area of the proposed site.
The state list of threatened and endangered species that may potentially be found in Watauga
County was requested from NC WRC on March 5, 1996. The federally-listed threatened and
endangered species which may potentially be found in Watauga County includes:
Carolina northern flying squirrel (Glaucomys sabrinus coloratus);
Blue Ridge Goldenrod (Solidago spithamaea);
Heller's blazing star (Liatris helleri);
Spreading avens (Geunt radiatum);
Roan mountain bluet (Hedyotis purpurea var. nrontana); and
Virginia big-eared bat (Plecotus townsendii virginianus).
None of these species are known to be present in the vicinity of the proposed site. Overall, the
proposed site is currently developed and the grounds are maintained by ASU. The restored
stream area adjacent to the convocation center will create a more diverse wildlife habitat.

Therefore, unless additional comments are received as a result of this Scoping Notice, this
category will not require further evaluation during the EA.
Introduction of Toxic Substances
No toxic substances are anticipated to be introduced into the environment as a result of this
project. Therefore, unless additional comments are received as a result of this Scoping Notice,
this category will not require further evaluation during the EA.
Eutrophication of Receiving Waters
The culverting of the open portion of Boone Creek is not expected to cause eutrophication of
Boone Creek or any receiving waters. Sedimentation control practices which will be used during
construction will be addressed in the Erosion and Sedimentation Control Plan. Further,
hydrologic and hydraulic modeling will be provided for the design of the culvert at the proposed
site with a goal to eliminate or minimize any significant impacts of the culvert upon flowrates
and base flood levels along Boone Creek. Therefore. unless additional comments are received as
a result of this Scoping Notice, this categor,.will not require further evaluation during the EA.
Boone Creek Floodplain
Portions of the proposed convocation center site lie in the 100-year floodplain of Boone Creek as
determined by FEMA. Within the limits of the proposed site, the existing 100-year FEMA
floodplain is located at approximately elevation 3,156 feet. In order to place the convocation
center facility safely above 100-year base flood levels, the elevation of the proposed site will be
increased and the finished floor for the convocation center will be at approximate elevation 3,164
feet. A FEMA Conditional Letter of Map Revision (CLOMR) will be prepared to document the
proposed stream and floodplain modifications resulting from the project. The CLOMR will
follow FEMA procedures and guidelines for proposed modifications to a regulatory floodplain.
Further, the designers for the convocation center project are working closely with the Town of
Boone, FEMA, and the State of NC to ensure that the design meets all applicable floodplain
development requirements.
Storm Water
At the February 22, 1996 meeting, the NC DEM stated that a National Pollutant Discharge
Elimination System (NPDES) storm water permit would not be required for the convocation
center construction. Storm water from the ASU campus currently is discharged into Boone
Creek. During heavy rains, the current capacity of the upstream underground culverted section
(88-inch arch pipe under Lackey Field) and downstream culverted sections of Boone Creek are
inadequate. Adjacent to the convocation center, Rivers Street will be realigned and Highway
321 will be widened. This roadwork, along with the construction of the convocation center, will
require the culverting of the 450-foot open portion of Boone Creek and modification of the
floodplain by filling and grading. The volume and rate of water flowing through Boone Creek is
not anticipated to change significantly during construction or when the project is complete.
Again, hydrologic and hydraulic modeling will be conducted to design the appropriate
parameters for the culvert. Any potential impacts from erosion and sedimentation will be

addressed in the Erosion and Sedimentation Control Plan for this project. Therefore, unless
additional comments are received as a result of this Scoping Notice, this category will not
require further evaluation during the EA.

State agencies of the proposed convocation center construction project. We encourage any
comments you may have relative to your area of expertise or concern. All information and
comments on relevant environmental issues, structures, or features related to the convocation
center construction will be evaluated for the EA.

26 for Phase 1 was requested in June 1995. The channel restoration work
associated with Phase 2 of the Boiler Plant project will also require a NWP 26. The
permit for the Phase 2 work was requested on February 26, 1996.

on the specific Convocation Center project site along Boone Creek, however.

The US Army COE has determined (Mr. Steve Chapin, Asheville Field Office) that
no wetlands exist on the proposed project site (reference is made to COE letter
' dated September 8, 1995, Action ID. 199504607, Pre-Application, and a project
coordination meeting at ASU on February 22, 1996.) Therefore, a wetlands
delineation will not be applicable to this project.

