On 8/23/2010, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCGNE0148, In accordance with your request, CertifEcate'of Coverage
Number NCGNE0148 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
cov,2.rage was necessary. if, in retrospect, you feel the site still requires permit coverage, you should
rtotifry this office immediately. Furthermore, if in the future you wish to again discharge to the State's
si�.face waters, you must first apply for and receive a new NPDES pennit. ,
If the facility is in the process of being sold, you will be performing a public servicc if you would inform
the new or prospective owners of their potential need for NPDES pennit coverage.

On August 16, 2010, Scott health and Safety received a letter from your
agency discussing our recertification for our facility declaring No Exposure
Certification as it relates to Stormwater discharge.
This facility is currently operating with a Stormwater Discharge Permit which
was issued by NC Division of Water Quality on October 17, 2007. (General
Permit No. NCG030000 Certificate of Coverage NO. NCG030511).
Therefore, we are requesting that the Certification for No -Exposure
Exclusion be rescinded.

As a current holder.gf a No -Exposure Certification, please note the following important change to the Division's
implementation of this program. The No -Exposure Certifications no longer will have an expiration date. Previously your
no -exposure exclusion had to be re -certified with the Division every 5 years. This will no longer be required. Please
disregard the expiration date on your original certification. However, in order to assure that your facility stays in
compliance with,all of the conditions in the no -exposure certification, you must self re -certify your facility at least
annually. Please F�a the attachment for information on self re -certification.
If you. are waiting for a response from the Division for a renewal certification you already submitted, please consider this
letter the Division's approval for renewing your No -Exposure exclusion.
Please note that tf ;.:• does not change your obligation to maintain no -exposure conditions at your facility. If
conditions change such that your facility can no longer qualify for a no -exposure exclusion, you are obligated to
immediately obtain NPDES permit coverage for your stormwaterdischarge. Otherwise, the discharge becomes
subject to enforcement as an un-permitted discharge. State statute provides for fines of up to $25,000 per day for
un-permitted discharges.
Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental
permits that may be required under other federal, state, or local regulations or ordinances.

The Division has reviewed your submittal of the No -Exposure Certification for Exclusion from NPDES
Stormwater Permitting form, which we received on March 7, 2002. We apologize for the extended period it
has taken us to get back to you on this request and we appreciate your patience as we have worked through
this process. Based on your submittal and signed certification of no exposure at the above referenced facility
the Division is granting your certification as provided for under 40 CFR 126.22(g) which is incorporated by
reference in North Carolina regulations.
Please note that by our acceptance of your no exposure certification, you are obligated to maintain no
exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no -
exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your Stormwater
discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your
conditional no -exposure exclusion expires in five years (April 30, 2010). At that time you must re -certify with
the Division, or obtain NPDES permit coverage for any Stormwater discharges from your facility.
Your certification of no exposure does not affect your facility's legal requirements to obtain environmental
permits that may be required under other federal, state, or local regulations or ordinances.

It was very educational talking to you about the permit requirements
for our new facility. I am attaching a copy of the rescission form we
are sending to Valery Stephens. Once again, I requested the rescission
of the permit be delayed until June 15, 2002 to give us the time we
need to move into the new facility.
Also find attached a copy of the completed Form 3510-11, the NO
EXPOSURE CERTIFICATION application for the new location on Goldmine

NPDES Storm Water Permuting
Submission of this No Exposure Certification constitutes notice that the entity identified in Soction A does not require permit authorization for its storm water
discharges associated with industrial activity in the State identified in Section B under EPA's Storm Water Multi -Sector General Permit due to the existence
of a condition of no exposure.
A condition of no exposure exists at an industrial facility when all industrial materials and activities are protected by a storm resistant shelter to prevent
exposure to rain, snow, snowmelt, and/or runoff. Industrial materials or activities include, but are not limited to, material handling equipment cr activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage,
loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is
not required for the following industrial materials and activities:
— drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed"
means banded or otherwise secured and without operational taps or vatves;
— adequately maintained vehicles used in material handling; and
— final products, other than products that would be mobilized in storm water discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is
available on a facility -wide basis only, not for individual outfalls. If any industrial activities or materials are or will.be exposed to precipitation, the facility is
not eligible for the no exposure exclusion.
By signing and submitting this No Exposure Certification form, the entity in Section A is certifying that a condition of no exposure exists at its facility or site,
and Is obligated to comply with the terms and conditions of 40 CFR 122.26(g).

