Wilson County
On 10 April 1996, you requested a 401 Water Quality Certification from the Division
of Environmental Management for your project (construction of a forestry road) located
near NC 42 East in Wilson County. We wrote to you on 23 April 1996 discussing
concerns that we have regarding the design of the project and placing it on hold until those
concerns are addressed. We recently received a copy of a Corps of Engineers letter dated
22 April 1996 stating that this project was exempt from a 404 Permit. Since no 404
Permit will be required, no 401 Water Quality Certification will be needed.

the Natural Resources Conservation Service regarding your

north of S.R. iix8, below the headwaters of Cattail Swamp,
southeast of Elm City, in WllgQn (;Ounry, Norn c:arolina.
Based upon the information submitted by Mr. Donald W.
Pittman, District Conmervationiat, the primary purposc of chc
propQst!U rods is Lo provide access for timber haxvestfng and
management. Per our regulations [33 CFR, Part 323.4(a)(6)), the
construction of forest roads is exempt from section 404 of the
C3ean Water Act provided such roads are built and maintained :,n
accordance with enclosed -5eSL management eracrlces ror logging
roads. Accordingly, a Department of the Army permir will not be
required for construction of your proposed road. Please note
that to utilize this exempGjon, the work cannot convert an area

CONDITIONS
a. Perunent roods (for fanning or forestry activities), temporary arcen
roada (for mining, forestry, or ram purposes) and skid trails (for logging)
In waters of the U,S, shall be held to the minimum feasible number, width,
and total length consistent with the purpose of specific farming,
silvieultural, or mining operations, and local topographic and ol_matie
conditions;

outside the Lateral boundaries of the fill itself;
f. In designing, donstructing, and maintaining roads, vegetative
disturbance in the waters Of the U.S. 3hall be kept to a minimum;

disrupt the migration or other movement of those species of aquatic life

I have received your request for a wetland determination or
delineatiou on farm tract 31G5. You need to know that this
process may require 90 days to complete.
The time factor is the result of policy established in a
Memorandum of Agreement by the EPA, Fish and Wildlifo
Service, Corps of Engineers, and the Natural Resvur'ces
Conservation Service. '1'he kVish and Wildlife Service and the
Corps must be consulted prior to our completion of a wetland
determination or delineation.
These agencies have as much as 45 days to respond to your
request, while the state DEM has no deadlino. PleasA be
assured that we, at the NRCS will try to expedite the
process as quickly as possible and get a response: to you.
