In accordance with your request, Certificate of Coverage Number NCGNEO102 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished pen -nit coverage when, in fact, continuing pen -nit coverage was necessary. If, in retrospect, you feet the site still requires pennit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive.a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only, not for individual outfalls. If any industrial activities or materials are or will be exposed to precipitation, the facility is not eligible for the no exposure exclusion. Box 11422 Pittsburgh, PA 15238-0422 Phone: 412.963.9363 x5734 Fax: 412.696,0333 Email: rterraro@spang.com RE: Magnetics Division of Spang & Company, Canton, NC SIC Code 3679 NPDES Stormwater Discharge Permitting Qualification for Category 1 I Exemption Dear Mr. Bennett: This letter and included attachments are provided in response to the telephone conversation that we had on Wednesday, December 19, 2001, regarding the Unit's requirements for a facility to qualify for a Category 1 1 exemption from obtaining a Stormwater General Permit in the state of North Carolina. The Magnetics Division of Spang & Company is currently in the process of constructing a ferrites manufacturing facility located in Canton, North Carolina. The site is located on Great Oak Drive in the Beaverdam Industrial Park and consists of approximately 194,400 square feet of existing warehouse and office space on approximately 30 acres of land. The site was initially developed and constructed in 1998 as a manufacturing facility and was occupied by Commercial Vehicle Systems until sometime in 2000. The site will manufacture ferrite cores used in the electronics industry. The process used to manufacture ferrite cores is similar to that used to produce other types of non -clay based ceramics. In this case, a prepared powder mixture of oxides of iron, manganese, zinc, and binding agents will be delivered to the facility in containers. The powder will be transferred to presses, where the specific sizes and shapes of ferrite cores are formed. The parts will then be charged to tunnel kilns, where the ferrite parts are fired at high temperatures under controlled atmospheres. The fired cores become ceramic electronic components that require further mechanical January 2, 2002 Page 2 processing to produce a finished part. This mechanical processing consists of surface grinding of similar parts to obtain critical shape characteristics. After the ferrite cores undergo functional parameter testing and physical inspection, they are packaged for finished goods inventory and shipment to customers. According the information contained on the Division of Water Quality's website, Magnetics, due to its SIC code, is in a category that requires the facility to obtain an Stormwater General Permit. However, due to the nature of its manufacturing activities, Magnetics seems to qualify for what is called the "Category I 1 Exemption" From obtaining this permit for the following reasons: All manufacturing activities at the site will be conducted indoors. All raw and waste materials will be stored indoors. All waste dumpsters at the facility will be kept covered. Since all of the activities at the site will be conducted indoors and all waste containers will be kept covered, Magnetics has eliminated any potential stonnwater exposures. Therefore, we are requesting your concurrence that the facility will not need to obtain a Stormwater General Permit. Attached are two maps of the facility (Attachments 2 and 3), denoting planned dumpstcr locations and areas where any loading and unloading activity is to occur. Also attached is the completed EPA Form 3510-1 1 "No Exposure Certification for Exclusion from NPDES Storm Water Permitting" (Attachment 1).
