This project, owned by Spdng DeveloplllE:!nt, Inc., is located near Apex, NC (Wake County). This site shown on the attached plans and USGS Tapo Quad vicinity map. A Ni:\tionwide Permit 26 will be neccssc1l'Y to impact 0.85 acres (see map) of jurisdictional wetlands for the development of a residential subdivision. A total of 0..10 a<:res of impacts for a road crossing is requested under Nationwide Permit '14. ~werlines have been installed <It the site. They conform to the conditions of Nationwide 12 and its General Water Quality Certification. Stmam bunk 5tabilizalion is required by Wake County Erosion Control. Stabilization conforms to Nationwide 13. Th(~ Olajority of impacted vegetated wctlimds are associated with the bottoms of ret:ently drained ponds. These i:lreas do not support small woody ve~~et.\tion. Impoundments could not be brought up to Dam Safety spQCific.\tions in an economically feasible manner and, therefol'p, were removed. After reviewing your application, we have decided that this fIll is covered by General Water Quality Certification Numbers 3022, 2732 and 2671. These certifIcations allow you to use Nationwide Pemtit Numbers 12, 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. This certification does not authorize any lot flll in the large wetland area between lots 110-114 of Phase I and lots 9-12 of Phase II, or any flll in Phase III. Deed restrictions shall be placed on all lots with remaining jurisdictional wetlands to prevent future fill. It should also be noted here that the Division encourages any wetland restoration efforts in the old pond area in Phase I, Tract A Section II, as suggested by your consultant during his site visit with our Regional Office. In addition, you should get any other federal,state or local pemtits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing, You must act within 60 days of the date that you receive this letter, To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. This project, owned by Spang Development, Inc., is located near Apex, NC (Wake County). This site shown on the attached plans and USGS Topo Quad vicinity map. A Nationwide Permit 26 will be necessary to impact 0.85 acres (see map) of jurisdictional wetlands for the development of a residential subdivision. A total of 0.10 acres of impacts for a road crossing is requested under Nationwide Permit 14. Sewerlines have been installed at the site. They conform to the conditions of Nationwide 12 and its General Water Quality Certification. Stream ,-' bank stabilization is required by Wake County Erosion Control. Stabilization conforms to Nationwide 13. The majority of impacted vegetated wetlands are associated with the bottoms of recently drained ponds. These areas do not support small woody vegetation. Impoundments could not be brought up to Dam Safety specifications in an economically feasible manner and, therefore, were removed. The site plan incorporates the installation of stormwater ponds (in the preliminary design, process pending approval of this application) that will off-set some of the acreage of lost open water habitat. The proposed stormwater ponds will account for some replacement of the lost significant function (stormwater control and protection of downstream wetlands) of the impacted wetlands. Stormwater ponds will be designed to retain the first inch of run-off from impervious surfaces and then subsequently meter out the remaining water. Soil/Site Evaluation .