the form, we are moving to a new location, some distance from the
existing site.
However, since it will take some time to effect the move, please do not

Federal law at 40 CFR Part 122126 prohibits point source discharges of
storm water associated with industrial activity to waters of the U.S. without
a National Pollutant Discharge Elimination System (NPDES) permit. However,
NPDES permit coverage is not required for discharges of storm water
associated with industrial activities identified at 40 CFR 122.26(b)(14)(i)-
(ix) and (xi) if the discharger can certify that a condition of "no exposure"
exists at the Industrial facility or site.
Storm water discharges from construction activities identified in 40 CFR
122.26(b)(14)(x) and (b)(15) are not eligible for the no exposure exclusion.
Obtaining and Maintaining the No Exposure Exclusion
This form is used to certify that a condition of no exposure exists at the
industrial facility or site described herein. This certification is only applicable
in jurisdictions where EPA is the NPDES permitting authority and must be
re -submitted at least once every five years.
The industrial facility operator must maintain a condition of no exposure at
its facility or site in order for the no exposure exclusion to remain applicable.
If conditions change resulting in the exposure of materials and activities to
storm water, the facility operator must obtain coverage under an NPDES
storm water permit immediately.

Section A. Facility Operator Information
1. Provide the legal name of the person, firm, public organization, or any
other entity that operates the facility or site described in this certification.
The name of the operator may or may not be the same as the name of
the facility. The operator is the legal entity that controls the facility's
operation, rather than the plant or site manager.
2. Provide the telephone number of the facility operator.
3. Provide the mailing address of the operator (P.O. Box numbers may be
used). Include the city, state, and zip code. All correspondence will
be sent to this address.

be obtained from United States Geological Survey (USES) quadrangle
or topographic maps, by calling 1-(888) ASK-USGS, or by accessing
EPA's web site at http://www.apa.gov/owm/swriindustryAndex.htm and
selecting Latitude and Longitude Finders under the Resources/Permit
section.
Latitude and longitude for a facility in decimal form must be converted
to degrees (1), minutes ('), and seconds (") for proper entry on
the certification form. To convert decimal latitude or longitude to
degrees/minutes/seconds, follow the steps in the following example.
Example: Convert decimal latitude 45.1234567 to degrees (°), minutes

8. Enter the total size of the site associated with industrial activity in acres.
Acreage may be determined by dividing square footage by 43,560, as

Jim,
Thanks for your call this morning. Corroborating our earlier conversation, I have the following guidance on the three
topics you raised.
1. Our September 3, 2010 notification letter of rescission of No Exposure Exclusion from permitting.
a. Scott's facility in Monroe is currently covered under Certificate of Coverage NCG030511, as seems
appropriate for the facility as you described it.
b. We have rescinded the No Exposure Exclusion, NCGNE0148, as per your request. This also seems
appropriate for the site conditions, as we discussed today.
The second paragraph of our September 3, 2010 notification letter misses the mark with respect to the
current permitting status of your site. At the time we produced the notification letter, we missed the
point that while we did indeed rescind your coverage under NCGNE0148, your site still had continuing
coverage under NCG030511. The second paragraph is pointed at the much more common
circumstance of a facility applying for a rescission, and without any continuing regulatory obligation
under the NPDES stormwater permitting program. This is not the case for Scott Health and Safety. I'm
sorry for our oversight, and your resulting confusion.
In summary, you are properly permitted under NCG030511, and the second paragraph in the
notification letter should be understood as part of a mass mailing letter template that does not apply to
your site under its current circumstances.
You also advised me that you are not contemplating a sale of the facility, and so again, the third
paragraph of the notification letter should be understood as standard template language not applying to
your site under its immediate circumstances.
2. Analytical sampling results showing a high hit for TSS.
a. You asked me about submitting an atypical stormwater sampling result encountered in the July -
December 2010 sampling event; a T55 value of 925 mg/L.
b. Despite your execution of a Tier 1 walk -around, you were not able to conclusively identify the source of
the benchmark exceedance. You supposed that potential causes may have been: poor sampling
technique in that the third party sampler reported sampling from a flow that was so shallow that the act
of sampling stirred up the bottom sediments in the flow channel; the extended preceding dry period
may have exacerbated the first flush delivery of accumulated pollutants; an adjacent grassed area was
very dry and may have lost some sediment compared to a fully vegetated condition; very recent grass
clippings may have entered the discharge flow, thereby raising the TSS.
c, Three other outfalls sampled in the same rain event had TSS values in the range of 30 mg/L to 60 mg/L.
There is no particular reason to suspect unusual exposure or risk in this sub -drainage area, although the
facility receiving docks are in this sub -drainage area.
d. I advised you to go ahead and submit the 925 mg/L result, with an explanation of your suspicions as to
the possible causes, and the inconclusive results of your Tier 1 walk -around. We talked about
alternative strategies, but it seems to me this is the best approach. The permit obligates you to submit
the first valid sampling results during the monitoring period. For you own management purposes, you
may wish to re -sample just the one outfall forjust TSS — as an investigation into whether there really is a
continuing source, or whether this really is a case of poor sampling conditions leading to poor sampling
technique, but you are not required to accomplish this extra sampling under your permit.