*Note: A culvert system of 800 linear feet (+/-) is proposed for Boone Creek to
accommodate the planned NCDOT widening of US 321 and facilitate development
' of the Convocation Center. However, only 450 feet of the stream is currently in
an open channel condition. A typical bank-to-bank top channel width for the
existing open channel section is approximately 30 feet or less. The width of the
' ordinary high water level along the stream is also 30 feet or less. Also, no
wetlands are located in the project area.
' Using these parameters for calculation of area, the estimate of total impact to
"waters of the US" along Boone Creek is approximately 0.31 acre. This is
determined from the 450 linear ft of existing open channel stream and the 30 ft
' maximum width of the ordinary high water level (450' x 30' = 13,500 sq ft;
13,500 sq ft / 43,560 sq ft per acre = 0.31 acre). This methodology for
determining total area of impact to waters of the US is based upon discussions
with Mr. Steve Chapin (US Army COE) and confirmed by Mr. John Dorney (NC
DEM, Raleigh Central Office) in a telephone conversation with Scott Bryant
(Ogden) February 19, 1996. Mr. Dorney further noted that if the impacted area
is equal to or less than one-third of an acre, a written approval from DEM is not
required for the project.
' Item 12. Description of Proposed Work: (See site plans attached)
' The proposed work involves the development of a multi-purpose Convocation
Center facility at Appalachian State University. The planned NCDOT widening of
US 321, in conjunction with site placement of the Convocation Center facility,
requires that a 450 ft section of Boone Creek open channel be placed into a culvert
system.
1 Item 13. Purpose of Proposed Work:
The "Appalachian Convocation Center" will serve as a multi-purpose place of
' assembly for university convocations, concerts, public speakers, various sports
tournaments, training camps, family entertainment shows, conventions, trade
association events and exhibits. This facility will serve the Town of Boone and the
region, in addition to the University.

Approximately 27% of the Convocation Center's floor area is dedicated to
academic program space for the ASU Health Leisure and Exercise Science
department. The academic area will include faculty offices, classrooms, special
instructional spaces, and research labs.
Item 14. State reasons why the applicant believes this activity must be carried out in wetlands.
Also, note measures taken to minimize wetland impacts.
As noted above, the proposed activity does not involve any disturbance of
wetlands. The project will involve the culverting of approximately 0.31 acre of
"waters of the US" along Boone Creek. The impact to waters of the US will be
minimal, however, because some of the stream is already in culvert.
In order to successfully widen US 321 and develop the Convocation Center site,
the proposed fill and culverting is necessary. The fill will place the site at an
elevation above the 100-year base flood level to protect the building and adjacent
facilities.
Land use adjacent to the existing reach of Boone Creek open channel is typically
urban and includes Blowing Rock Road (US 321), Boone commercial development,
Rivers Street, some residential development, and University tennis courts.
Therefore, the proposed fill and culverting of the site and stream will not
significantly change the nature of the setting nor degrade existing uses.
With regards to adjacent projects, ASU has prepared design plans to remove the
approximate 960 ft run of culvert immediately upstream from the Convocation
Center and restore this area with a "natural mountain stream" concept. The Boone
Creek culvert that will be removed begins at Hardin Street near the ASU boiler
facility and exits just below ASU Lackey Baseball Field in the proposed
Convocation Center site area. As part of the Boone Creek restoration, Lackey Field
will also be relocated to another part of the ASU campus. All of this described
upstream work is associated with the ASU Phase 2 Boiler Plant Project and
includes the realignment of Rivers Street with US 321 immediately upstream of the
Convocation Center site. The 404 application for the Phase 2 work was submitted
to the Corps of Engineers on February 26, 1996.

Work along the Boone Creek channel associated with Phase 1 of the ASU Boiler
Plant Facility (upstream of the Phase 2 Boiler Plant work and Convocation Center
site) was determined to require a US Army COE Nationwide 26 permit. The NWP
' 26 for Phase 1 was requested in June 1995. The channel restoration work
associated with Phase 2 of the Boiler Plant project will also require a NWP 26. The
permit for the Phase 2 work was requested on February 26, 1996.
' It is not known if any Section 404 permits have been previously requested for use
on the specific Convocation Center project site along Boone Creek, however.

The US Army COE has determined (Mr. Steve Chapin, Asheville Field Office) that
no wetlands exist on the proposed project site (reference is made to COE letter
dated September 8, 1995, Action ID. 199504607, Pre-Application, and a project
coordination meeting at ASU on February 22, 1996.) Therefore, a wetlands
delineation will not be applicable to this project.

