On March 4, 2014, the Division of Energy, Mineral and Land Resources received your request to rescind
your coverage under Certificate of Coverage Number NCG210386. In accordance with your request,
Certificate of Coverage Number NCG210386 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit is against federal and state laws and
could result in fines. If something changes and your facility would again require stormwater or
wastewater discharge permit coverage, you should notify this office immediately. We will be happy to
assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

We've received the rescission request for NCG180082 Blue Ridge Panels. That permit number was rescinded in 2008,
and in its place, NCG210386 was issued. Before I go ahead with the rescission of the stormwater permit for the former
Blue Ridge Panels facility in Lenoir, NC, I need to verify that you are requesting rescission of the current permit
NCG210386 and not NCG180082. Is that correct?
You can view the current permit information on our website if you're interested:
http://portal.ncdenr.org/web/`Ir/­swpermit-tracker. You'll see that the status of NCG210386 is "expired," but the permit
needs to be rescinded in order to stop billing.

Sorry for the confusion. Timber products is the SIC code (and type of industry) and not the specific company. I should
not have capitalized "Timber Products." You all have a general stormwater permit for "lumber and wood products,
except furniture, including wood chip mills -- SIC 24. Does this now make sense?

After I replied to your email, I realized that this is the site of the former Broyhill Miller Hill Complex. l pulled the Blue
Ridge Panels file and reached Mr. David Moore (former plant manager) at his cell phone number (828/221-5494). He
confirmed that Blue Ridge Panels was no longer in operation and had gone "bankrupt 1 % to 2 years ago". The NC
Secretary of State website confirms this with a "dissolved" status for this company. He did give me a contact for the
parent company Hambro Forest Products in Crescent City, CA. I have a message in to Mr. Wes White (707/218-5650)
asking them to request rescission of the stormwater permit. On another note, I had a call in October 2013 from
Woodgrain which will have a new facility at this same location. I have a call into Rick Penley (828/754-2089) of
Woodgrain to determine if they are operating. As far as I know, we have not received an NOI from Woodgrain. Once
confirmed that Woodgrain is operating, we will schedule an inspection.
I'll let you know the results of my conversation with Mr. White when he returns my call.

We got a returned invoice from Blue Ridge Panels, Inc. in Caldwell County, NCG210386. On the returned invoice, it's
indicated that the company is no longer in business. I tried to reach the owner to discuss the possibility of rescission or
change of ownership, but the phone number we have on file is disconnected.
Is there a staff person in the ARO that can go by the facility to ascertain whether industrial activities have ceased and if
any potential pollutant sources remain onsite? You should also know that their permit is expired, so if there are
stormwater discharges, they may be in violation. The facility address is: 820 Complex St Sw, Lenoir.

If we determine that rescission is an option, we'll try contacting the owner by mail and recommend they formally
request a rescission. That letter can come from the ARO, or I can handle it if you prefer.

Hi Bill,
I looked over the NOI and noticed it was at a location that was recently permitted under NCG08. You
may already know all this, if so 1 apologize. I called Mr. Styles and spoke with his secretary regarding
the location. Indeed there are two companies operating in the Miller Hill Complex. One is a
warehousing and transportation facility owned by Broyhill, the other is the Blue Ridge Panels facility.
They each own land in the complex. If you feel a site visit is necessary please let me know. Otherwise I
have no concerns regarding issuance of the COC for Blue Ridge Panels. The facility was inspected by
Larry Frost of this office in the spring of 2006. The site was listed as owned by Blue Ridge Panels at
that time. The inspection found the site to be in compliance with their NCG 18 permit at that time. They
were noted as being a clean facility and having a SPPP that was being implemented.

In response to your renewal application for continued coverage under stormwater General Permit NCG210000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit has been reissued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Stormwater Permit NCG210000
• A copy of the Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes to the General Permit include the following:
• Permit cover page, second paragraph — The General Permit now may cover activities that DWQ determines to be similar in
either the process, or in the exposed materials, to the Timber Products Industry.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for continued coverage at the next renewal of the General Permit.
• Part I Section B second paragraph — A new clarification that the permit does not authorize discharges that DWQ determines
are wastewaters.
• Part 11 Section A —The required contents of the Stormwater Pollution Prevention Plan have been expanded and clarified.
• Part 11 Section B Table 1 — A new requirement to sample stormwater discharges twice per year for those facilities with
exposed piles of certain materials remaining on site longer than seven days.
• Part II Section B Tables 2 and 3 and following — For permittees with exposed piles, there are new provisions requiring the
permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the
second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring
instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences.
• Part 11 Section B — For permittees with exposed piles, a new provision that four exceedences of any particular benchmark
will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct
the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control
measures.
•_ Part 11 Section C — Clarification that under the qualitative monitoring provisions of the permit, the permittee is obligated to
respond to repeated observations of stormwater pollution. DWQ may impose additional stormwater management
requirements if the permittee is non -responsive, or if the responses are ineffective.
Your coverage under the General Permit is transferable only through the specific action of DWQ.