3. (1pportunities to discontinue TTO analyses in the future.
a. You reported TTO results within the benchmark values, i.e. < 1 mg/L.
b. You reported that the only solvent present on site is IPA, perhaps 2S gallons on site today, and perhaps
110 gallons on site in a year.
c. I advised that the permit text itself provides that you can be excused from continuing the TTO analyses
upon petition to DWQ and upon the development and implementation of a solvent management plan
for all of your on -site solvents (per your report, just the IPA in your case.) I offered the opinion that for
such a small quantity, and for just the one solvent, an approved Solvent Management Plan would
require fairly simple documentation.
d. We further discussed the small quantities involved, and I suggested that perhaps we might consider that
the small quantities involved would allow us to waive the TTO analyses based on a de minimis
argument, rather than based on the strict wording in the permit text requiring a Solvent Management
Plan. I've reconsidered that perspective, and I now believe that the clearest path forward would be for
you to be excused from TTO only upon the development of the required Solvent Management Plan,

In accordance with the application for this mining permit, which is hereby approved by the
Department of Environment and Natural Resources, hereinafter referred to as the Department,
and in conformity with the approved Reclamation Plan attached to and incorporated as part of
this permit, provisions must be made for the protection of the surrounding environment and for
reclamation of the land and water affected by the permitted mining operation. This permit is
expressly conditioned upon compliance with all the requirements of the approved Reclamation
Plan. However, completed performance of the approved Reclamation Plan is a separable
obligation, secured by the bond or other security on file with the Department, and may survive
the expiration, revocation or suspension of this permit.
This permit is not transferable by the permittee with the following exception: If another
operator succeeds to the interest of the permittee in the permitted mining operation, by virtue
of a sale, lease, assignment or otherwise, the Department may release the permittee from the
duties imposed upon him by the conditions of his permit and by the Mining Act with reference
to the permitted operation, and transfer the permit to the successor operator, provided that
both operators have complied with the requirements of the Mining Act and that the successor
operator agrees to assume the duties of the permittee with reference to reclamation of the
affected land and posts a suitable bond or other security.
In the event that the Department determines that the permittee or permittee's successor is not
complying with the Reclamation Plan or other terms and conditions of this permit, or is failing
to achieve the purposes and requirements of the Mining Act, the Department may give the
operator written notice of its intent to modify, revoke or suspend the permit, or its intent to
modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a
hearing at a designated time and place on any proposed modification, revocation or
suspension by the Department. Alternatively and in addition to the above, the Department
may institute other enforcement procedures authorized by law.
Definitions
Wherever used or referred to in this permit, unless the context clearly indicates otherwise,
terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49.
Expiration Date
This permiL.s6l be effective from the date of its issuance until August 27, 2020.
Conditions
This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and
to the following conditions and limitations:
OPERATING CONDITIONS:
A. Any wastewater processing or mine dewatering shall be in accordance with the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission.

On 8/23/2010, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCGNEO148. In accordance with your request, Certificate of Coverage
Number NCGNEO148 is rescinded effective immediately. .
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing pennit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for. and receive a new NPDES permit. ,
If the facility is in the process of being sold, you will be performing a public service if you would inforni
the new or prospective owners of their potential need for NPDES permit coverage.