*Note: A culvert system of 800 linear feet (+/-) is proposed for Boone Creek to
accommodate the planned NCDOT widening of US 321 and facilitate development
' of the Convocation Center. However, only 450 feet of the stream is currently in
an open channel condition. A typical bank-to-bank top channel width for the
existing open channel section is approximately 30 feet or less. The width of the
' ordinary high water level along the stream is also 30 feet or less. Also, no
wetlands are located in the project area.
Using these parameters for calculation of area, the estimate of total impact to
"waters of the US" along Boone Creek is approximately 0.31 acre. This is
determined from the 450 linear ft of existing open channel stream and the 30 ft
maximum width of the ordinary high water level (450' x 30' = 13,500 sq ft;
13,500 sq ft / 43,560 sq ft per acre = 0.31 acre). This methodology for
' determining total area of impact to waters of the US is based upon discussions
with Mr. Steve Chapin (US Army COE) and confirmed by Mr. John Dorney (NC
DEM, Raleigh Central Office) in a telephone conversation with Scott Bryant
' (Ogden) February 19, 1996. Mr. Dorney further noted that if the impacted area
is equal to or less than one-third of an acre, a written approval from DEM is not
required for the project.
Item 12. Description of Proposed Work: (See site plans attached)
The proposed work involves the development of a multi-purpose Convocation
Center facility at Appalachian State University. The planned NCDOT widening of
US 321, in conjunction with site placement of the Convocation Center facility,
requires that a 450 ft section of Boone Creek open channel be placed into a culvert
system.
Item 13. Purpose of Proposed Work:
The "Appalachian Convocation Center" will serve as a multi-purpose place of
' assembly for university convocations, concerts, public speakers, various sports
tournaments, training camps, family entertainment shows, conventions, trade
association events and exhibits. This facility will serve the Town of Boone and the
1 region, in addition to the University.

Approximately 27% of the Convocation Center's floor area is dedicated to
academic program space for the ASU Health Leisure and Exercise Science
department. The academic area will include faculty offices, classrooms, special
instructional spaces, and research labs.
Item 14. State reasons why the applicant believes this activity must be carried out in wetlands.
Also, note measures taken to minimize wetland impacts.
As noted above, the proposed activity does not involve any disturbance of
wetlands. The project will involve the culverting of approximately 0.31 acre of
"waters of the US" along Boone Creek. The impact to waters of the US will be
minimal, however, because some of the stream is already in culvert.
In order to successfully widen US 321 and develop the Convocation Center site,
the proposed fill and culverting is necessary. The fill will place the site at an
elevation above the 100-year base flood level to protect the building and adjacent
facilities.
Land use adjacent to the existing reach of Boone Creek open channel is typically
urban and includes Blowing Rock Road (US 321), Boone commercial development,
Rivers Street, some residential development, and University tennis courts.
Therefore, the proposed fill and culverting of the site and stream will not
significantly change the nature of the setting nor degrade existing uses.
With regards to adjacent projects, ASU has prepared design plans to remove the
approximate 960 ft run of culvert immediately upstream from the Convocation
Center and restore this area with a "natural mountain stream" concept. The Boone
Creek culvert that will be removed begins at Hardin Street near the ASU boiler
facility and exits just below ASU Lackey Baseball Field in the proposed
Convocation Center site area. As part of the Boone Creek restoration, Lackey Field
will also be relocated to another part of the ASU campus. All of this described
upstream work is associated with the ASU Phase 2 Boiler Plant Project and
includes the realignment of Rivers Street with US 321 immediately upstream of the
Convocation Center site. The 404 application for the Phase 2 work was submitted
to the Corps of Engineers on February 26, 1996.
In sum, the planned widening of US 321 and site placement of the Convocation

Watershed: Project is not located within a State designated water-supply
watershed. WS-II and WS-IV water-supply watersheds are located south and
southeast of the project area, respectively.

