On 8/8/2013, the Division of Energy, Mineral and Land Resources received your request to rescind your
coverage under Certificate of Coverage Number NCG 170140. In accordance with your request,
Certificate of Coverage Number NCG 170140 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit is against federal and state laws and
could result in fines. If something changes and your facility would again require stormwater or
wastewater discharge permit coverage, you should notify this office immediately. We will be happy to
assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

I am trying to tie up some loose ends here on old rescission requests. Can you tell me anything about the status of the
following facility and whether you would recommend them for rescission?
NCG170140— Guilford Mills Incorporated — Wake. They requested rescission in August 2013. Their request states that
the facility closed in December 2008. They continued to pay their annual fees until 2012, and are now overdue one
payment.

As to the status of NCG17, and the status of Guiford Mills' renewals:
a) DWQ's proposed revisions to that general permit will be available on our website on May 15, 2009. We will take
public comments through June 15. We will incorporate selected public comments, and re -issue the general permit on
August 1, 2009.
b) The revisions we are proposing are minor. For NCG17 the most significant change will be a little more detailed
explanation of the requirements under the several elements of the SPPP, as identified in Section II.A. of the current
permit text.
c) The permit boilerplate is confusing as to your responsibility to renew 180 days in advance. For many past permit:
cycles DWQ has taken on the responsibility to initiate permit renewal under the General Permits. In general, permittees
should wait to hear from us on the renewal actions, boilerplate language not withstanding.
d) However, in your case, we should have already mailed out your renewal notices with all the other NCG17 renewal
.otices in early February of this year. So, it looks like there has been some sort of glitch, since we don't have responses
from you on any of the four facilities you list below. It looks like we mailed the four renewal notices to the mailing
address shown in our records, rather than to the revised address that you provided in January. Our database stile shows:

STORMWATER DISCHARGES
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM
In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and
regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the
Federal Water Pollution Control Act, as amended,
Guilford Mills, Inc.
is hereby authorized to discharge stormwater from a facility located at
Guilford Mills, Inc.
200 Dickens Road
Fuquay-Varina, NC
Wake County
to receiving waters designated as an unnamed tributary to Basal Creek in the Neuse River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III
and IV of General Permit No. NCG 170000 as attached.
This certificate of coverage shall become effective April 7, 1995.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
