Dear Mr. Faulk:
You have our approval to place fill material in 0.23 acres of wetlands or waters for the purpose of
constructing sewer lines and stabilizing a stream at CSX tract, as you described in your application
dated 8 January 1996 . After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Numbers 3022 and 2665. These certifications allow you to use
Nationwide Permit Numbers 12 and 13 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get apy other federal, state or local permits before you go ahead with your
proj cc t. 'A
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-

Dear Mr. Dorney and Mr. DeRosa:
The purpose of this letter is to request a Nationwide Permit 12, and a Section
401 Water Quality Certification for the project known as the CSX Tract and
Sewer Outfall. The project, owned by Suburban Park LLC., is located near
Raleigh, NC (Wake County). The site is shown on the enclosed N.C., USGS
Topo Quad vicinity map.
It will be necessary to impact 0.21 acres (see map) of jurisdictional wetlands
above headwaters for the placement of the proposed sewerline. An additional
0.02 acres of channels banks will be stabilized under Nationwide Permit 13.
See enclosed impact table and impact key for locations, sizes, and types of
wetlands that are to be impacted. Impacts are shown in detail on attached maps
and grade plans.

perform a site visit please call and we will arrange for someone to accompany
you.

6-here are wetlands on the above described property which we strongly suggest should be delineated and
surveyed. The surveyed wetland lines must be verified by our staff before the Corps will make a final
jurisdictional determination on your property.
• Because of the size of your property and our present workload, our identification and delineation of your
wetlands cannot be accomplished in a timely manner. You may wish to employ a consultant to obtain a
more timely delineation of the wetlands. Once your consultant has flagged a wetland line on the property,
Corps staff will review it, and, if it is accurate, we strongly recommend that you have the line surveyed for
final approval by the Corps. The Corps will not make a final jurisdictional determination on your property
without an approved survey.
?• The wetlands on your lot have been delineated, and the limits of Corps jurisdiction have been explained
80 to you. Unless there is a change in the law or our published regulations, this determination may be relied
upon for a period not to exceed 1,4ree years from the date of this notification.
• There are no wetlands presents on the above described property which are subject to the permit
requirements of Section 404 of the Clean Water Act (33 USC 1344). Unless there is a change in the law
or our published regulations, this determination may be relied upon for a period not to exceed three years
from the date of this notification.
• The project is located in one of the 20 Coastal Counties. You should contact the nearest State Office of
Coastal Management to determine their requirements.
Placement of dredged or fill material in wetlands on this property without a Department of the Army
permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311). A permit is
not required for work on the property restricted entirely to existing high ground. If you have any