Work along the Boone Creek channel associated with Phase 1 of the ASU Boiler
Plant Facility (upstream of the Phase 2 Boiler Plant work and Convocation Center
site) was determined to require a US Army COE Nationwide 26 permit. The NWP
' 26 for Phase 1 was requested in June 1995. The channel restoration work
associated with Phase 2 of the Boiler Plant project will also require a NWP 26. The
permit for the Phase 2 work was requested on February 26, 1996.
' It is not known if any Section 404 permits have been previously requested for use
on the specific Convocation Center project site along Boone Creek, however.
' Item 10. Estimated total number of acres of waters of the US, including wetlands, located on
project site:
' Approximately 0.31 acre of "waters of the US" located on the project site along
Boone Creek. (See item 11 for more detail and discussion.)
The US Army COE has determined (Mr. Steve Chapin, Asheville Field Office) that
no wetlands exist on the proposed project site (reference is made to COE letter
' dated September 8, 1995, Action ID. 199504607, Pre-Application, and a project
coordination meeting at ASU on February 22, 1996.) Therefore, a wetlands
delineation will not be applicable to this project.

*Note: A culvert system of 800 linear feet (+/-) is proposed for Boone Creek to
accommodate the planned NCDOT widening of US 321 and facilitate development
' of the Convocation Center. However, only 450 feet of the stream is currently in
an open channel condition. A typical bank-to-bank top channel width for the
existing open channel section is approximately 30 feet or less. The width of the
ordinary high water level along the stream is also 30 feet or less. Also, no
wetlands are located in the project area.
' Using these parameters for calculation of area, the estimate of total impact to
"waters of the US" along Boone Creek is approximately 0.31 acre. This is
determined from the 450 linear ft of existing open channel stream and the 30 ft
' maximum width of the ordinary high water level (450' x 30' = 13,500 sq ft;
13,500 sq ft / 43,560 sq ft per acre = 0.31 acre). This methodology for
' determining total area of impact to waters of the US is based upon discussions
with Mr. Steve Chapin (US Army COE) and confirmed by Mr. John Dorney (NC
DEM, Raleigh Central Office) in a telephone conversation with Scott Bryant
' (Ogden) February 19, 1996. Mr. Dorney further noted that if the impacted area
is equal to or less than one-third of an acre, a written approval from DEM is not
required for the project.
i Item 12. Description of Proposed Work: (See site plans attached)
The proposed work involves the development of a multi-purpose Convocation
Center facility at Appalachian State University. The planned NCDOT widening of
US 321, in conjunction with site placement of the Convocation Center facility,
requires that a 450 ft section of Boone Creek open channel be placed into a culvert
system.
' Item 13. Purpose of Proposed Work:
The "Appalachian Convocation Center" will serve as a multi-purpose place of
assembly for university convocations, concerts, public speakers, various sports
tournaments, training camps, family entertainment shows, conventions, trade
association events and exhibits. This facility will serve the Town of Boone and the
' region, in addition to the University.

Approximately 27% of the Convocation Center's floor area is dedicated to
academic program space for the ASU Health Leisure and Exercise Science
department. The academic area will include faculty offices, classrooms, special
instructional spaces, and research labs.
Item 14. State reasons why the applicant believes this activity must be carried out in wetlands.
Also, note measures taken to minimize wetland impacts.
As noted above, the proposed activity does not involve any disturbance of
wetlands. The project will involve the culverting of approximately 0.31 acre of
"waters of the US" along Boone Creek. The impact to waters of the US will be
minimal, however, because some of the stream is already in culvert.
In order to successfully widen US 321 and develop the Convocation Center site,
the proposed fill and culverting is necessary. The fill will place the site at an
elevation above the 100-year base flood level to protect the building and adjacent
facilities.
Land use adjacent to the existing reach of Boone Creek open channel is typically
urban and includes Blowing Rock Road (US 321), Boone commercial development,
Rivers Street, some residential development, and University tennis courts.
Therefore, the proposed fill and culverting of the site and stream will not
significantly change the nature of the setting nor degrade existing uses.
With regards to adjacent projects, ASU has prepared design plans to remove the
approximate 960 ft run of culvert immediately upstream from the Convocation
Center and restore this area with a "natural mountain stream" concept. The Boone
Creek culvert that will be removed begins at Hardin Street near the ASU boiler
facility and exits just below ASU Lackey Baseball Field in the proposed
Convocation Center site area. As part of the Boone Creek restoration, Lackey Field
will also be relocated to another part of the ASU campus. All of this described
upstream work is associated with the ASU Phase 2 Boiler Plant Project and
includes the realignment of Rivers Street with US 321 immediately upstream of the
Convocation Center site. The 404 application for the Phase 2 work was submitted
to the Corps of Engineers on February 26, 1996.
In sum, the planned widening of US 321 and site placement of the Convocation
Center will require the filling and culverting of approximately 0.31 acre or less of
"waters of the US" along Boone Creek. With the constraints of these two
projects, the proposed culverting is the only practical option for the stream.

