APPROVAL of 401 Water Quality Certification and ADDITIO~AL CONDITIONS
I
Mr. Bill Spang
Spang Development, Inc.
111 Cloister Court, Suite 120
Chapel Hill, NC 27514
Dear Mr. Spang:
You have our approval to place flU in 1.08 acres of wetlands or waters for the purpose of developing the
Dogwood Ridge Subdivision in Apex, as you described in your application dated 1 July 1996. After
reviewing your application, we have decided that this fIll is covered by General Water Quality Certification
Numbers 3022, 2732 and 2671. These certifIcations allow you to use Nationwide Pemtit Numbers 12, 14
and 26 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. This certification
does not authorize any lot flll in the large wetland area between lots 110-114 of Phase I and lots 9-12 of Phase
II, or any flll in Phase III. Deed restrictions shall be placed on all lots with remaining jurisdictional wetlands
to prevent future fill. It should also be noted here that the Division encourages any wetland restoration efforts
in the old pond area in Phase I, Tract A Section II, as suggested by your consultant during his site visit with
our Regional Office. In addition, you should get any other federal, state or local pemtits before you go ahead
with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing,
You must act within 60 days of the date that you receive this letter, To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are fmal and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act !fyou have any questions, please telephone John Dorney at 919-733-1786.

The applicant proposes to impact 0,85 acres under NW 26, O. ] 0 acres under NW 26, and
0.210 acres under NW 12 fbr the construction ofa residential subdivision. Must impacts arc
associated wilh drained pond:;. A 100 foot buffer i::l proposed along the adja.cent creek and
stom'lwater ponds will be installed.
We have the following recommendations concerning this certification:
1, Woody shrub~ ,tnd/or trc:c:s should be established or retained in the 1 DO-toot buffel'~.
2, Place deed restrictions un the property to prevent any future wetland destruction by
current or future owners. Sufficient water should be routed to remaining wetlands to
maintain hydrology. However, energy should be dissipated t() prevent scouring uf lhe
wetlands.
Thank you fur the opportunity to provide input into the review process. If we can be of
further assistance, please contact our office at (919) 528-9886.

It is the RRO' S opInIon that this permit be issued with the
following conditions: 1) The wetland area in site 2 was created as
a result of the draining of a farm pond. The fill requested here
(,16 Acres) should be permitted as the quality of this wetland is
minimal. However, it was mentioned by the S&EC consultant that this
area would be a good potential mitigation site and that his client
may be willing to pursue this possibility. The RRO concurs with
this assessment. 2) The wetland area comprising site 3 is of high
quality and should remain preserved, Further, the small amount of
fill requested here (.08 Acres) should be denied as it appears that
there is enough existing space on lot #'s 9, 10, 11 to place houses
without fill.

Dear Mr. Dorney and Mr. Alsmeyer:
The purpose of this letter and application package is to request Nationwide
Permits 26, 14, 13 and 12 and Section 401 Water Quality Certification for the
project known as Dogwood Ridge. This project, owned by Spang Development,
Inc., is located near Apex, NC (Wake County). This site shown on the attached
plans and USGS Topo Quad vicinity map.
A Nationwide Permit 26 will be necessary to impact 0.85 acres (see map) of
jurisdictional wetlands for the development of a residential subdivision. A total
of 0.10 acres of impacts for a road crossing is requested under Nationwide
Permit 14. Sewerlines have been installed at the site. They conform to the
conditions of Nationwide 12 and its General Water Quality Certification. Stream
,-' bank stabilization is required by Wake County Erosion Control. Stabilization
conforms to Nationwide 13.
The majority of impacted vegetated wetlands are associated with the bottoms of
recently drained ponds. These areas do not support small woody vegetation.
Impoundments could not be brought up to Dam Safety specifications in an
economically feasible manner and, therefore, were removed. The site plan
incorporates the installation of stormwater ponds (in the preliminary design,
process pending approval of this application) that will off-set some of the
acreage of lost open water habitat. The proposed stormwater ponds will account
for some replacement of the lost significant function (stormwater control and
protection of downstream wetlands) of the impacted wetlands. Stormwater
ponds will be designed to retain the first inch of run-off from impervious
surfaces and then subsequently meter out the remaining water.
Soil/Site Evaluation . Mapping and Physical Analysis . Wetlands Mapping and Mitigation . Environm~ntal Audits
On-Site Waste Treatment Systems, Evaluation and Design
.
Storm water ponds are located downstream of the drained ponds. The locations
of the stormwater facilities is preferred because they can service a large portion
of the run-off from impervious surfaces. The proposed stormwater ponds will
provide storage and filtration functions and will protect downstream wetlands
from high velocity events and other degrading factors.
Please call if you have question or if you intend to perform a site visit.
Sincerely,
c~ ~~/t1U/Y