' Work along the Boone Creek channel associated with Phase 1 of the ASU Boiler
Plant Facility (upstream of the Phase 2 Boiler Plant work and Convocation Center
site) was determined to require a US Army COE Nationwide 26 permit. The NWP
' 26 for Phase 1 was requested in June 1995. The channel restoration work
associated with Phase 2 of the Boiler Plant project will also require a NWP 26. The
permit for the Phase 2 work was requested on February 26, 1996.
' It is not known if any Section 404 permits have been previously requested for use
on the specific Convocation Center project site along Boone Creek, however.
Item 10. Estimated total number of acres of waters of the US, including wetlands, located on
project site:
Approximately 0.31 acre of "waters of the US" located on the project site along
Boone Creek. (See item 11 for more detail and discussion.)
' The US Army COE has determined (Mr. Steve Chapin, Asheville Field Office) that
no wetlands exist on the proposed project site (reference is made to COE letter
dated September 8, 1995, Action ID. 199504607, Pre-Application, and a project
coordination meeting at ASU on February 22, 1996.) Therefore, a wetlands
delineation will not be applicable to this project.

*Note: A culvert system of 800 linear feet (+/-) is proposed for Boone Creek to
accommodate the planned NCDOT widening of US 321 and facilitate development
of the Convocation Center. However, only 450 feet of the stream is currently in
an open channel condition. A typical bank-to-bank top channel width for the
existing open channel section is approximately 30 feet or less. The width of the
' ordinary high water level along the stream is also 30 feet or less. Also, no
wetlands are located in the project area.
' Using these parameters for calculation of area, the estimate of total impact to
"waters of the US" along Boone Creek is approximately 0.31 acre. This is
determined from the 450 linear ft of existing open channel stream and the 30 ft
maximum width of the ordinary high water level (450'x 30' = 13,500 sq ft;
13,500 sq ft / 43,560 sq ft per acre = 0.31 acre). This methodology for
' determining total area of impact to waters of the US is based upon discussions
with Mr. Steve Chapin (US Army COE) and confirmed by Mr. John Dorney (NC
DEM, Raleigh Central Office) in a telephone conversation with Scott Bryant
' (Ogden) February 19, 1996. Mr. Dorney further noted that if the impacted area
is equal to or less than one-third of an acre, a written approval from DEM is not
required for the project.
' Item 12. Description of Proposed Work: (See site plans attached)
' The proposed work involves the development of a multi-purpose Convocation
Center facility at Appalachian State University. The planned NCDOT widening of
US 321, in conjunction with site placement of the Convocation Center facility,
' requires that a 450 ft section of Boone Creek open channel be placed into a culvert
system.
Item 13. Purpose of Proposed Work:
The "Appalachian Convocation Center" will serve as a multi-purpose place of
assembly for university convocations, concerts, public speakers, various sports
tournaments, training camps, family entertainment shows, conventions, trade
association events and exhibits. This facility will serve the Town of Boone and the
1 region, in addition to the University.

Approximately 27% of the Convocation Center's floor area is dedicated to
academic program space for the ASU Health Leisure and Exercise Science
department. The academic area will include faculty offices, classrooms, special
instructional spaces, and research labs.
Item 14. State reasons why the applicant believes this activity must be carried out in wetlands.
Also, note measures taken to minimize wetland impacts.
As noted above, the proposed activity does not involve any disturbance of
wetlands. The project will involve the culverting of approximately 0.31 acre of
"waters of the US" along Boone Creek. The impact to waters of the US will be
minimal, however, because some of the stream is already in culvert.
In order to successfully widen US 321 and develop the Convocation Center site,
the proposed fill and culverting is necessary. The fill will place the site at an
elevation above the 100-year base flood level to protect the building and adjacent
facilities.
Land use adjacent to the existing reach of Boone Creek open channel is typically
urban and includes Blowing Rock Road (US 321), Boone commercial development,
Rivers Street, some residential development, and University tennis courts.
Therefore, the proposed fill and culverting of the site and stream will not
significantly change the nature of the setting nor degrade existing uses.
With regards to adjacent projects, ASU has prepared design plans to remove the
approximate 960 ft run of culvert immediately upstream from the Convocation
Center and restore this area with a "natural mountain stream" concept. The Boone
Creek culvert that will be removed begins at Hardin Street near the ASU boiler
facility and exits just below ASU Lackey Baseball Field in the proposed
Convocation Center site area. As part of the Boone Creek restoration, Lackey Field
will also be relocated to another part of the ASU campus. All of this described
upstream work is associated with the ASU Phase 2 Boiler Plant Project and
includes the realignment of Rivers Street with US 321 immediately upstream of the
Convocation Center site. The 404 application for the Phase 2 work was submitted
to the Corps of Engineers on February 26, 1996.
In sum, the planned widening of US 321 and site placement of the Convocation
Center will require the filling and culverting of approximately 0.31 acre or less of
"waters of the US" along Boone Creek. With the constraints of these two
projects, the proposed culverting is the only practical option for the stream.

site) was determined to require a US Army COE Nationwide 26 permit. The NWP
' 26 for Phase 1 was requested in June 1995. The channel restoration work
associated with Phase 2 of the Boiler Plant project will also require a NWP 26. The
permit for the Phase 2 work was requested on February 26, 1996.
' It is not known if any Section 404 permits have been previously requested for use
on the specific Convocation Center project site along Boone Creek, however.

*Note: A culvert system of 800 linear feet (+/-) is proposed for Boone Creek to
accommodate the planned NCDOT widening of US 321 and facilitate development
of the Convocation Center. However, only 450 feet of the stream is currently in
an open channel condition. A typical bank-to-bank top channel width for the
existing open channel section is approximately 30 feet or less. The width of the
I ordinary high water level along the stream is also 30 feet or less. Also, no
wetlands are located in the project area.
' Using these parameters for calculation of area, the estimate of total impact to
"waters of the US" along Boone Creek is approximately 0.31 acre. This is
determined from the 450 linear ft of existing open channel stream and the 30 ft
' maximum width of the ordinary high water level (450' x 30' = 13,500 sq ft;
13,500 sq ft / 43,560 sq ft per acre = 0.31 acre). This methodology for
determining total area of impact to waters of the US is based upon discussions
with Mr. Steve Chapin (US Army COE) and confirmed by Mr. John Dorney (NC
DEM, Raleigh Central Office) in a telephone conversation with Scott Bryant
' (Ogden) February 19, 1996. Mr. Dorney further noted that if the impacted area
is equal to or less than one-third of an acre, a written approval from DEM is not
required for the project.
' Item 12. Description of Proposed Work: (See site plans attached)
' The proposed work involves the development of a multi-purpose Convocation
Center facility at Appalachian State University. The planned NCDOT widening of
US 321, in conjunction with site placement of the Convocation Center facility,
requires that a 450 ft section of Boone Creek open channel be placed into a culvert
system.
Item 13. Purpose of Proposed Work:
The "Appalachian Convocation Center" will serve as a multi-purpose place of
assembly for university convocations, concerts, public speakers, various sports
tournaments, training camps, family entertainment shows, conventions, trade
association events and exhibits. This facility will serve the Town of Boone and the
region, in addition to the University.

Approximately 27% of the Convocation Center's floor area is dedicated to
academic program space for the ASU Health Leisure and Exercise Science
department. The academic area will include faculty offices, classrooms, special
instructional spaces, and research labs.
Item 14. State reasons why the applicant believes this activity must be carried out in wetlands.
Also, note measures taken to minimize wetland impacts.
As noted above, the proposed activity does not involve any disturbance of
wetlands. The project will involve the culverting of approximately 0.31 acre of
"waters of the US" along Boone Creek. The impact to waters of the US will be
minimal, however, because some of the stream is already in culvert.
In order to successfully widen US 321 and develop the Convocation Center site,
the proposed fill and culverting is necessary. The fill will place the site at an
elevation above the 100-year base flood level to protect the building and adjacent
facilities.
Land use adjacent to the existing reach of Boone Creek open channel is typically
urban and includes Blowing Rock Road (US 321), Boone commercial development,
Rivers Street, some residential development, and University tennis courts.
Therefore, the proposed fill and culverting of the site and stream will not
significantly change the nature of the setting nor degrade existing uses.
With regards to adjacent projects, ASU has prepared design plans to remove the
approximate 960 ft run of culvert immediately upstream from the Convocation
Center and restore this area with a "natural mountain stream" concept. The Boone
Creek culvert that will be removed begins at Hardin Street near the ASU boiler
facility and exits just below ASU Lackey Baseball Field in the proposed
Convocation Center site area. As part of the Boone Creek restoration, Lackey Field
will also be relocated to another part of the ASU campus. All of this described
upstream work is associated with the ASU Phase 2 Boiler Plant Project and
includes the realignment of Rivers Street with US 321 immediately upstream of the
Convocation Center site. The 404 application for the Phase 2 work was submitted
to the Corps of Engineers on February 26, 1996.
In sum, the planned widening of US 321 and site placement of the Convocation
Center will require the filling and culverting of approximately 0.31 acre or less of
"waters of the US" along Boone Creek. With the constraints of these two
projects, the proposed culverting is the only practical option for the stream.

Work along the Boone Creek channel associated with Phase 1 of the ASU Boiler
' Plant Facility (upstream of the Phase 2 Boiler Plant work and Convocation Center
site) was determined to require a US Army COE Nationwide 26 permit. The NWP
26 for Phase 1 was requested in June 1995. The channel restoration work
associated with Phase 2 of the Boiler Plant project will also require a NWP 26. The
permit for the Phase 2 work was requested on February 26, 1996.
It is not known if any Section 404 permits have been previously requested for use
on the specific Convocation Center project site along Boone Creek, however.
Item 10. Estimated total number of acres of waters of the US, including wetlands, located on
project site:
Approximately 0.31 acre of "waters of the US" located on the project site along
Boone Creek. (See item 11 for more detail and discussion.)
' The US Army COE has determined (Mr. Steve Chapin, Asheville Field Office) that
no wetlands exist on the proposed project site (reference is made to COE letter
' dated September 8, 1995, Action ID. 199504607, Pre-Application, and a project
coordination meeting at ASU on February 22, 1996.) Therefore, a wetlands
delineation will not be applicable to this project.

*Note: A culvert system of 800 linear feet (+/-) is proposed for Boone Creek to
accommodate the planned NCDOT widening of US 321 and facilitate development
of the Convocation Center. However, only 450 feet of the stream is currently in
an open channel condition. A typical bank-to-bank top channel width for the
existing open channel section is approximately 30 feet or less. The width of the
1 ordinary high water level along the stream is also 30 feet or less. Also, no
wetlands are located in the project area.
t Using these parameters for calculation of area, the estimate of total impact to
"waters of the US" along Boone Creek is approximately 0.31 acre. This is
determined from the 450 linear ft of existing open channel stream and the 30 ft
maximum width of the ordinary high water level (450' x 30' = 13,500 sq ft;
13,500 sq ft / 43,560 sq ft per acre = 0.31 acre). This methodology for
determining total area of impact to waters of the US is based upon discussions
with Mr. Steve Chapin (US Army COE) and confirmed by Mr. John Dorney (NC
DEM, Raleigh Central Office) in a telephone conversation with Scott Bryant
(Ogden) February 19, 1996. Mr. Dorney further noted that if the impacted area
is equal to or less than one-third of an acre, a written approval from DEM is not
required for the project.
Item 12. Description of Proposed Work: (See site plans attached)
The proposed work involves the development of a multi-purpose Convocation
Center facility at Appalachian State University. The planned NCDOT widening of
US 321, in conjunction with site placement of the Convocation Center facility,
I requires that a 450 ft section of Boone Creek open channel be placed into a culvert
system.
Item 13. Purpose of Proposed Work:
The "Appalachian Convocation Center" will serve as a multi-purpose place of
assembly for university convocations, concerts, public speakers, various sports
tournaments, training camps, family entertainment shows, conventions, trade
association events and exhibits. This facility will serve the Town of Boone and the
region, in addition to the University.

Approximately 27% of the Convocation Center's floor area is dedicated to
academic program space for the ASU Health Leisure and Exercise Science
department. The academic area will include faculty offices, classrooms, special
instructional spaces, and research labs.
Item 14. State reasons why the applicant believes this activity must be carried out in wetlands.
Also, note measures taken to minimize wetland impacts.
As noted above, the proposed activity does not involve any disturbance of
wetlands. The project will involve the culverting of approximately 0.31 acre of
"waters of the US" along Boone Creek. The impact to waters of the US will be
minimal, however, because some of the stream is already in culvert.
In order to successfully widen US 321 and develop the Convocation Center site,
the proposed fill and culverting is necessary. The fill will place the site at an
elevation above the 100-year base flood level to protect the building and adjacent
facilities.
Land use adjacent to the existing reach of Boone Creek open channel is typically
urban and includes Blowing Rock Road (US 321), Boone commercial development,
Rivers Street, some residential development, and University tennis courts.
Therefore, the proposed fill and culverting of the site and stream will not
significantly change the nature of the setting nor degrade existing uses.
With regards to adjacent projects, ASU has prepared design plans to remove the
approximate 960 ft run of culvert immediately upstream from the Convocation
Center and restore this area with a "natural mountain stream" concept. The Boone
Creek culvert that will be removed begins at Hardin Street near the ASU boiler
facility and exits just below ASU Lackey Baseball Field in the proposed
Convocation Center site area. As part of the Boone Creek restoration, Lackey Field
will also be relocated to another part of the ASU campus. All of this described
upstream work is associated with the ASU Phase 2 Boiler Plant Project and
includes the realignment of Rivers Street with US 321 immediately upstream of the
Convocation Center site. The 404 application for the Phase 2 work was submitted
to the Corps of Engineers on February 26, 1996.
In sum, the planned widening of US 321 and site placement of the Convocation
Center will require the filling and culverting of approximately 0.31 acre or less of
"waters of the US" along Boone Creek. With the constraints of these two
projects, the proposed culverting is the only practical option for the stream.

determining total area of impact to waters of the US is based upon discussions
with Mr. Steve Chapin (US Army COE) and confirmed by Mr. John Dorney (NC
DEM, Raleigh Central Office) in a telephone conversation with Scott Bryant
(Ogden) February 19, 1996. Mr. Dorney further noted that if the impacted area
is equal to or less than one-third of an acre, a written approval from DEM is not
required for the project.
Item 12. Description of Proposed Work: (See site plans attached)
1 The proposed work involves the development of a multi-purpose Convocation
Center facility at Appalachian State University. The planned NCDOT widening of
US 321, in conjunction with site placement of the Convocation Center facility,
requires that a 450 ft section of Boone Creek open channel be placed into a culvert
system.
' Item 13. Purpose of Proposed Work:
The "Appalachian Convocation Center" will serve as a multi-purpose place of
' assembly for university convocations, concerts, public speakers, various sports
tournaments, training camps, family entertainment shows, conventions, trade
association events and exhibits. This facility will serve the Town of Boone and the
1 region, in addition to the University.

Approximately 27% of the Convocation Center's floor area is dedicated to
academic program space for the ASU Health Leisure and Exercise Science
department. The academic area will include faculty offices, classrooms, special
instructional spaces, and research labs.
Item 14. State reasons why the applicant believes this activity must be carried out in wetlands.
Also, note measures taken to minimize wetland impacts.
As noted above, the proposed activity does not involve any disturbance of
wetlands. The project will involve the culverting of approximately 0.31 acre of
"waters of the US" along Boone Creek. The impact to waters of the US will be
minimal, however, because some of the stream is already in culvert.
In order to successfully widen US 321 and develop the Convocation Center site,
the proposed fill and culverting is necessary. The fill will place the site at an
elevation above the 100-year base flood level to protect the building and adjacent
facilities.
Land use adjacent to the existing reach of Boone Creek open channel is typically
urban and includes Blowing Rock Road (US 321), Boone commercial development,
Rivers Street, some residential development, and University tennis courts.
Therefore, the proposed fill and culverting of the site and stream will not
significantly change the nature of the setting nor degrade existing uses.
With regards to adjacent projects, ASU has prepared design plans to remove the
approximate 960 ft run of culvert immediately upstream from the Convocation
Center and restore this area with a "natural mountain stream" concept. The Boone
Creek culvert that will be removed begins at Hardin Street near the ASU boiler
facility and exits just below ASU Lackey Baseball Field in the proposed
Convocation Center site area. As part of the Boone Creek restoration, Lackey Field
will also be relocated to another part of the ASU campus. All of this described
upstream work is associated with the ASU Phase 2 Boiler Plant Project and
includes the realignment of Rivers Street with US 321 immediately upstream of the
Convocation Center site. The 404 application for the Phase 2 work was submitted
to the Corps of Engineers on February 26, 1996.
In sum, the planned widening of US 321 and site placement of the Convocation
Center will require the filling and culverting of approximately 0.31 acre or less of
"waters of the US" along Boone Creek. With the constraints of these two
projects, the proposed culverting is the only practical option for the stream.
